Wilcenski, Chairman Members of the Planning Board Date: March 28, 2014 Re: Request for Comments: Southold Historical Society Antique Market SCTM#1000-62.-2-5.2 ZBA#6737 The Planning Board has reviewed the special exception request for an Antique Market on the parcel referenced above. The subject parcel is 2.87 acres and split-zoned. Nearly 2 acres are in the Hamlet Business zoning district fronting Route 25 and Maple Avenue, and 1 acre is in the R-40 zoning district in the rear (southern) portion of the parcel. There is a drainage easement to the Town in the flag area of the parcel which accesses Hobart Lane in the southeast corner of the parcel. Whether this easement is actively used by the Town will require more research. This proposal is for an antique market with eighteen vendors and a proposed vendor parking area within the R-40 portion of the lot. In general, locating retail activity in the hamlet center is consistent with the goals of the Town and the Comprehensive Plan. The Board, however, has concerns over parking and what types of items will be sold that they would like to further evaluate. At this time, the Planning Board does not have enough information to support the requested special exception. The Board recommends a site plan application--if required--concurrent with the application to the ZBA so that the impacts from this proposal can be examined in more detail. Further, a building permit application (which begins the site plan application process) will also help to identify any other zoning issues and potentially save the applicant from having to make a second application to the ZBA. For example: commercial parking in an R-40 zone is not permitted; however, it can be approved by the ZBA (§280-78 H & 1). The Board of Fire Commissioners understand the importance of the Historical Society encouraging greater use of the museum grounds however they do have to consider the emergency services that are provided to the community. Unfortunately, the Board does not have the personnel to monitor the parking facilities every Sunday from May to October. The Board requests that you please take into consideration their concerns. The Historical Society has sponsored funding-raising events throughout the years which have required the cooperation of the residents of Maple Lane, a "private road". These annual events have included a hay ride down our street in October, the lighting of the Christmas tree on the property of the Society in late November, and the Ice Cream Sunday event on a Saturday in August. We the residents have been supportive of the need for these events by the Society, even though our street, designated by the Town as a "private road", becomes in fact a parking area for the general public on those days. This has meant that on some occasions it has become difficult for us residents to navigate getting in and out of our own properties either on foot or by car because of the traffic. But this has been part of our contribution toward supporting the Society over the years in their need to fund-raise. 2. Just to review what the implications of living on a "private road" are for the residents of this hamlet: we have to maintain the road at our own expense, we are responsible for picking up our mail at the Post Office and when snow storms occur we have to pay for the removal of the snow from our street. So there are on-going expenses we incur because of the choice we have made to live on Maple Lane, a street which has a history in the hamlet of great beauty and charm. 3. The Society's proposal which you are deliberating here today does envision a parking space on the Society's property for vendors' trucks and vehicles. But it doesn't take into account the need for consumer parking. The proposal envisions the Flea Market operating on Sundays from loam to 3pm throughout the months of May, June, July, August, September, and October— precisely the period of time when our area experiences its greatest volume of traffic. Where are consumers to park? On the Main Rd in the vicinity of the Society's property? The public restaurant next to Society ( Founders' Tavern) already depends on Main Rd. for customers' parking. Should consumers at the Flea Market) park across the road at the Fire House? Crossing the Main Rd. on a Sunday at the time of the Flea Market's operation would be a disaster. The most logical alternative would be to have them park on our street, a "private road". We, the resident's, at 315 Maple Lane are resolutely opposed to this. There would simply be no way for us to enforce our right to maintain and use our street for the purposes we designate. And the fact is that our street is now blessed by the presence of a number of young kids whose safety might very easily be compromised by the very real potential of increase traffic on the street. Surely the Town would not be interested in providing some form of traffic control on Main Road each Sunday (as it does on the occasions of other events the Society sponsors.) Another concern regarding consumer parking is the possibility of some auto vehicle accident or personal injury on our street followed by litigation possibly against one of us residents. We welcome our guests on the street and are prepared to deal with potential difficulties that might occur involving them. But we would not be pleased having to become involved in such problems involving the general public. That's why we are on a private street. We've had an occasional sinkhole in the middle of the street which I have called about; manhole covers have popped out from a large degree of water flow. The street sweepers I believe have bottomed out on some parts of the road that are sinking. NYS has installed many catch basins on Main Rd. to help with the water situation, however the water table has now risen and stays elevated for much longer. I will present myself at the hearing on Thursday, April 3, 2014,to be heard against the granting of the Special Exception. In the meantime I would request that this letter be made part of the file. This letter refers only to that part of the Society's site plan called "Vendor Parking".This is the lawn to the south of the historical buildings, which I believe the Society calls the "South Field". It may not be obvious to one reading the site plan that the area for Vendor Parking is a lawn, a grass plot. The surface is grass, and it is maintained as a lawn, with weekly mowing, etc. Also it may not be clear from the site plan that the entire plot designated Vendor Parking is not flat ground. Part of the plot, perhaps 25%, is a wooded slope going down toward Hobart St. The sloping section would not be available for parking. Further, if appropriate 15 to 25 foot barriers were required to buffer the parking lot from the abutting residential properties to the west and south, parking for the vendors is concentrated even more. The site plan shows eighteen (18)vendor booths. I infer that Vendor Parking would have to accommodate at least eighteen (18) cars or trucks or SUVs, each Sunday, May to October,for seven hours each Sunday (giving time to set up and fold up the displays).This adds up to 182 hours of parking by each of the eighteen vehicles, on the twenty-six Sundays from May to October, each year going forward.That is heavy use. I am assuming in all of this that the Historical Society is not contemplating resurfacing the South Field with an impervious surface like macadam or concrete. I am advised that one quart of motor oil is sufficient to pollute 250,000 gallons of well water. On our property, 315 Maple Lane (called the Heller property on the tax map), there is an artesian well just two feet removed from the South Field. (It is used for irrigation, not human consumption.) I do not have the record of other wells in the neighborhood, or what would be 9 0 the effect of the leeching of pollutants from parked cars to the nearby wetlands or the discharge basin which is just a few hundred feet away on Hobart St. We are all aware of the issues raised in regard to the parking of the Sandy-damaged cars in Calverton, and that was on a cement surface. One can hardly imaging the outcry if the plan was to park the cars on grass! All of the above would be an issue even if the grass lawn were dry and firm. But add a heavy or moderate rain to the picture, on any Friday or Saturday before the flea market is opened on each of the twenty-six Sundays from May to October, and the contours of the South Field would be forever damaged. In the southeast corner of the South Field,there are still ruts from the entrance of one utility truck for construction purposes fifteen years ago. When wet,the ground is soft and vulnerable. It is classic Southold clay ready to be molded to your demand, and to keep its new shape, however ugly, permanently. As a resident of Southold for forty-six years, and as the co-owner of property which has the most exposure to the South Field, I oppose any use that would subject the South Field to environmental or aesthetic abuse, and that includes using it as a parking field on a regular basis through the late spring, summer and early fall. And aside from my interest in avoiding what would be for 315 Maple Lane a property-value disaster, I submit that if the Historical Society is permitted to go forward with the opening of this business and use the South Field for Vendor Parking, a valuable part of the patrimony of the Hamlet of Southold will be forfeited, and to what benefit? We would exchange our birthright for a bowl of stew (Gen 25:32), or a pile of old comic books.
