Russell SUPERVISOR RUSSELL: Please rise and join in the Pledge of Allegiance to the Flag. Thank you. Before we get to the regular business of the meeting we are going to take a few moments to recognize a gentleman that we lost recently, Mr. Peter Bel, who was a member of Southold Town Anti-Bias Task Force. The town wants to express its condolences and I would invite at this point if members of Mr. Bel's family are here, I would ask you to please come forward. I am going to read a proclamation on behalf of the entire Town Board: `Whereas this Board on behalf of our community wishes to extend our sincere condolences over the passing of Peter Bel, a member of the Anti-Bias Task Force and whereas Peter grew up and went to school in Brooklyn, where he graduated Brooklyn College with a degree in Anthropology and a minor in education and then later attended Brooklyn Law School. Peter was a longshoreman, a drill press operator, warehouseman, tug boat fisherman and an artist and whereas in his service to the people of Southold Town as a member of the Anti-Bias Task Force since May 20, 2008, Peter showed a true understanding of the harmony, unity and compassion necessary for a bias-free community and his efforts contributed to the fulfillment of the committee's mission of overcoming bias and prejudice of any kind and whereas the Town of Southold is very grateful to the family of Peter Bel for sharing him with the Town for those many years during which he gave of his time, talents and energy, now therefore be it resolved that the Town Board wishes to March 25, 2014 Page 4 Southold Town Board Meeting give formal expression of its loss in the death of Peter Bel and when the Town Board adjourns this day, it does so out of respect to his memory and be it further resolved that a copy of this resolution be spread upon the minutes of this Town Board meeting and a copy be transmitted to the family of Peter Bel, that we may extend to them our sincere sympathy.' We actually have an exhibit of some of his work and I would invite all of you at the end of the meeting to please take a look at them. They will be on display here for a few days. Thank you. It just doesn't seem right. SUPERVISOR RUSSELL: I am just going to clarify Bob's point. We adopted a policy well over a year ago because of the huge number of events that are being requested of this town and the use of our public assets, especially our roads. The concerns of the police department, police chief and others, were heard by us, we adopted a policy that would more or less give preferential treatment to not-for-profits hosting events furthering their mission. Chapter 17 of the Code of the Town of Southold is hereby amended as follows: §17-13.1. Community Preservation Fund Management and Stewardship Plan adopted. The Town Board of the Town of Southold hereby approves and adopts the Town of Southold Community Preservation Management and Stewardship Plan 2009-2014 for real property interests acquired by use of moneys from the Town of Southold Community Preservation Fund, prepared by the Land Preservation Coordinator, D '°^*°r of the Depai4m of Publie Works, and the Stewardship Co ato presented to the Town Board during the Work Session of February 24,z-r-2009,25, 2014 and intended to be the management and stewardship plan required by § 64-e (6) of the New York State Town Law. III. I have a signed affidavit of publication in the Suffolk Times newspaper that it ran commencing on the 13th day of March 2014, signed by Karen Kine. I have an LWRP letter here from Mark Terry,principal planner and LWRP coordinator dated March 21, 2014 and in this it states that his recommendation of the proposed action is consistent with the LWRP policy standards and is consistent with the LWRP. And I also have here from Southold Planning Board a letter from mark Terry the principal planner that the proposed action has been reviewed to chapter 130 environmental quality review of the Southold Town Code and the New York State Department of Environmental Conservation regulation 6 NYCCRR part 617 of the state environmental quality review and it is my determination that this action is a type II action and therefore not subject to SEQRA review. Melissa Spiro Land Preservation Coordinator MELISSA SPIRO, LAND PRESERVATION COORDINATOR: Melissa Spiro, Land Preservation Coordinator. Just to add a little clarification to what this is. The Town of Southold as you all know, has a Community Preservation Fund, commonly known as the CPF Fund. It is a requirement that Towns with a Community Preservation Fund adopt a Management and Stewardship Plan if the town wants to spend any money from the fund for management and stewardship of lands acquired by the fund. So, the Community Preservation Fund Management and Stewardship Plan 2014 details proposed expenditures from the Community Preservation Fund for management and stewardship purposes in 2014 and into 2015. CPF Law states that not more than ten percent of the fund shall be utilized for the management and stewardship program. This plan is within the 10% allowance. The Town has adopted a Community Preservation Project Plan, not to be confused with the stewardship plan, which we call the CPF Plan. The CPF Plan is a separate document from the CPF Stewardship Plan; the CPF Plan identifies