with MXI Environmental Services, LLC for the collection and removal of household hazardous wastes (HHW) through
the 2014 calendar year, in accordance with the Town's DEC approved HHW program, at the prices submitted by MXI
in its bid of November 23, 2011 which represent no increase over current pricing, such contract extension being at the
sole and complete option of the Town, all in accordance with the Town Attorney.

WHEREAS, there is pending in the Environmental Conservation Committee of the New York State Legislature a Bill
No. A-6428 which seeks to amend § 11-903 of the Environmental Conservation Law to authorize the Town of Southold
and other East End Towns to adopt local laws in certain cases related to taking wild deer; and
WHEREAS, the Town Board of the Town of Southold acknowledges that the overpopulation of white tailed deer is a
crisis plaguing our Town and the entire East End of Long Island resulting in an epidemic of tick-borne illnesses, the
degradation of our natural resources and agriculture operations and a proliferation of motor vehicle accidents; and
WHEREAS, the Town Board of the Town of Southold is in receipt of a request from Legislator Albert Krupski for
support of a request to the New York State Assembly to move Bill A-6428 out of the Environmental Conservation
Committee so it can be promptly considered by the whole of the New York State Assembly; and
WHEREAS, the Town Board of the Town of Southold believes that the ability to pass local laws relating to the taking
of white tailed deer would greatly enhance the Town's ongoing deer management efforts; now, therefore, be it
RESOLVED that the Town Board of the Town of Southold fully supports Legislator Krupski's request to
Assemblyman Robert K. Sweeney to move Bill A6428 to a vote as promptly as possible and further authorizes
Supervisor Scoott A. Russell to execute any documents required in support of this important legislation.

Comment regarding resolution 838
COUNCILMAN RULAND: I am going to vote yes but I want to reiterate not only to the people in the audience but the TV
audience as well, the seriousness of this and this really has been a logjam for some time and it is nice to see any movement
especially any movement in the right direction and I think that all of us on the Town Board are willing to do whatever it takes to
further the efforts to begin to get this problem under control which is probably going to take as has been stated in other
correspondence, 10 years. But I vote yes overwhelmingly.
COUNCILMAN TALBOT: Yes. I have a comment on that also, I had a conversation with Assemblyman Sweeney a couple of
years ago regarding this and at the time, it was an election up for Assemblyman Alessi who subsequently lost the race and it was
not pushed forward by our last Assemblyman, he had hoped that I would bring it to our local Assemblyman, which obviously for
the last year we haven't had one and I am hopeful that Assemblyman Sweeney will make some changes to this. I approve, yes.

BE IT ENACTED by the Town Board of the Town of Southold as follows:
1. Purpose.
New York State Real Property Tax Law §485-b establishes a framework for counties to work with other local
governments to encourage economic development that is consistent with the master plans of their communities
and crafted in conformity with the needs of their residents, businesses and environment. Suffolk County has
created the Industrial Commercial Incentive Board to work with the Towns within the County to create a
Strategic Industries Property Tax Abatement Plan, which includes the Industrial/Commercial Incentive Plan,
Town of Southold, to attract and encourage business growth, allowing the Town to target tax incentives to
businesses that make improvements to real property in areas identified by the Town. In accordance with the
Strategic Industries Property Tax Abatement Plan, the Town is enacting this exemption to encourage targeted
economic development, and the value of the exemption is justified by the need to provide employment
opportunities and broaden the tax base in designated areas within the Town of Southold.
II. Chapter 245 of the Code of the Town of Southold is hereby amended as follows:
ARTICLE 11
Targeted Business Investment Exemption
§245 7. Exemption r-epeoled.

exemp4iea would have been applieable to eligible real pr-epefty assessed for T-evm purposes.
4245-7. Exemption granted.
A. Real property constructed, altered, installed or improved subsequent to the effective date of this Article for the
purpose of commercial, business or industrial activities that are set forth in the Industrial/Commercial Incentive
Plan, Town of Southold, permitted uses pursuant to Chapter 280, Zoning and which are identified parcels in the
Industrial/Commercial Incentive Plan, Town of Southold shall be eligible for an exemption from taxation and
special ad valorem levies from each school district located within the area within which said exemption shall
apply unless such school district, by resolution, shall determine that such exemptions shall not be applicable to
its tax and ad valorem levies. For the purposes of this section, the terms "construction," "alteration,"
"installation" and "improvement" shall not include ordinary maintenance and repair.
B. This exemption shall only apply to those projects where the cost of such construction, alteration, installation or
improvements exceeds the sum of $50,000. The amount of the exemption shall be calculated by taking the
increase in the assessed value of such real property attributable to such construction, alteration, installation or
improvement and reducing that increase in the assessed value of such real property, on a declining percentage
basis, pursuant to the following accelerated strategic exemption schedule:

C No exemption shall be granted unless such construction alteration installation or improvement is completed as
may be evidenced by a certificate of occupancy or other appropriate documentation as provided by the owner.
D. Application:
(1) Such exemption shall be granted only upon application by the owner of such real property on a form
prescribed by the New York State Department of Taxation and Finance Such application shall be filed
with the Assessor of the Town having the power to assess property for taxation on or before the
appropriate taxable status date of the Town or County and within one year from the date of completion
of such construction, alteration, installation or improvement.
(2) If the Assessor is satisfied that the applicant is entitled to an exemption pursuant to this Article, he or she
shall approve the application and such real property shall thereafter be exempt from taxation and special
ad valorem levies except for special ad valorem levies for school district purposes, as herein provided,
commencing with the assessment roll prepared after the taxable status date of March 1 of each Year.
The assessed value of any exemption granted pursuant to this Article shall be entered by the Assessor on
the assessment roll with the taxable property, with the amount of the exemption shown in a separate
column.
E. In the event the real property granted an exemption pursuant to this Article ceases to be used primarily for
eligible purposes as set forth in the Industrial/Commercial Incentive Plan, Town of Southold, the exemption
granted shall cease.
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of competent
jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part thereof other than
the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law.

WHEREAS, the Town Board of the Town of Southold has met at the time and place specified in the notice of public
hearings on the Preliminary Budget for the fiscal year beginning on January 1, 2014, and heard all persons desiring to
be heard thereon; now, therefore, be it
RESOLVED that the Town Board of the Town of Southold does hereby adopt such Preliminary Budeet, as
amended, as the Annual Budget of this Town for the fiscal year beginnine on the 1st day of January 2014; and be
it
FURTHER RESOLVED that such budget as adopted by this Board be entered in detail in the minutes of the
proceedings of this Town Board; and be it
FURTHER RESOLVED that the Town Clerk of the Town of Southold shall prepare and certify copies of said annual
budget as adopted by the Town Board of the Town of Southold, together with the estimates, if any, adopted pursuant to
Section 202a, Subdivision 5 of the Town Law, and deliver a copy thereof to the County Legislature of the County of
Suffolk.

WHEREAS there had been presented to the Town Board of the Town of Southold, Suffolk County, New York, on the
6th day of November, 2013, a Local Law entitled "A Local Law in relation to Amendments to Chapter 245,
Taxation, to Provide Assessment and Tax Relief to Property Owners Impacted by Superstorm Sandy" and
WHEREAS the Town Board of the Town of Southold held a public hearing on the aforesaid Local Law at Southold
Town Hall, 53095 Main Road, Southold, New York, on the 19th day of November, 2013 at 4:36 p.m. at which time all
interested persons were given an opportunity to be heard.
RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed Local Law entitled, "A
Local Law in relation to Amendments to Chapter 245, Taxation, to Provide Assessment and Tax Relief to
Property Owners Impacted by Superstorm Sandy" reads as follows:
LOCAL LAW NO. 10 of 2013
A Local Law entitled, "A Local Law in relation to Amendments to Chapter 245, Taxation, to Provide Assessment
and Tax Relief to Property Owners Impacted by Superstorm Sandy".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
1. Purpose.
Superstorm Sandy caused catastrophic property damage in Suffolk County in the Fall of 2012. Many homes
were either destroyed or severely damaged by the high winds, rains and flooding associated with Superstorm
Sandy. Superstorm Sandy struck the Town after assessment rolls were prepared; as a result, property owners
who experienced substantial damage to their homes and businesses were required to pay their normal property
tax bill in 2013. The State of New York has enacted legislation which addresses this inequity by authorizing
local governments to grant assessment relief to Superstorm Sandy victims whose properties were substantially
damaged or destroyed. The Town of Southold was included in the Federal Disaster Declaration of Superstorm
Sandy and, therefore, is eligible to extend assessment relief to its residents. As such, the Town Board believes
it is fair and equitable to provide relief to residents who saw their properties damaged or destroyed and their
lives upended by Superstorm Sandy.
Therefore, the purpose of this local law is to elect to provide assessment relief to persons substantially impacted
by Superstorm Sandy as authorized by the "Superstorm Sandy Assessment Relief Act", enacted by the New

