As Executor of the Last Will and Testament of JOHN M. MONTGOMERY, a/k/a JOHN MICHAEL
MONTGOMERY, late of Suffolk County, deceased, Suffolk County Surrogate's Court File No. 2013-
955
party of the first part, and
PHYLLIS MONTGOMERY, residing at 159 Sterling Avenue, Greenport, NY, 11944
party of the second part,
WITNESSETH, that the party of the first part, by virtue of the power and authority given in and by said last
will and testament and in consideration of TEN ($10.00) dollars, paid by the party of the second part, does
hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being in the Village of Greenport, Town of Southold, County of Suffolk and State of New
York, bounded and described as follows: '
BEGINNING at a point on the southerly side of Sterling Avenue, distant 93 feet easterly from the corner
formed by the intersection of the southerly side of Sterling Avenue and the easterly side of Carpenter Street;
running thence along the southerly side of Sterling Avenue, North 74 degrees 24 minutes 00 seconds East, a
distance of 42 feet to land now or formerly of Booth Estate; thence along said land South 15 degrees 13
minutes 50 seconds East, 118 feet to land now or formerly of Damalas and Moraitis; thence along said land,
South 68 degrees 38 minutes 50 seconds West, 54 feet to land now or formerly of Goldin; thence along said
land and land now or formerly of Bond, North 2 degrees 52 minutes 30 seconds West, 39.29 feet; thence
along land now or formerly of Klipp, North 13 degrees 01 minutes 10 seconds West, 85.18 feet to the
southerly side of Sterling Avenue, at the point or place of BEGINNING. Said premises being commonly
known as 159 Sterling Avenue, Greenport.
BEING AND INTENDED TO BE the same premises conveyed to john M. Montgonery, now
deceased, by deed dated May 6, 1975 which deed has been recorded in the Office of the Clerk of the
County of Suffolk on May 12, 1975 in Liber 7838 at page 308.
TOGETHER with all right, title and interest, if any,'of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof, TOGETHER with the
appurtenances, and also all the estate which the said decedent had at the time of the decedent's death in said
premises, and also the estate therein, which the party of the first part has or has power to convey or dispose
of, whether individual, or otherwise;
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the
sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first
above written.