how the Town intends to preserve or protect properties and includes a list of eligible properties for actual acquisition, the CPF Stewardship Plan just deals with the stewardship and management of those lands. The Stewardship Plan includes a list of properties acquired with CPF funds for open space purposes and proposed projects and cost estimates for each property for 2014 and into 2015. Inclusion on the Plan does not necessarily mean that the Town will proceed with the particular project; that is still subject to a Management Plan for the specific project, prioritization of projects and Land Preservation Committee and Town Board approval for the specific project. Most of the proposed projects are just minimal improvements (trimming, signage, etc.) to keep the preserves we have open accessible and open for public use. Other projects are larger, such as March 25, 2014 Page 37 Southold Town Board Meeting replacement of the Pipes Cove pedestrian bridge that was damaged during Sandy. The costs shown per project are estimated and it is understood that not all projects will be approved or completed. In addition, others may be eligible for grant re-imbursement. The Town's preservation program has focused on acquisition. As a result, there is a backlog of properties needing specific Management Plans. It is the Town's goal and the Land Preservation department's goal to have a Management Plan, with a budget, for each preserve as we move forward. The Land Preservation Committee has reviewed the Plan and supports Town Board adoption of the Local Law. Thank you. Supervisor Russell SUPERVISOR RUSSELL: Thank you. Peter Terranova, Peconic PETER TERRANOVA: Scott, Town Board, I want to thank you for allowing the public to make some brief comments regarding, in today's work session regarding the possibly revisiting the EIS regarding the Goldsmiths Inlet jetty. COUNCILMAN RULAND: Sir, can you identify yourself? MR. TERRANOVA: Yes, I am sorry. Peter Terranova from Peconic. COUNCILMAN RULAND: Thank you. MR. TERRANOVA: I know we are going to have very interesting discussions over the next couple of weeks and it gives everyone from the community an opportunity to comment. For the benefit of some of our newer town board members who were not present during the last discussions that occurred back in 2009 and 2010, it means some of the issues that control it are going to be perhaps overwhelming but it is no secret that the members of the Peconic Sound shores community were against the shortening of the jetty and consequently were not necessarily in favor of revisiting the EIS, because there was some very solid, substantial reasons why the town board elected not to act on the EIS back in 2009. Two years ago, myself and Roxanne Zimmer, Roxanne who is the president of Peconic Sound Shores association, wrote a letter to town board members, okay, addressing this very issue of perhaps revisiting the EIS. And for the benefit of the new town board members who probably did not receive a copy of it, I just made some additional copies of that same letter that was written about two years ago. So with permission, I would just like to...again, Scott, thank you for giving us the opportunity to talk this afternoon. March 25, 2014 Page 38 Southold Town Board Meeting SUPERVISOR RUSSELL: Would anyone else like to address the Town Board on any issue to please feel free? Benja Schwartz, Cutchogue BENJA SCHWARTZ: Benja Schwartz from Cutchogue. How are you doing this evening? I didn't see anything on the agenda today about appointing any committee members to any committees in the Town of Southold. Did I miss something? Was there discussion at the work sessions? SUPERVISOR RUSSELL: There was no discussion yet. Applications had come in, we haven't had a chance to vet the applications, set up for interviews or anything of the things that we would do before we make appointments. MR. SCHWARTZ: But you are working on it? SUPERVISOR RUSSELL: We have, unfortunately, we have not been working on it yet. No, with the full plate of work, we have set it to the side for the time being. In the very near future we will be working on it. MR. SCHWARTZ: Okay, well, apparently you said it yourself. There's, work is not getting done. Now this is not just Scott's job, this is all six of your job, right? Is that correct? Jim, Jill, is this? COUNCILMAN DINIZIO: I am at a loss as to what job you are talking about Benja. MR. SCHWARTZ: To keep the committee's, Southold Town committee's organized. The law says `The Town Board shall by resolution may establish advisory committee's for such purposes as it may deem necessary' to assist in the performance of its duties. So these committees belong to the, in the town government are organized by the town board not the town supervisor. SUPERVISOR RUSSELL: Right, but we did just advertise for them. MR. SCHWARTZ: You put out some ads. COUNCILMAN DINIZIO: You know, we have to get, they have to answer, reply and then we have to look them over and then we have to set up an interview to see if they would be compatible with the committees that they want and then we choose them. That is not something that happens in a month. MR. SCHWARTZ: Well, unfortunately, let's see, what is it today? March 25th, so just a couple of committees, the first committee on the