SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated January 8, 2014 stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency
review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. The LWRP Coordinator issued a recommendation dated March 3, 2014. Based upon the information
provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records
available to us, it is our recommendation that the proposed action is INCONSISTENT with LWRP policy standards
and therefore is INCONSISTENT with the LWRP. However, with the re-positioning of the proposed in-ground
swimming pool and the conditions placed on the property, the Board finds the action consistent with the LWRP
policy because the amended application locates the proposed pool as far from the top of bank as practicable.
PROPERTY FACTS/DESCRIPTION: Subject property is located in the R40 Zone district containing 27,106 sq.
ft. of which approximately 9100 sq. ft. is unbuildable. It is improved with a 1 %2 story dwelling with attached
decks. It has 110.00 feet of frontage on North Sea Drive, 250.90 feet along the western property line, 110.49 feet
on Long Island Sound and 253.12 along the eastern property line as shown on the survey dated April 6, 2009, last
revised October 31, 2013 prepared by Nathan Taft Corwin, III, LS.
BASIS OF APPLICATION: The applicant requests variances from Article III Code Section 280-15 and Article
XXII Code Section 280-116A(1) and the building Inspector's December 4, 2013 Notice of Disapproval based upon
on an application for a building permit for an accessory in-ground swimming pool, at: 1) location other than the
code required rear yard, 2) less than the code required 100 foot setback from the top of the bluffibank.
RELIEF REQUESTED: The applicant is requesting construction of an in-ground swimming located partially in the
side yard, where the code requires accessory structures to be located in the rear yard, or in the case of waterfront

properties in the front yard, and a setback of 51 feet from the top of the bluff/bank where the code requires a 100
foot setback from the top of a bluff/bank.
AMENDED APPLICATION: During the hearing, the applicant's agent presented an alternative site plan sketch
that would bring the plan into more conformity with the code. It shows the in-ground swimming pool being turned
ninety degrees which places it at approximately 70 feet from the top of bluff/bank using an elevation of 10 feet to
establish the location of the top of the bluff/bank, as proposed by the applicant's agent. The Board then requested a
survey showing the proposed pool location, as amended, at both the 10 foot and 18 foot elevation lines,which was
received on March 17, 2014. This survey shows a 68 foot setback and a 43 foot setback respectively. The Board
accepts the determination by the LWRP coordinator that locates the top of the bluff/bank on the applicant's
property at the 18 foot contour line, which places the proposed pool, as amended, at 43 feet from top of bluff as
shown on the survey dated April 6, 2009, last revised March 11, 2014 prepared by Nathan Taft Corwin, III, LS.
ADDITIONAL INFORMATION: At the hearing, the agent for the applicant submitted a section of the subdivision
map that showed two parcels with swimming pools that received variances from the Board of Appeals for bluff
setbacks, one with a 40 foot setback and the other with a 51 foot setback. In Appeal #3859 (October 4, 1989) the
Board used the 15' contour line to define the location of the top of the bluffibank on a neighboring property, which
created a 40 foot bluff setback for a proposed in ground swimming pool, thereby setting a precedent for this
neighborhood. Based upon a discussion with the Agent for the applicant, it was agreed that both of the former
variances granted were on lots that had greater dune height than the subject property. The Zoning Board requested
comments from Suffolk County Soil & Water. In a letter dated March 5, 2014, they stated, "no obvious natural
resource limitations were found" and recommended the installation of a drywell for pool discharge and draining.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on March 6, 2014 at which time written and
oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and
surrounding neighborhood,and other evidence, the Zoning Board finds the following facts to be true and relevant
and makes the following findings:
1. Town Law &267-b(3)(b)(1). Grant of the variances as amended will not produce an undesirable change in the
character of the neighborhood or a detriment to nearby properties. There are other pools in the neighborhood with
non-conforming bluff/bank setbacks and the proposed amended location for the subject pool is in keeping with
those precedents. Only a small portion of the pool will be in a side yard so most of it will not be visible from the
street.
2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for
the applicant to pursue, other than an area variance. The applicant could place the in-ground swimming in a
conforming front yard location. However, this would be out of character with the neighborhood and the pool
would not be easily accessible from the applicant's house.
3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 57%
relief from the code for the proposed bluff/bank setback, and 100% for the partial side yard location. However, the
amended pool location places it as far from the top of bluff/bank as practicable and the proposed non-conforming
bluff/bank setback is similar to other non-conforming setbacks for swimming pools in the neighborhood.
Additionally, the proposed location is only slightly in the side yard and moving it entirely to the rear yard, while
maintaining the amended setback of 43 feet from the bluff/bank, would interfere with an existing septic system.
4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential
community will not have an adverse impact on the physical or environmental conditions in the neighborhood. The
applicant must comply with Chapter 236 of the Town's Storm Water Management Code.

