PO Box 1547 Riverhead, NY 11901 Re: Standard Subdivision of N&L Properties, LP Oregon Road, Cutchogue NY 11935 SCTM#: 1000-73-01-01 Zoning District: R-80 Dear Mr. Cuddy, This letter is a follow-up to our meeting on December 10, 2009 regarding the above referenced application. Based upon this meeting, the application still does not meet the Yield requirement necessary for the Planning board to accept this application for review for the following reasons: 1) Insufficient Yield. Your application is proposing a total of three (3) Lots on 5.814 acres in the R-80 Zoning District., where Lot 1 totals 84,463 square feet and less the flag area 80,000 square feet, Lot 2 totals 80,000 square feet and Lot 3 totals 80,000 square feet. While you have correctly deducted the "flag pole" portion of Lot 1 as ` unbuildable land" and therefore not used it to calculate Yield, the Town of Southold would still require a turn-around area for emergency vehicle access. There is no turn-around shown on this map. Further, the proposed easement over a portion of Lot 2 to encumber 9 feet of the right-of-way to remain free and clear for emergency vehicle access and to meet Southold Town Highway specifications requiring a 25 foot right-of-way cannot be used as part of the initial Yield calculation. See below. Pursuant to Southold Town Code §240-10: Technical Requirements, a Yield Plan shall be determined on buildable lands only. See below. B. Yield plan. (1) Purpose. The purpose of the yield plan is to determine the allowable density. (2) Standard subdivision. A yield plan shall be prepared for a standard subdivision in accordance with the requirements of this section and shall include a requirement to provide affordable housing. (a) Density. The permitted number of dwelling units shall not exceed the number of units that, in the Planning Board's judgment, would be permitted if the land were subdivided into lots conforming to the minimum lot size and density requirements of this chapter applicable to the zoning district (or districts) in which such land is situated and conforming to all other requirements of the Town Code. (b) Total lot yield shall be determined on buildable lands only. Subdivision design shall exclude the following features, unless the applicant shall have obtained a permit from all relevant regulating authorities approving the applicant's right to place residential structures in the subject areas: [11 All underwater lands. [2] Tidal wetlands or freshwater wetlands, as defined in state and local regulations. [3] Bluffs, primary dunes and secondary dunes. [41 Beaches below mean high water, as defined by the United States Coast and Geodetic Survey or latest Tidal Wetlands Survey, and any beach or area lying between this line and the coastal erosion hazard line. [5] Areas required for park dedication pursuant to this chapter. [61 Areas required for recharge basins or for natural area recharge. [71 Areas required for public or private rights-of-way. [81 Areas required for utilities or public facilities, except that minor utility easements of direct service to the subdivision may be included. [91 Areas for which the development rights have been transferred, sold or extinguished. [101 Areas which the Planning Board shall determine to be ofsuch character that they cannot be used safely for building purposes without danger to health or peril from fire, flood, drainage or other menace to neighboring properties or the public health, safety and welfare. Buildable lands are defined by the Southold Town Code as follows: §240.3: Defmitions BUILDABLE LANDS The area of a lot or parcel, not including the square footage of tidal andfreshwater wetlands, land seaward of the coastal erosion hazard area line, beaches, bluffs, primary dunes, secondary dunes, underwater lands, land subject to the transfer, sale or extinguishment of development rights and other restrictions that prevent the use of such land for construction of buildings or other development The terms "wetlands," "beaches," "bluffs,"and "underwater lands" shall have the meanings set forth in Chapter 275, Wetlands and Shoreline, of the Town Code. The terms "coastal erosion hazard area line, " 'primary dunes" and "secondary dunes" shall have the meanings set forth in Chapter 111, Coastal Erosion Hazard Area, of the Town Code. • • Because the proposed right-of-way for vehicular and emergency vehicle access constitutes "buildable" land, it cannot be used as part of the yield calculation. For the foregoing reason, your proposed application of a standard subdivision of three (3) lots in the R-80 zoning district on 5.814 acres of land continues to not meet the Yield requirement to move forward. The Southold Town Planning Board has also reviewed your letter dated March 25, 2010 where you reference Tall Pines at Paradise Point subdivision and the turn-arounds shown on the lots for Yield Map purposes submitted and accepted by the Planning Board in 2006. With respect to the former Tall Pines at Paradise subdivision (since withdrawn and acquired by the Town of Southold as protected property on June 5, 2008), turn-arounds were allowed to be shown as part of the lots on the Yield map because there was more than sufficient area (square footage) overall for each of the lots to meet yield requirements, with or without the turn-arounds shown on the lots themselves. In the present case of the proposed N&L subdivision, 2 out of the 3 proposed lots (Lots 2 & 3) are shown to be exactly 80,000 square feet in size which is the minimum square footage allowed in the R-80 Zoning District. Because emergency turn-arounds are not part of "buildable lands"(Southold Town Code §240-3) and are instead considered "unbuildable", therefore they cannot be shown upon lots whose square footage is exactly 80,000 square feet of only "buildable" lands without minimizing the requisite square footage needed in the R-80 Zoning District. At this point, the applicant may want to withdraw the application, present an application with fewer lots to meet the yield requirement or come up with a design that meets the yield and allows for three lots. This appears to be contrary to prior practice. For instance, in 2007 the subdivision known as Tall Pines at Paradise Point, Southold had series of lots where the turn-around area was included in the lot yield. You will recall that I met with you and Mr. Terry and we spent considerable time discussing the 25 ft. entrance road and 16 ft. flag pole for lot#3. We originally had a turn- around and I was advised that that was not required. I don't know what has changed to cause it to be required. There is no encumbrance of 9 ft. at lot#2. The 9 ft. showing there simply designated the additional footage on lot #2 (25-16=9). 1 don't understand your analysis, although I appreciate you provided us with the basis of your conclusion, i.e., Town Code Section 240-10 and 240-3. I would like to schedule a meeting with you and Mr. Corwin so we may determine what configuration of the road and flag lot, if any, will satisfy the Town Code.