website, the agricultural advisory committee, three terms expire on March 31, 2014. Well, I, do you have plans to do something before then? Just in reviewing the first six or seven committees three terms expire on one committee, five terms expiring March 31, 2014 on another, six in another, two in another, another committee all 12 members terms are expiring March 31, 2014 and I didn't even get half way down the list of committees. So the ones that I looked at, out of those five committees, there is 28 members March 25, 2014 Page 39 Southold Town Board Meeting whose terms are expiring next week. But really, it's just, it is very sad. The committees are posted on the website. The committees also have the ability to post information under laserfiche. Now, do you all know what laserfiche is? Does anybody on the town board not know what laserfiche, because a lot of people I talk to, I mention laserfiche, they say what's that? Laserfiche is the database where all the town records are being kept and posted available in the town, in this building here, in the town hall and also online. And the committees have the abilities to post things on laserfiche. I am not going to go through all the details here, if you like I could help you to try and point out some of the probably hundreds of mistakes and things that are, it is not just that people are not being appointed. Minutes are not being taken. Now, as the town board you inherited all the town laws and you are the ones who created, the town board of the Town of Southold created the law that says minutes shall be kept during each meeting and shall be filed with the town clerk within 14 days of any meeting. But when I did a FOIL request for the minutes of one committee and I got back an answer from the Town Clerk that there were no minutes for that committee since it was formed up to the present, there has never been any minutes filed and I would guess that probably half of the committees in town do not have minutes filed with the town clerk. That is a guess. Looking, there are many committees that do have minutes filed also but I will just go through a few, I didn't get very far.... COUNCILWOMAN DOHERTY: Benja, what is your question? I don't understand where you are going? MR. SCHWARTZ: Well, my question is, it started out at the state of the town when we were discussing appointments to the deer management committee and I was told that it was all under control and it was organized. And if find out that it is not organized, it is not under control, that the committees are operating illegally, that the same committees are appearing on the town website under two different names as if there were two separate committees, that some committees are not listed. Some committees are listed as committees and then again are listed as departments and I am not talking about situations like the Land Preservation department which where there is also a separate Land Preservation committee. but umm... COUNCILMAN DINIZIO: Do you have a list, Benja? MR. SCHWARTZ: Well, I have been working on it but you know, it is a lot of work. And takes time and I have been working on it for a week but the committees that are listed on the website as departments supposedly there is a community development department, economic development department and then the Town Board created an economic development committee, so is it a committee or is it a department? The emergency preparedness department or is it the emergency preparedness committee? Well, if you don't know if it is a committee or department, then you are not going to be able to properly interact with that. It is not going to be accountable to you and you won't know how to keep track of what the committee is doing. You know, a lot of the committee's don't have chairpersons. The, the, what I would suggest and I would like to hear a commitment from you to do that would be to go through all the committees and to put on the website the official name of the committee, either a copy or a link to the resolution establishing the committee. many of them, establishing resolutions for the committees are filed in the committees folders on laserfiche and it is very, very easy to link from the website to the March 25, 2014 Page 40 Southold Town Board Meeting laserfiche, so you don't have to put it in another place, you just have to link to what is already there in the case of the committees that already have it online. In case of the committees that don't have it online, someone has to research it. Why bother? Well, right now it is very confusing because we have committees and online it says the committee was formed in 2012 but the establishing resolution is from 2002 so not only is there a lot of information missing, there is false information, incorrect and inconsistent, conflicting information on the website. You know, I can't do it myself. I can help you do it. I am willing to help you. if you would like I will complete this summary list and I will provide it to you, if you give me an indication that you are committed to working on this situation. COUNCILMAN DINIZIO: Scott, do you mind if I comment on that? SUPERVISOR RUSSELL: No, please feel free. COUNCILMAN DINIZIO: About six weeks ago, we got together with the department heads and mostly those are elected committees and