5. Town Law &267-b(3)(b)(Q. The difficulty has been self-created. The applicant purchased the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
6. Town Law &267-b. Grant of the amended relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of an in-ground swimming pool while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-13, motion was offered by Member Goehringer, seconded by Member Schneider, and
duly carried, to
GRANT, the variances, as amended, and as shown on the survey dated April 6, 2009, last revised March 11, 2014
prepared by Nathan Taft Corwin, 111, subject to the following conditions;
Conditions:
1. Pool mechanicals shall be placed is a sound deadening enclosure.
2. Drywell for pool de-watering shall be installed.
That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued.
Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays
and/or a possible denial by the Building Department of a building permit, and may require a new application and
public hearing before the Zoning Board of Appeals.
Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey
cited above, such as alterations, extensions, or demolitions, are not authorized under this application when
involving nonconformities under the zoning code. This action does not authorize or condone any current or future
use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does
not increase the degree of nonconformity.
Vote of the Board: Ayes: Members Weisman (Chairperson), Schneider, Horning, Goehringer, Dantes. This Resolution was
duly adopted(5-0).

Dear Chairperson Weisman,
This Firm represents Mr. George Curis who obtained a zoning variance for a proposed swimming
pool at the premises referenced above. Thereafter,we filed with the Southold Town Trustees
obtaining their permit. The application was subsequently amended to substitute a wood deck in
lieu of a concrete patio. Also,the proposed pool equipment and drywell was relocated to the
eastern portion of the lot(away from the adjoining neighbor,Antonaidis,and adjacent to the
vacant parcel n/o/f Petty's Bight Association).
I am now advised to seek a"diminimus amendment"to the zoning variance that would permit the
Trustees to proceed with our requested amendment and eventually file for a building permit.
Enclosed herewith please find three copies of the survey prepared by Nathan Taft Corwin last
dated June 16,2014 which depicts the proposed changes. By way of this correspondence,I
request that you issue the requested"diminimus amendment"so that this project can proceed as
depicted on the enclosed survey.

As per your request a site investigation was conducted at SCTM# 1000-15-1-5 at 3190 North Sea Road in
Orient, NY on March 4, 2014. This site is the location for a proposed 18'X36' in-ground pool. At the time
of the site visit, no obvious natural resource limitations were found on the subject property.
This parcel has an existing home with a well-established lawn. Most of the rear yard leading to the bluff-
top is flat or slopes gently toward the bluff. Roof water runoff at the present time is directed to gutters
and downspouts and exits into the ground.
The bluff face is low in elevation and vegetated.There is an existing stairwell leading to the beach below
in good repair.Storm high tides and possible normal high tides appear to reach the toe of the slope as
there is apparent scouring.There is no toe stabilization present on this parcel nor does there appear to
be a need for any at this time.The homeowner should monitor this.
The proposed location of the swimming pool is the only available location for the proposed pool to be
placed on this parcel. It is recommended that provisions be made for draining the runoff generated by
the proposed new construction so that additional surface water is not directed over the bluff edge.
Runoff from all new construction should be directed into existing drywells. Additional considerations
must be taken to ensure that the top of the bluff is not disturbed by construction equipment. According
to the plan survey, a dry well is to be installed for pool discharge and draining the pool. The installation
of this dry well is necessary. It is advised to avoid draining the pool unless absolutely necessary as the
chemicals used in pool maintenance are harmful to the environment. It the pool does need to be
drained, gradually discharge de-chlorinated water into the dry well.

