No. 4367 - Special Exception (Accessory Apartment) Dear Mrs. Westerbeke: After review by Board Members on March 6, 1996 of your entire application, the Board indicated that your application for a special exception does not comply with subsection 13-m of Section 100-31-B of the Zoning Code which requires that a Certificate of Occupancy must be issued prior to January 1, 1984. Even though the building permit was issued 11/3/83 for construction of a new dwelling, a major portion of the house was not able to be completed by January 1, 1984, and in fact, the Certificate of Occupancy is shown to be issued 11/18/88. Your application is being returned at this time for the reason that Town Law, Section 274-b of the State of New York does not authorize a board to approve an application which fails to comply with all legislatively mandated conditions. Please confirm by letter of your intentions to request a refund of the $400 filing fee, and we will forward a recommendation to the Town Clerk to return the application fee based upon the above. They would like to use $400 filing fee paid for special exception toward the processing of a variance. Terry, Town Clerk FROM: ZBA Officq�5rz ✓-a DATE: September 9, 1996 RE: Request for Refund - Appl. #4367 (Westerbeke) Mrs. Westerbeke was asked to file for approval of an existing apartment by the enforcement department. Mrs. Westerbeke was informed by the ZBA staff that she was not able to comply with Section 100-31B, subsection 13-m, due to the January 1984 cut-off date for eligibility. The Board later confirmed this again after review by members. Mrs. Westerbeke has requested a refund of the filing fee of $400 paid concerning their former application for an Accessory Apartment. It is recommended that $350.00 be refunded, as part of the $400 paid by applicant, which will cover costs and services resulting from the processing of the application: a) review and preparation of material to open new file, review neighbor notices for accuracy; research for prior actions and other historical information, and process; filing application "as is" with the Town Clerk (as per discussions with applicant, who wanted to communicate with Code Review Committee as to consideration for possible new cut-off date for C.O. eligibility); b) duplication (five sets) of the file for Board Members' review and discussion at a public meeting; There was no advertisement or other services (except numerous discussions with the enforcement officer) since it was known from the beginning that the date of the C.O. did not allow eligibility. GEORGE STANKEVICH: My name is George SLankevich, and in the course of remedy I will just state that I think the application fully covers the reasons why this application is necessary and why it is in your interest and the Town' s interest to grant it. Thank you very much. MR. DOUGLASS: Thank you. In this application is there anybody wishing to speak against it? (THERE WAS NO RESPONSE. ) MR. DOUGLASS: If not, I ' ll just say a couple of words. In checking this over , we find that there apparently ate some discrepancies in the right-of-way, stuff that has to be straightened out, still yet by you people somewhere along the line. out in front of it, the right-of-way which they want a setback variance for, because this is a corner lot and it ends up with two frontyards, it is on a very definitely set-up private right-of-way. There being no objections to it, it is a pre-existing lot, why I would make a motion that the setback be 'granted and the access be granted provided they have egal right of title for the access road and that the access road -se improved to our regular specifications. If that meets with your approval, why I-- MR. TUTHILL: I'm not clear--there' s an existing blue stone-- MR. DOUGLASS: That' s not it. MR. TUTHILL: The stone road that goes along the side of this property. Now there' s another one that' s a paper street. Is that the other proposed corner or is it actually a physical road that comes off of the-- MR. DOUGLASS: There isn ' t any there; it' s still a paper road. MR. TUTHILL: They propose to open it up? MR. STANKEVICH: I think they would propose to open the minimum up to gain access because of the expense. Mrs . McLean has sold the lot at $6,000, a very low price in order to finance her son' s educa- tion. And sell this and an adjoining lot, so-- And the purchaser' s builder, I'm sure, is, I think lie' s going to pay for the improvements but only minimum improvements because it' s his daughter' s house and he' s doing it on a-- MR. TUTHILL: As of now it' s just a technical corner lot? MR. STANKEVICH: Yes, sir. SUwnluLU '1VWN i3ullRU VY' Ak'A"i MR. DOUGLASS : But it is a recognized private road. MR. STANKEVICH: True, and that' s the necessity of a variance. It' s got to comply with technicalities or get a variance: ) MR. DOUGLASS : Right. So I would go with it that way, approve setback on the private right-of-way and the access with proof of 1 right of title, and it to be improved to the specifications we require. A 15-foot with either stone-blend or oil and so ind so forth. . MR. STANKEVICH: I have the .specs. MR. DOUGLASS : You have them, right. As I said there seems to some dispute on that access road. MR. STANKEVICH: The title company has the -answer. we will rovide you with a copy. H MR. DOUGLASS: Right. Do you agree with it? 0 MR, TUTHILL: I ' ll second it. After investigation and inspection, the Board finds that the d applicant is requesting a variance for 24-foot frontyard setback, and the property has three front yards leaving the other a rearyard N which requires this variance for 24-foot setback. The applicant is also requesting approval for access on the 30-foot right-of-way 1 extending from the Goose Creek Lane Association right-of-way for which there appears to be litigation pending about legal title. However, the Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hard- ship created is unique and would not be shared by all properties alike in the immediate vicinity of the property and in the same use district; and the variance will not change the character of the neighborhood and will observe the spirit of the Ordinance. After much discussion and investigation, it was decided that a set of specifications should be drawn up and used as guidelines for the improvements of the rights-of-way. On motion by Mr. Tuthill, seconded by Mr. Grigonis, it was RESOLVED, that all rights-of-way, private road or other means of access to one or more parcels of land or buildings shall conform to the following requirements : (1) Such access road shall have a width of not less than 15 feet. (2) Such access road shall be cleared of all trees, brush and other obstructions to a width of 15 feet. (3) Such access road shall be improved in either of the following methods : (a) Such access road shall be surfaced with a minimum depth of 4 inches of packed 3/4 inch stone blend so as to afford access for emergency vehicles. Such stone blend may be either applied to the ground surface & shaped, or the surface may be excavated to permit r the application of packed blend to a depth of 4 inches. (b) The access road shall have topsoil removed to a depth of 8 inches and then filled with "8 inches of a good grade of stone and sand bank run. The surface shall then be covered with a layer of 2 inches to 4 inches of 3/4 inch stone blend. (c) Oiled with a minimum of 4/10th of a gallon of road oil per square yard. (4) All work required as hereinbefore set forth shall be performed under the supervision of the and no building permits or certificates of occupancy shall be issued by the Building Inspector until the has certified that such access road has been constructed in accordance with the foregoing requirements . (5) Where the terrain of the land over which such access road is to traverse is such that drainage problems may occur, the applicant shall be required to construct such drainage facilities as may be recommended by the Town Engineer. (6) The Board of Appeals may in passing upon any appeal for approval of access make any reasonable exception as in its judgment it deems appropriate to the circumstances. Vote of the Board: Ayes : . There being no objections to it, it is a pre-existing lot, why I would make a motion that the setback be 'granted and the access be granted provided they have egal right of title for the access road and that the access road '-tie improved to our regular specifications. If that meets with your approval, why I-- MR. TUTHILL: I 'm not clear--there' s an existing blue stone-- MR. DOUGLASS: That' s not it. MR. TUTHILL: The stone road that goes along the side of this property. Now there's another one that' s a paper street. Is that the other proposed corner or is it actually a physical road that comes off of the-- MR. DOUGLASS: There isn 't any there; it' s still a paper road. MR. TUTHILL: They propose to open it up?