appointed committees and we are in the process right now of establishing through their meetings and their getting together and some procedures and some standards that they have to follow, try to get these things written down, just like you said. You know, who does the minutes, who is responsible for them? You know, well okay, the minutes we have, we keep the minutes, let's go to the next step, okay, where do they go? They should be looking in that in laserfiche to find out their just where their resolution, the resolution that created them, where they should be going. And I think that gets lost because the committees change so often and I could tell you that at the Zoning Board when I was on there, we did that. We established procedures, we established some standards. Just basic things like how we treat each other, how to go to a site and do inspection. What you can do, what you can't do, what you can talk about, what you can't talk about, all of those things that we established and then every year review. And we are trying to get the rest of the boards in town to come into that and certainly that would be a way to straighten out what you're saying, which I agree. The website and laserfiche and trying to find things is very difficult and I have been involved in town politics for 25 years so, you know, sometimes there are things I just can't find. I know they are there and if I go through the entire year, every application, I will find it but trying to get to it is very difficult. I do appreciate what you do, I'd appreciate any list you would give me and you know, I will certainly, I don't know that we can assign anybody, we are running on a shoestring here. But you know, we can try to get those committees to straighten themselves out, if they know they have problems. So, you know, feel free to give us whatever you can, I will make sure the committees get them. MR. SCHWARTZ: I appreciate that, Jim. I mean the Anti-Bias Task Force may not be the most key committee in the whole town but of the five terms that are expiring, both of the chairpersons terms are expiring on the same day. Now to me that is not a question of oh, I didn't have time, I didn't get to it. When they were appointed it should have been obvious that you don't appoint two co-chairpersons to expire at the same time. You stagger their terms. There are in the resolutions establishing one committee it says it should be five members, there happen to be six. There's all kinds of inconsistencies like that, to the point that the whole thing is very confusing and it is not just the committees as you mentioned, the departments are not well organized either, March 25, 2014 Page 41 Southold Town Board Meeting do not appear to be well organized. As a member of the public, you know, you are responsible for running the town government and you are responsible to the public and I think putting the information out there so that someone doesn't have to go to FOIL requests and you know, I could have sent 50 FOILS to the Town Clerk but I didn't want to burden the Town Clerk with that. Most of the information I was able to discover on the website but a lot of it was missing. Should be here. There's other problems, like the accountability of the various committees. Particular I am thinking about the Conservation Advisory Council, I was trying to understand how the Conservation Advisory Council is supposed to work or is working or is changed, the establishing resolution for the Conservation Advisory Council speaks very clearly that the purpose and the mission of the Advisory Council is to take directions, follow directions of the Town Board and to report to the Town Board but it appears that most of the matters the Conservation Advisory Council deals with are Trustee matters and it appears that it has been working with the Trustee's board to the point that in the laserfiche system, the minutes of the Conservation Advisory Council are filed underneath the Trustees folder rather than the Town Board folder, but of course, the Town Board doesn't have a folder. Doesn't have a website. That's one of the boards, there's committees, departments and boards which are not well organized and I am not asking to make them all wear uniforms and fit into one mold but I would like to see them follow the law and work in an open manner that people can find out what they are doing, what they aren't doing and perhaps assist them and I think if we could do that, I think we would have and maybe work out some procedures for the appointments and the, revise the terms. Now you can revise the terms. Just because you have got a committee now where all 12 of the members expire on the same date, you can change that at any time. The Town Board has absolute control over these committees. Are you going to, 1, Jim, I take your answer as a yes and I will devote more of my time to trying to specifically identify the specific issues that are apparent from a review of the website and laserfiche. Can I get a feeling from the other five of you whether this is something that you would be willing to work on because it really doesn't interest me to waste my time identifying problems if nobody is going to try to correct them. COUNCILMAN DINIZIO: Like I said before, Benja, we are working on that. I mean..... MR. SCHWARTZ: Well, I