Code Section 280-116A(1) and the Building Inspector's December 4, 2013 Notice of Disapproval based
on an application for building permit for accessory in-ground swimming pool, at; 1) location other than
the code required rear yard, 2) less than the code required 100 foot setback from top of bluff, located
at: 3190 North Sea Drive (adj. to Long Island Sound) Orient, NY. SCTM#1000-15-1-5
The Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
INCONSISTENT with the policy standards and therefore is INCONSISTENT with the LWRP.
Policy 4.1. "Minimize losses of human life and structures from flooding and erosion hazards." The
following management measures to minimize losses of human life and structures from flooding and
erosion hazards are recommended.- specifically
A. Minimize potential loss and damage by locating development and structures away from
flooding and erosion hazards.
The "top of bluff' is not identified correctly on the survey. Town code defines a bluff as:
Bluff-Any bank or cliff with a precipitous or steeply sloped face adjoining a beach or a body of
water. The waterward limit of a bluff is the landward limit of its waterward natural protective
feature. Where no beach is present, the waterward limit of a bluff is mean low water. The
landward limit is 25 feet landward of the receding edge or, in those cases where there is no
discernible line of active erosion, 25 feet landward of the point of inflection on the top of the
bluff. The "point of inflection" is that point along the top of the bluff where the trend of the land
slope changes to begin its descent to the shoreline.
By definition, the top of bluff is more accurately delineated at the 18' topographical contour as
show on the survey dated as last revised October 31, 2013. This is validated by the location of
the Coastal Erosion Hazard Area which includes the bluff on this parcel furthering the goals of
the Coastal Erosion Management Program. A program goal applicable to this action is to
"Regulate new construction or placement of structures in order to place them a safe distance
from areas of active erosion and the impact of coastal storms to ensure that... structures are not
prematurely destroyed or damaged due to improper siting, as well as to prevent damage to
natural protective features and other natural resources."
In the event that the action is approved it is recommended that the pool be relocated or re-
oriented to achieve the greatest distance from the top-of-bluff as practicable to mitigate impacts
from future coastal storms (erosion).
Furthermore, portions of the parcel are included within the FEMA VE flood zone (Figure 1).
FEMA defines VE zones as "areas subject to inundation by the 1-percent-annual-chance flood
event with additional hazards due to storm-induced velocity wave action". It is recommended
that the proposed pool be re-located or re-oriented to maximize the distance from the coastal
high hazard area to the greatest extent practicable to prevent future potential loss from storm-
induced erosion.

8 consistent with the LWRP. So there seems
9 to be a conflict among the consistency of
10 the properties that are adjacent to each
11 other.The remainder of this memo goes
12 onto describe what a bluff is, and that
13 definition is listed directly from the
14 Town's Coastal Erosion Hazard area,which
15 does not apply in this case.We are not
16 near the Coastal Erosion Hazard area.And
17 then he proceeds to challenge the bluff
18 and gives the definition of the term bluff
19 and contained within the Coastal Erosion,
20 which is not applicable here. He is
21 suggesting that the bluff would be located
22 18 foot contour. We are going to say that
23 this is validated by the Coastal Erosion
24 Hazard area.

