The objective of the said conspiracy to commit fraud, the unlawful activities involving forging of deeds, forging of surveys and other documents, is to legalize the theft of the Private Road property. The stolen property is a 100-year old Right of Way (ROW), adjacent to the former property of Donald and Russell Case, the said ROW owned by subdivisions of the Wickham Case estate. Wickham Case family is separate branch of unrelated to the Donald and Russell Case family. Lawyers are held to even higher standards. It has come to our attention that you have been allegedly submitting a fraudulent survey issued by Peconic Surveyors, P.C., Lic. N. 49618 referring to the 1000-16-6-12.0 lot situated at 12400 New Suffolk Avenue. The said lot 12.0 is certified by Advocates Abstract Inc #ADA2455-S Stewart Title Insurance Company. Penny Wells LaValle David Triebs RE: ILLEGAL CHANGE TO THE COUNTY TAX MAP IN 2013 IN REFFENCE TO: 12400 New Suffolk Avenue address, Cutchogue, NY-11935 Prior to 2013 the property was associated with Tax Map #1000-116-6-12.0 The property was ILLEGALLY split into 1000-116-6-12.1 & 1000-116-6-12.2 ANNEXING THE NEIGHBORING LOT I visited the Tax Map Division in January 2014 and requested information, entitled to by Freedom of Information Act, about the above 2013 illegal change to the Tax Map. I was informed by the staff that there is no formal procedure to follow when requesting a Tax Map change, that there was no application made for the 2013 illegal change and that the requestor for the above ILLEGAL change is UKNOWN. I was not allowed to see or get the survey based on which the change to the Tax Map was made. The relevant record in Tax Map for Parcel ID NUMBER 1000-116-06-12 shows that parcel was illegally split into two lots 12.1 & 12.2. (Exhibits, Page 1 - Illegal 1000-116-06-12 lot split.) The illegal split was evidently made based on a forgery: the survey done by Peconic Surveyors, the survey stamped as received on Nov 4.2013 by Board of Trustees (Exhibits Page 2, - Planning Board Letter states "no record of approved subdivision") (Exhibits Page 3, - Nov 4, 2013 stamped forgery, the survey by Peconic Surveyors) RETIRED/REPLACED PARCEL 1000-116-6- 12, Liber 12106 P108, (Exhibits, Page 1) consisted of one lot, "115 feet wide and 300 feet deep more or less", as said in the P108 deed and as referred to in the 2012 the Tax Roll record. (Exhibits, Page 4 - Liber 12106 P108 deed, lot size 115 x 300) Lot 1000-116-6-12 115 x 300 feet was then SPLIT/ replaced by 12.1 and 12.2 lots Lot was split into: 1000-116-6-12.1 115 x 300 Parcel 1 Liber 12718 P266 and (Exhibits, Pages 5&6 - Liber 12718 P266, lot 115 x 300) 1000-116-6-12.2 33 x 300 Parcel 2 Liber 12718 P267 (Exhibits, Page 7&8, Liber 12718 P267, irrelevant Quit Claim deed with no conveyance whatsoever and not even referring to the said lot 12.2 at all) TOTAL of parts 148 x 300 - DEFIES COMMON SENSE The said SPLIT defies common sense because the PARTS of the supposedly DIVIDED property when added are BIGGER THAN THE WHOLE. When combined together lot 12.1 lot and lot 12.2 lot are -30% bigger than the supposedly divided 12.0 lot. The 2013 forged survey also includes the land past the high water mark, supposedly to inflate the acreage in order to confuse and help with the deceit. The size and location of the 12.2 lot on the Tax Map is exactly the size and the location of the Private Road property, the 100 Year Old Right of way. The hand written mark on the Quit Claim deed, at the top right corner of the page, the deed referring to lot 12.2 indicates R/O/W. The deed doesn't make any sense, description referring to apparently some other location or no location at all. Furthermore, the Liber 12718 P267 QC deed was issued by the person that never owned any such property. This Quit Claim deed is as relevant to the ownership of lot 12.2 as a Quit Claim deed to Brooklyn Bridge would have been if it were put forth as the evidence of the ownership. (Exhibits Page 7&8 - The Quit Claim deed FRAUD, an irrelevant deed referring to some non-existent and indefinable property, description referring to the neighboring Fitzgerald's land.) The current Tax Map is based on a forged survey, forged deeds and forged documents used in a criminal conspiracy to steal half a million dollars worth of real-estate property. The fraudulent Tax Map is unlawfully used as evidence of ownership in a Supreme Court lawsuit brought against alleged owners of 12400 New Suffolk Avenue property who illegally occupied the land. The Tax Map was used as an initial vehicle of the CON. We respectfully request that the Tax Map be IMMEDEATELY corrected. The stolen property is the Private Road property, adjacent to the former property of Russell Case at 12400 New Suffolk Avenue address. The said Right Of Way is owned by the subdivisions of the Wickham Case estate. Wickham Case family is separate branch of an unrelated family to Russell Case family. (Exhibits, Page 9 & up - The Private Road property, 1946 Tax Map and other ROW related evidence. The undisputable evidence of the Private Road property ownership is in the Suffolk County public records. Page 10 The 1950's Agreement of the owners in common of the Private Road property, agreeing to limit the Private Road to foot traffic. George H. Case 12400 New Suffolk Avenue owner at the time, ancestor of Donald and Russell, is mentioned as being on the West border of the ROW, the Private Road. 12400 New Suffolk Avenue property never had and have no rights of any kind whatsoever to the ROW property.