would like to hear that from them. COUNCILMAN DINIZIO: Six weeks ago we started working on that and that process started years ago, at least on the Board that I was on and I intend to take it onto the other Boards. You know, there are problems with some Boards that you know, don't think they need those things. There's problems with Boards that just don't meet enough or they just don't have enough time to devote to them. So you know, one by one you have to chip at these things, at these kind of problems and the more information that you have, the more information that you can provide that things you don't see as unsatisfactory. I certainly would make sure that they get that information and hopefully that will help them formulate their standards and procedures. MR. SCHWARTZ: Thank you. Could I hear from the other Town Board members? March 25, 2014 Page 42 Southold Town Board Meeting COUNCILMAN RULAND: What is it that you would like to hear, sir? That we are not going to cooperate with you if you have information to provide us? By all means, certainly do. You are implying that we sit here and do nothing and I take exception to that. MR. SCHWARTZ: I don't think I am implying anything. COUNCILMAN RULAND: Alright, you are stating it. You are stating it. MR. SCHWARTZ: I am not stating and I am not implying that you do nothing I am implying that there is a lot of things that are not being done. And I am not implying that, I am stating that as a fact. That the... COUNCILMAN RULAND: Are you done? You interrupted me. Are you done? MR. SCHWARTZ: No, I am sorry. I thought Jill asked me a question. I will let you finish. COUNCILMAN RULAND: No, by all means. You interrupted me. MR. SCHWARTZ: I interrupted you? COUNCILMAN RULAND: You cut me off. MR. SCHWARTZ: I thought you decided telling me that I was accusing you of doing nothing and I took that as a, you know, I am not here to fight or argue or make trouble. I am trying to help you. For example, the committees on the laserfiche, I have got a list here that marks which ones are not on the website at all, are not even mentioned on the website and then the ones that are on the website but under a different name. so you have the community development block grant reviewing committee, then is the community development committee. the CSEA committee on laserfiche is labor management on the website, I believe but I am not sure. But I think these should be checked out and there should be a consistency with the use of names. Does that make sense to you? Okay. so then I will work on it. there are committees that are, there are things that are called committees on the website that are not really committees like the list of liaisons, town board liaisons to committees. There are committees that are required to have town board liaisons that don't appear to have liaisons. There is something called a town board standing committee which I don't believe is a committee, I believe, I think what you are talking about is not a question of whether it is a standing committee or if it is a special committee but I think you are talking about a committee of the whole. When you say town board standing committee. there actually there are three things that are identified as town board standing committees. Three committees. One of them I don't think should be there at all, the other two maybe should be committees as a whole. It should be in addition to that list of the police commission. Do you all know that you are members of the police commission? COUNCILMAN RULAND: Yes. SUPERVISOR RUSSELL: Yes, we do. March 25, 2014 Page 43 Southold Town Board Meeting MR. SCHWARTZ: Okay, because last, couple of years ago I mentioned that and one of the council people had no idea that there was a police commission. Have you ever had a meeting of the police commission? Taken minutes? It is part of town law when you run a police force, supposed to have a police commissioner. You have a police committee but the police committee is not a police committee. SUPERVISOR RUSSELL: We understand the distinctions, so let me just say is what you are basically doing is you are standing up here at a public meeting and you are criticizing many volunteers who contribute your time and their efforts to Southold Town despite their busy lives. You accused them of having illegal meetings and you are implying that they are operating under some cloak of secrecy. The meetings are all publicly noticed, they are noticed well in advance and these are volunteers, so let's remember that the police advisory committee and all these groups you are mentioning, they are volunteers that surrendered some of their time to help advise us as best they can. If the minutes of meetings happen to be missing, if at the end of the day appointments happen to be expiring at the end of this month, it is not fatal. They are advisory, they are not, they don't have any formal standing to review applications or to review projects, they are advisory in nature. And it is not fatal if their.... MR. SCHWARTZ: I take it you are happy with the way it is and I won't bother.... SUPERVISOR RUSSELL: Would I like to see it improve? Yes, but would it be high on my list of priorities? Absolutely not. COUNCILWOMAN DOHERTY: Benja, there is always room for improvement but from what I am getting