Mark Terry Response—Yes,the pool is outside of coastal erosion hazard area, however, erosion is not limited to that
area only. A case in point is that most of the Peconic Bay shoreline suffered severe erosion during "Sandy"and it is not
mapped as a coastal erosion hazard area.
One of the purposes of the Chapter 111 Coastal Erosion Hazard Areas is to:

erosion and the impact of coastal storms to ensure that these structures are not prematurely destroyed or damaged due
to improper siting, as well as to prevent damage to natural protective features and other natural resources
Policy 4.1 furthers this purpose. The LWRP CC review asks the Board to maximize the distance from the top of bluff. I
review these actions with consideration of future storm events capable of causing severe erosion and loss of the
bluff. The recommendations made attempt to prolong the "life" of the structures and minimize loss.
MEMBER HORNING: So what you have
22 pointed out to us is that there is a
23 discrepancy.The surveyor has the top of
24 the bank in one location and around 11-12
25 elevation.And Mark Terry is saying that

1 is incorrect.The top of the bank is
2 actually at the 18 foot elevation,which
3 makes the setback totally different.
4 MR.ANDERSON: The reason why we are
5 saying that is that we are saying that his
6 assessment is flat out incorrect. It's
7 incorrect for basically five reasons.The
8 first reason is that the DEC tells us
9 there jurisdiction goes to the 10 foot
10 contour line or to the top of the bluff,
11 whichever is more landward. So in this
12 case,the 10 foot contour is the top of
13 the bluff as shown on the survey.And that
14 is in your application packet.So that is
15 reason number one.
Mark Terry Response—The NYSDEC missed that the top of bluff is more landward of the 10'contour.
Reason number two is,
16 Terry says it's 18 feet by virtue of the
17 Coastal Erosion Hazard area line and he
18 actually got that backwards because the
19 Coastal Erosion Hazard area line would be
20 25 feet landward from the top of the
21 bluff.
Mark Terry Response—the top of bluff is located at the 18'contour because of the definition of the bluff, not the coastal
erosion hazard area. The point in the LWRP CCR is that the NYSDEC mapped the coastal erosion hazard area to include

the bluff area identifying it as having the potential for severe erosion. The location of the line supports the feature as a
bluff. The top of bluff/bank line in this case does not follow the slope but, rather the vegetation planted and this is
incorrect. Note the extreme jog of the line to the north shown on the survey.
Mr. Anderson is correct that the definition of bluff includes a built in buffer of 25'. Essentially it locates the top of
bluff 25' landward of the point of inflection.The "point of inflection" is that point along the top of the bluff where the
trend of the land slope changes to begin its descent to the shoreline. However,the 25' is not consistently applied in the
Town so in the LWRP CCR review I located the top-of bluff at the 18' contour. I discussed this with Jen Andaloro prior to
sending the review to your office. A topographical map is provided below showing the bluff slope on the properties in
the area below(figure 1) . Examples of past decisions recognizing the bluff follow.

13 Town,and what that is, is the Town has
14 stepped into the position and is actually
15 implemented the State Coastal Erosion
16 Hazard Area law.The Town accepts the maps
17 that are promulgated to that program.They
18 are not challenging the maps or the lines
19 to the bluffs.And the surveyor is
20 spotting the Coastal Erosion Hazard area
21 line as per the adopted and accepted map.
22 Therefore all of that would show that the
23 surveyor actually got the setback correct.

Mark Terry Response—The location of the coastal erosion hazard line is not being challenged so the discussion above
confuses the issue. The location of the top of bluff line is the issue. The LWRP CC review recommends locating
structures farthest from features in active erosion or potential for active erosion to the greatest extent practicable.
I found one past permit issued by the Board of Trustees(Antoniadis) in this area for actions that did not encroach
farther into the setback to the bluff than existing structure. Therefore the proposed actions were not evaluated to
potential loss from erosion.
I saw that the applicant submitted a new survey identifying the setback from the 18' contour line. Call me to discuss if
you would like.

A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list,policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town).

