This application must be filled in by typewriter or ink and submitted to the Building Department with the following:
A. For new building or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual natural or
topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains less than 2/10 of 1 % lead.
5. Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and "pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and unusual natural or topographic
features.

INSTRUCTIONS
a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

Based on the information you have submitted, the New York State Department of
Environmental Conservation has determined that the property that is landward of the
substantial man-made structures, which are more than 100 feet In length, and existed on or
before August 20, 1977, as shown on Tidal Wetlands Map No. 706-4538, is beyond the
jurisdiction of Article 25 (Tidal Wetlands).
Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6 NYCRR
Part 661), no permit is required under the Tidal Wetlands Act Please be advised, however,
that no construction, sedimentation, or disturbance of any kind may take place seaward of the
tidal wetlands jurisdictional boundary, as indicated above, without a permit.
It Is your responsibility to ensure that all necessary precautions are taken to prevent any
sedimentation or other alteration or disturbance to the ground surface or vegetation within
tidal wetlands jurisdiction which may result from your project. Such precautions may include
maintaining an adequate work area between the tidal wetland jurisdictional boundary and your
project (i.e., a 15 to 20 feet wide construction area) or erecting a temporary fence, barrier, or
hay bale berm.
Please be further advised that this letter does not relieve you of the responsibility of obtaining
any necessary permits or approvals from other agencies.

9. The addition and aiteratians to the e)dsft gage, as applied for, are only for purposes of
providing unheated storage in an area above the first floor, and to provide storage area for
parking/storage of the family's two vehicles. The height to the top of the ridge of the new roof will be
24 feet matdmum.
2. The applicant is proposing now additions and alterations to tits etussting dwelling for the purpose
of convecting the home from summer use to year-round occt"ncy, The Board is not in agreement
with applioarWs proposal for an octagonal deck at 27 feet from the (Fortner) sea wag, and discusses
agemathe relief, noted below.
3. Homes in this residential waterfrzlnt cxlrr mumty (Sag Lake vigags) data back to the 1930s, having
been renovated and updated. The neighborhood consists mainly of one-slory, single-farnity homes,
on nonconfottrang-size lots located on 8 peninsula of lames Creek and Peconic Bay. There are a
few dwwelling$ with second-floors, designed with relatively shallow roof tines that match the orte-story
homes in the community:
4. Grant of alternative relief will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby pmperfies. The alternative relief reduces the height of the
new aecond-ffOOr addition to the home to 26 feet measured Iron Wmrid to brie tap of the roof ridge,
instead of the applicant's request for 30 feet to the top of the rod ridge. The alternative relief for the.
garage denies the raised balcony area originally proposed by the applicant. The increase in the
degtsa of normarrfarmity for the garage will not reduce the setback and will contribute to the owo
attracUv character of the property
5. The benefit sought by the applicant cannot be achieved by some method, feasitrte for rte
applicant to pursue, other than an area variance, The size of the lot is nonconforming at 20,286
square feet Sections of the lot will continue to maintain restricted buffer areas from the Creek and
Great Peoonic Hay waterfront and beach area owned by the applicant.
6. The relief granted herein i6 substantial. The code requires a minimum of 75 feet from bukheads,
and the setback for the new construction will be an Increase in the existing nonconformtly at 24.7
feet at its closest point (to the house at the no Ureast corner), and for the shed. all as shown on the
August 24, 2005 land survey prepared by John C. Ehlers.
7. The difficulty has been self-created since the garage and dwelling have etdsted in noneonformoV
locations for many years.
8. N0 evidence has been submitted to sugge st Utet variances in this residential community will have
an adverse impact on the physical or environmental catdMuns in the neighborhood, The applicant
has obtained auttorization ftom the Southold Town Board of Trustees and the New York State
Department of Environmental Conservation for new construction activities.
9. Grant of the requested relief is the rrsnirnum action necessary and adequate to eneble the
applicant to enjoy rte benefit of additions and alterations, while preserving and protecting the