at from what you are saying is you are implying if you don't see it on the website that it is not happening and that's what I am getting from what you are saying and I just want to make that clear to everybody that is listening,just because you don't see it on the website and can't get the minutes on laserfiche doesn't mean it is not there and is not happening. Not everybody is computer savvy and not everybody goes to the computer for every little thing. We still have people come in and want the paper. SUPERVISOR RUSSELL: I don't mean to be rude but it is my son's 10th birthday, so I am going to leave. I am sorry, Benja. I promised him I would be home by now. MR. SCHWARTZ: I am finished then but Jill, that is not what I said, that is not what I meant. COUNCILWOMAN DOHERTY: Okay. MR. SCHWARTZ: I specifically stated that I had made a request for the minutes of one committee that did not exist and that I did not request the minutes of the other.... COUNCILWOMAN DOHERTY: But you said that they are not being done. MR. SCHWARTZ: I believe many of them do not exist. Yes, I believe that. March 25, 2014 Page 44 Southold Town Board Meeting COUNCILWOMAN DOHERTY: That is your belief. That doesn't mean it is true. MR. SCHWARTZ: That is correct. COUNCILWOMAN DOHERTY: Okay. I just want to clarify it. COUNCILMAN DINIZIO: Jot it down, Benja. Jot it down and give it to me. COUNCILMAN GHOSIO: For me a measure of a problem was also the amount of people that come and express it as being a problem. As far as I know this problem that you are bringing up today has only been mentioned by one person and that would be you. I have worked on lots of committees and I sit on various boards, not just in my public life but also in my private life and I do know that these issues of replacing members can be time consuming particularly since I don't see a line at the back door of people dying to get on the committees. And that is, again, both in my private and public life. Scott is right, these are volunteers. By and large they do a great job. A lot of these committees were put together so the folks that live in town can participate in their government and I applaud them for that but you know, if was to listen to you and some of the points that you are making, the one thing I can take away from this is perhaps we need to streamline and eliminate some of these committees that may or may not be doing what you think they should be doing. And I would suggest that perhaps we start to think in those terms. Maybe we should evaluate the committees. Some of these committees may exist and they haven't met in a long time because they serve no real purpose. One of those would be the dredge committee. the dredge committee was formed five years ago, it met a few times and it may have actually outlived its purpose. So you might be right in that regard. So I think we maybe that's the direction we ought to go in. MR. SCHWARTZ: So you are willing to work on this situation then? COUNCILMAN GHOSIO: Oh, I am ready to evaluate whether there is a real problem and certainly see if there are committees that are listed that maybe have outlived their reason to exist. Certainly. MR. SCHWARTZ: Well, why don't you get back to me if you would like some assistance. COUNCILMAN GHOSIO: Sure. MR. SCHWARTZ: Thank you. COUNCILMAN DINIZIO: Oh, I thought you were going to bring me some stuff? MR. SCHWARTZ: Jim, I am perfectly willing to work and work hard and for nothing but when I hear people blaming me for identifying situations, proclaiming that oh, nobody else is complaining so it is not a problem. You know, this is the kind of thing you hear from good of boys. This is the kind of thing you hear from government that has modern tools but is not March 25, 2014 Page 45 Southold Town Board Meeting properly using them, is not utilizing, is not, you know, we have a company from Kansas that we are paying money to I think every month, I don't know how much they are getting to do the Southold Town, official Southold Town website. I don't think they really care about Southold Town. I don't think anybody, really when you have the same committee on the same list under two different names that indicate to me nobody has looked at it, nobody has read it. Why? Because it is all very confusing, it is hard to understand, I am talking about streamlining it and simplifying it so that you can make sense of each page and of all the pages. I am offering to help you with that and instead I am getting attacked. COUNCILMAN RULAND: Send it along. COUNCILMAN DINIZIO: Bring it by, you know I will take care of something, whatever you have there, Benja. MR. SCHWARTZ: So you will review it if I finish the report? COUNCILMAN GHOSIO: What would your report contain? What is it.... COUNCILMAN DINIZIO: Well, no, let's review it. COUNCILMAN GHOSIO: I will review any piece of paper that comes before me. COUNCILMAN DINIZIO: I mean, somebody in the audience has something to say, this concerns him. You know, listen, I am willing to take anything you got, Benja. Anything at all and certainly look at it and you know, do whatever needs to be done. I may not interpret it the same way you do but I am certainly willing to have the discussion, if you want to bring me what, what you want to discuss. MR. SCHWARTZ: I will. I will contact you.