Conservation has determined that the property landward of the 10 foot elevation contour
on a gradual, natural slope as shown on the survey prepared by Nathan Taft Corwin III
dated 04/06/09, is beyond Tidal Wetlands Act (Article 25) jurisdiction. Therefore, in
accordance with the current Tidal Wetlands Land Us^ Regulations (6NYCRR Part 661)
no permit is required.
I Be advised, no construction, sedimentation, or disturbance of any kind may take
place seaward of the tidal wetlands jurisdictional boundary, as indicated above, without
a permit. It is your responsibility to ensure that all precautions are taken to prevent any
sedimentation or disturbance within Article 25 jurisdiction which may result from your
project. Such precautions may include maintaining adequate work area between the
jurisdictional boundary and your project (i.e. a 15' wide construction area) or erecting a
temporary fence, barrier, or hale bay berm.
This letter shall remain valid unless site conditions change.

raising the property out of the floodplain. Management efforts in this area seek to
mitigate the effects of flooding through the siting and design of structures.
The intent of this policy is to protect life, structures, and natural resources from flooding and
erosion hazards throughout the Town of Southold. The policy reflects state flooding and erosion
regulations and provides measures for reduction of hazards and protection of resources.
Definitions
Coastal Barrier Resource Area is any one of the designated and mapped areas under the Coastal
Barrier Resources Act of 1982, (P.L. 97-348), and any areas designated and mapped under the
Coastal Barrier Improvement Act of 1990 (P.L. 101-591), as administered by the U.S. Fish and
Wildlife Service, and arty future designations that may occur through amendments to these laws.
Coastal Hazard Area is any coastal area included within the Erosion Hazard Area as designated
by the New York State Department of Environmental Conservation pursuant to the Coastal
Erosion Hazard Areas Act of 1981 (Article 34 of the Environmental Conservation Law), and any
coastal area included within a V-zone as designated on Flood Insurance Rate Maps prepared by
the Federal Emergency Management Agency pursuant to the National Flood Insurance Act of
1968(P.L. 90-448) and the Flood Disaster Protection Act of 1973 (P.L. 93-234).
Natural protective features are nearshore areas, beaches, dunes, bluffs, and wetlands and
associated natural vegetation.
Policy Standards
4.1 Minimize losses of human life and structures from flooding and erosion hazards.
The following management measures to minimize losses of human life and structures
from flooding and erosion hazards are suggested:
A. Minimize potential loss and damage by locating development and structures away
from flooding and erosion hazards.
1. Avoid development other than water-dependent uses in coastal hazard
areas. Locate new development which is not water-dependent as far away
from coastal hazard areas as practical.
a. No development is permitted in natural protective feature areas,
except as specifically allowed under the relevant portions of 6
NYCRR 505.8.
b. Avoid hazards by siting structures to maximize the distance from
Coastal Erosion Hazard Areas.
C. Provide sufficient lot depth to allow relocation of structures and
maintenance of required setbacks over a period of thirty years.
2. Avoid reconstruction of structures, other than structures that are part of a
water-dependent use, damaged by 50% or more of their value in coastal
hazard areas.
3. Move existing development and structures as far away from flooding and
erosion hazards as practical. Maintaining existing development and
structures in hazard areas may be warranted for:

