This is not merely a POTENTIAL habitat, a now very rare example of a previously common habitat of old growth deciduous forest of mixed oak and hickory with many trees greater than 2-3 ft. diameter lying next to a brackish tidal marsh, but is AT PRESENT the home and territory of numerous species including many of especial concern. All of the following species which I will enumerate have been observed by experienced North Fork Audubon Society members. This large property of which at least 25 acres is already cleared adjacent to the Creek offers plenty of areas for several homes without destroying any of the woods, if you as a board would take that stand. Either inside or within 500ft of this parcel the following species are resident nesting or regularly observed (i.e. daily). *designates species under special Federal, New York State DEC or IUCN( International Union for Conservation of Nature) protections.. All species listed are protected under the Migratory Bird Treaty Act Yellow-Crowned Night Heron "population viewed as at moderate risk. The wetlands flagging all seems fairly accurate. You'll note three points close to SR 25 that are spread apart a bit. Those are new to reflect the wetlands to the end closest to SR 25. SCTM#1000-75-6-6.-1 Zone: A-C Dear Mr. Gillies: The Planning Board at its July 21, 2008 Work Session reviewed the application for Sketch Approval and the Yield Map for the above referenced subdivision. The Planning Board has decided to reject the Yield Map as presented for the following reasons: The Yield Map does not conform to the Southold Town Code: 1) Proposed 25' ROW is shown as being only 50' from wetlands. See Flag 4. § 275-3 (D) (1) (a) [2] indicates that a driveway needs to be setback 50' from a wetland boundary. This ROW is not a driveway. It is a road; §275-3 (C)(1) and (5) state (paraphrased): The Town Trustees have jurisdiction over Land within 100 feet of ...any tidal wetland. 2) If this ROW is considered a "common driveway" and not a road, then does not comply with §240-45(C)(2): "...maximum number of lots using proposed common driveway shall be two..." This proposal shows 4 lots. §240-10(B): Yield plan. (1) Purpose. The purpose of the yield plan is to determine the allowable density. (2) Standard subdivision. A yield plan shall be prepared for a standard subdivision in accordance with the requirements of this section and shall include a requirement to provide affordable housing. (a) Density. The permitted number of dwelling units shall not exceed the number of units that, in the Planning Board's judgment, would be permitted if the land were subdivided into lots conforming to the minimum lot size and density requirements of this chapter applicable to the zoning district (or districts) in which such land is situated and conforming to all other requirements of the Town Code. 3) As discussed at the July 21, 2008 Planning Board Work Session, the Planning Board would like to have written documentation provided of the following: a) common ownership between the subject property and the adjacent property owner (SCTM#: 1000-75-6-6.2) referenced with regards to an easement for access to the proposed lots. b) An agreement between the parties as to granting the easement. c) An agreement to remove the accessory structure next to the easement so that two front-yards are not created by this easement resulting in a non-conforming lot in violation of the Town Code. Accessory structures are required to be in the rear yard. See §280-15 —Accessory Buildings and Structures. 4) As further discussed at the July 21, 2008 Planning Board Work Session, the applicant will refer to the Town Trustees regarding the distance of the proposed ROW to the wetlands. We understand that a variance has been requested on the setback requirements. This is an area of mature deciduous woodland lying along a creek which has been designated by the DEC as a "Critical Environmental Area." The designation is entirely appropriate as it is a nesting area for ospreys, purple martins, kingfishers, bluebirds and a constant roosting and feeding area for Great and Snowy egrets, Green and Black-Crowned Night Herons, Common Terns, and Great Blue Herons among numerous other species. How interesting that the species that are most threatened by developments are often chosen as the name. The Town Wetland Code and specifially Chapter 275 was developed with a considerable amount of work and care for the purpose of preserving and protecting the environments that are so unique on our North Fork, many of them unique in New York State.The 100 ft. buffer between houses, sanitary systems, clearing of vegetaion and the wetland is the crux of this protection. If one can easily obtain a variance to allow these smaller and smaller parcels to support 2nd and primary homes and the human and pet disturbance, noise, automobiles, septic runoff and woodland clearing that inevitably result one is left to wonder about the usefulness of and respect we afford to any law.
