HEMMINGWAY, residing at 01030 S.W. Counts Street, Portland, Oregon, 97219-7841, as to an undivided one-third (1/3) interest party of the second part, WITNESSETH, that whereas letters testamentary were issued to the party of the first part by the Surrogate's Court, Suffolk County, New York,on April 6, 1994 and by virtue of the power and authority given in and by said last will and testament, and/or by Article 11 of the Estates, Powers and Trusts Law, and in consideration of TEN ($10.00)-------------- dollars, ---------------_-------------- -------------- ------------------`- - paid by the pzrly of the second part, does hereby grant a,u release unto the party of the second part, the distributees or successors and assigns of the party of the second part forever; ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and beingtx2be at Peconic, Town of Southold, County of Suffolk, and State of New York, bounded and described as follows: DISTRICT BEGINNING at a monument set on the easterly side of Soundview Avenue, which point 1000 is distant the following courses and distances from the point of intersection of the easterly side of Soundview Avenue with the northerly side of Peconic Mill Lane; SECTION NORTH 10 degrees 52 minutes 40 seconds East, 227.49 feet to a point; 068.00 North 01 degrees 20 minutes 20 seconds West, 265.00 feet to a point marked by a BLOCK monument, and from said point of beginning the following courses and distances: 04.00 THENCE North 01 degree 20 minutes 20 seconds West along the easterly 'side of Sound- LOT view Avenue, 310.00 feet to a monument; 021.000 THENCE South 60 degrees 10 minutes 00 seconds East, 534.71 feet to a monument; THENCE South 60 degrees 10 minutes 00 seconds East, 234.50 feet to a monument, said last two courses and distances being along land now or formerly of John and Julia Sepenoski; THENCE South 30 degrees 45 minutes 00 seconds West along land now or formerly of Robert Celic, 264.36 feet to a monument; THENCE North 60 degrees 54 minutes 00 seconds West along land now or formerly of Robert Johnson, 604.52 feet to the point or place of BEGINNING. BEING AND INTENDED TO BE the same premises conveyed to Jules J. Bond, deceased, by deed dated July 30, 1990 recorded in the Office of the Clerk of the County of Suffolk on September 27, 1990 in Liber 11142 page 477. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and also all the estate which the said decedent had at the time of decedent's death in said premises, and also the estate therein, which the party of the first part has or has power to convey or dispose of, whether individ- ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the secondpart,the distributees or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid. Subject to the trust fund provisions of section thirteen of the Lien Law. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