a. structures which functionally require a location on the coast or in
coastal waters.
b. water-dependent uses which cannot avoid exposure to hazards.
C. sites in areas with extensive public investment, public
infrastructure, or major public facilities.
d. sites where relocation of an existing structure is not practical.
4. Provide public infrastructure in or near identified high velocity flood
zones, structural hazard areas, or natural protective features only if the
infrastructure:
a. will not promote new development or expansion of existing
development in: a Coastal Barrier Resource Area, except as
provided in the Coastal Barrier Resource System Act; a Coastal
Erosion Hazard Area; or a V-zone.
b. is designed in a manner which will not impair protective capacities
of natural protective features, and
C. is designed to avoid or withstand damage from flooding and
erosion
5. Manage development in floodplains outside of coastal hazard areas so as
to reduce adverse environmental effects, minimize the need for future
structural flood protection measures, or expansion of existing protection
measures and to meet federal flood insurance program standards.
B. Use vegetative non-structural measures to manage flooding and erosion hazards.
1. Use vegetative non-structural measures which have a reasonable
probability of managing flooding and erosion, based on shoreline
characteristics including exposure, geometry, and sediment composition.
2. Use vegetative measures to increase protective capabilities of natural
protective features.
Discourage clearing of existing, particularly indigenous vegetation during
siting, design, construction and regrading phases of any development
project.
3. Discourage alteration of existing natural drainage contours and swales and
encourage enhancement of those natural drainage features where they
exist.
C. Enhance existing natural protective features and processes, and use non-
structural measures which have a reasonable probability of managing erosion

nourishment, dredge disposal, or by restoring coastal processes.
a. Use only clean sand or gravel with a grain size equivalent to or
slightly larger than the native material at the project site.
b. Design criteria for enhancing the protective capabilities of beaches
should not exceed the level necessary to achieve protection from a
30-year storm, except where there is an overriding public benefit.
C. Provide for sand by-passing at engineered inlets or other shore
protection structures to maintain coastal processes and protective
capabilities of beaches.

Variance to the Zoning Ordinance, Article XXIII, Section
100-239d (A) (1) , as disapproved, for permission to construct an
inground pool with deck and fence, within 100 feet from the
Sound in this R-40 Zone District. Property Location: 3410
North Sea Drive, Orient; County Tax Map No. 1000, Section 15
Block 1, Lot 3.
WHEREAS, a public hearing was held and concluded on
September 21, 1989 in the matter of the Application of EMANUAL
PIPERAKIS AND DIMITRIOS AGRIROPOLOUS, under appeal 3859; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located along the north
side of North Sea Drive, Town of Orient, and is identified on
the Suffolk County Tax Maps as District 1000, Section 15, Block
1, Lot 3.
2. This is an application for Variances from the Zoning
Code Article XXIII, Section 100-239d (A) (1) , for permission to
construct an inground pool with deck and fence, proposed
construction will be within 100 feet of the Sound.

3 . Article XXIII , Section 100-239d (A) (1) , requires all
buildings located on lots adjacent to Long Island Sound and upon
which there exists a bluff or bank landward of the shore or
beach shall be set back not less than one hundred (100) feet
from the top of such bluff or bank.
4. The subject premises from the proposed pool is known
and referred to as being 40' from the top of the 15' high
contour and 65' from the bluff, they are 22' from the property
line on the west side and 53' from the east side of the property
line, the pool will be 16' x 32' in width and length.
5. In considering this application, the Board finds and
determines:
(a) that the circumstances of this application are
uniquely related to the premises and its established
nonconformities;
(b) that there is no other method for appellants to
pursue; and placing the proposed pool and deck in any other
location on the premises will require other variance relief;
(c) that the area chosen for pool and deck is not
unreasonably located;
(d) that the variance will not in turn cause a substantial
effect on the safety, health, welfare, comfort, convenience
and/or order of the Town;
(e) that in carefully considering the record and all the
above factors, the interests of justice will be served by
granting the variance, as applied conditionally notes below.
Accordingly, on motion by Mr. Goehringer, seconded by Mr.

RESOLVED, to GRANT a Variance in the matter of the
application of EMANUAL PIPERARIS AND DIMITRIOS AGRIROPOLOUS as
applied under Appeal No. 3859 for the placement of a 16' by 32'
pool (as described in the above Finding Paragraph $3) , SUBJECT
TO THE FOLLOWING CONDITIONS:
1. That the pool be approximately 22 feet from the West
property line, based upon the updated site plan.
2. That the entire enclosure be fenced in with a minimum
of a four foot fence, unable to be climbed by youngsters or
children and that the gates should be self closing and locked
from the outside.
3. That the filter be enclosed with a structure composed
of sound deadening material (wood or other composition) so as
not to cause noise for surrounding neighbors.
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis,
Doyen, Sawicki and Dinizio. This resolution was duly adopted.

5 Roderick Van Tuyl, P.C. , indicating a rather
6 large two-story frame house which presently is
7 almost directly in the center of the lot from
8 the bank , from the lip of the bank to North Sea
9 Drive some 48 feet from the road, 75 feet from
10 the top of the bank or lip of the bank, as we
11 say. And the applicant is proposing a 16-by-32
12 foot swimming pool, skewed a little more toward
r l 13 the west side, and which would leave us an
y` 14 insufficient area to the bulkhead. We have a
5 15 hundred foot under the guise of 23 D. We have a
16 county tax map indicating this and surrounding
17 properties in the area.

21 are seeking the variance to build this pool

6 My objection -- I have a letter in the
7 file, there.
8 My objection to the thing is the safety
9 factor. I 'm concerned about my children and the
10 other children in the area. I think personally
11 that swimming pools are dangerous things. This
12 past summer in Phoenix, Arizona they were losing
1 13 a child a day, one little human being every day.
14 That scaress me. It sounds like murder to me,
15 particularly 25 feet away from me or next door
16 to me.
17 That' s about all, except that the
1s filtering system will be 25 feet away from my
19 porch, which is the best part of the house
20 overlooks the sound, that' s why we spend so much
21 money buying the house to sit on the porch and
22 view the sound. I 'm going to have a filtering
23 system buzzing in my ear.

6 pool somewhat do you have a copy of the survey?

10 line, and we can enclose it. As far as the
11 buzzing sound, it' s not very loud at all. The
12 fencing will be around the whole property to
13 code , four foot high.

17 property. As far as you can see around.
18 MR. GOEHRINGER: The whole rear yard?
19 MR. SCHWARTING: Right, the rear yard.
20 Self-closing gates.
21 As far as the safety factor, ninety
22 percent of these drownings are because of
23 parents neglecting the children, that' s the
24 reason they' re drowning. The reason it' s become
25 an issue now, is because swimming pools are more

9 sounds makes sense. When we send our children
10 to the beach we go down there and supervise. We
11 can' t supervise our children every moment in the
12 day, It they' re in the backyard they may climb
13 over the fence. They' re under total supervision
14 when they' re on the beach.

Dear Mr. Goehringer:
In reference to Appeal Number 3859 - Piperakis and Argiropoulous (Variance),
please be advised that a site inspection was conducted on July 18, 1989. At
this time the site of the proposed pool and deck is well vegetated with turf
grasses. The existing top of slope is approximately 65 feet from the existing
deck, as depicted on the landscape plan.
Soils of this site are mapped as Haven loam with 0-3 percent slope and should
have few or no limitations regarding the project. The bluff or escarpment is
very low and well vegetated with perennial grasses. In addition, the toe of
the elope contains rock rip-rap and appears stable.

with a setback of approximately 40 feet from the top of existing
15' high contour, all as shown on the enclosed sketched landscape
Plan- Also attached are photocopies of photographs of the area
as exists, portion of the County Tax Map shaving the immediate
area, and copies portion of a survey. The subject premises is
located along the north side of North Sea Drive, Orient.

REQUESTED, to all owners of property (tax map with property numbers enclosed), vacant or
improved, which abuts and any property which is across from any public or private street.
Use the current owner name and addresses shown on the assessment rolls maintained by the
Southold Town Assessors' Office, or Real Property Office at the County Center, Riverhead. If
you know of another address for a neighbor, you may want to send the notice to that address as
well. If any letter is returned to you undeliverable you are requested to make other attempts to
obtain a mailing address or to deliver the letter to the current owner, to the best of your ability.