York State Legislature as Chapter 424 of the 2013 Laws of the State of New York.
II. Chapter 245 of the Code of the Town of Southold is hereby amended as follows:
ARTICLE IX
Assessment and Tax Relief for Property Owners
Impacted by Superstorm Sandy
§245-20. Definitions.
Unless otherwise expressly stated the following terms shall for the purpose of this Chapter, have the meanings
as herein defined. Any word or term not noted below shall be used with a meaning as defined in Webster's
Third New International Dictionary of the English Language, unabridged (or latest edition).
IMPACTED TAX ROLL - the final assessment roll which satisfies both of the following conditions: the roll is
based upon (a) a taxable status date occurring prior to October 28, 2012, and (b) taxes levied upon that roll were
payable without interest on or after October 28, 2012.
IMPROVED VALUE - the market value of real property improvements excluding the land.
PROPERTY - Real property, property or land as defined under paragraphs (a) through (g) of subdivision 12 of
New York Real Property Law.
RELIEF ACT - the Superstorm Sandy Assessment Relief Act as enacted by New York State Legislature,
Chapter 424 of 2013 Laws of the State of New York.
SUPERSTORM SANDY - the storms, rains, winds or floods which occurred within the State of New York and
the County of Suffolk during the period October 29, 2012 and ending November 3, 2012.
TOTAL ASSESSED VALUE - the total assessed value of the property prior to any and all exemption
adjustments.
&245-21. Implementation and Adoption of Superstorm Sandy Assessment Relief Act.
This law adopts and implements the provisions of the Superstorm Sandy Assessment Relief Act, as enacted by
the New York State Legislature Chapter 424 of the 2013 Laws of the State of New York, granting assessment
relief to the victims of Superstorm Sandy.
§245-22. Eligibility criteria and relief granted.
Notwithstanding any provision of law to the contrary, the Town of Southold elects to provide assessment relief
for properties damaged by Superstorm Sandy, as authorized by the Relief Act, as follows:

4245-23. Other provisions.
A. To receive relief under this law, a property owner must submit a written request to the Town Assessor's
Office on a form approved by the Director of the New York State Office of Real Property Tax Services
and in accordance with the specific requirements of the Relief Act. Such request shall attach any and all
determinations made by the Federal Emergency Management Agency, any and all reports made by
insurance adiusters, and describe in reasonable detail the damage caused to the property by Superstorm
Sandy and the condition of the property and shall be accompanied by supporting documentation, if
available.
B. The percentage of loss in improved value shall be adopted by the Assessor from a written finding of the
Federal Emergency Management Agency, or where no such finding exists, shall be determined by the
Assessor in a manner provided by the Relief Act, subject to review by the Board of Assessment Review.
C. Where an Assessor determines a property has lost at least 10% of its improved value due to Superstorm
Sandy, the assessed value attributable to the improvements on the property on the impacted assessment
roll shall be reduced by the appropriate percentage specified in &245-22 of this law, provided that any
exemptions which the property may be receiving shall be adjusted as necessary to account for such
reduction in the total assessed value. To the extent the total assessed value of the property originally
appearing on such roll exceeds the amount to which it should be reduced pursuant to the Relief Act and
this local law, the excess shall be considered an error in essential fact as defined by subdivision 3 of
Section 550 of the Real Property Tax Law. If the error appears on a tax roll, the tax roll shall be
corrected in the manner provided by Section 554 of the Real Property Tax Law or a refund or credit of
taxes shall be granted in the manner provided by Sections 556 or 556-b of the Real property Tax Law.
If the error appears on a final assessment roll but not on a tax roll, such final assessment roll shall be
corrected in the manner prescribed by Section 553 of the Real Property Tax Law.

This law shall apply to the impacted assessment roll as that term is defined in the Relief Act and this local law.
II. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of competent
jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part thereof other than
the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law take effect immediately upon filing with the Secretary of State as provided b law.

Federal Community Development Block Grant Funds. These funds may be used, and have been previously used for a
variety of projects to be selected by local officials.

Kathryn Gutleber, Habit for Humanity of Suffolk
KATHRYN GUTLEBER: My name is Kathryn Gutleber, I am real estate project development manager for Habitat for
Humanity of Suffolk. I am before you again for the Community Development Block Grant funding for a project that
we are looking to take title on. It is 550 Greenway East in Orient. So as some of you may know Habitat for Humanity
of Suffolk was founded in 1987 as an independent local affiliate of Habitat for Humanity International, a non- profit
affordable housing organization. We work in partnership with thousands of Suffolk county volunteers and responsible,
low-moderate income partner families to build and renovate homes. Our goal is to create decent and affordable houses
in communities in which people can live and grown. As you know, we are currently working towards obtaining title of
a property located at 550 Greenway East in Orient. HFHS is currently working with Suffolk County and Fidelity
National Title to clear one exception on the property in order to obtain clear title. Once we take title of the subject site,
HFHS plans to demolish the existing blighted home and build a new, affordable home for a low-moderate income
family. AS a non-profit affordable housing organization, we rely on the generosity of donated land and infrastructure
support from Suffolk County and its various townships, as well as support in the form of grants and tax exemptions.
The Town of Southold has generously reserved Community Development Block Grant funding in the amount of
$10,000 toward the demolition of the existing blighted home at 550 Greenway East. In order to further assist with the
development of the new home at 550 Greenway East, HFHS is formally requesting the use of an additional $10,000 in
CDBG funds from the Town of Southold. The additional CDBG funding will be used toward building infrastructure
and materials for the new home. By securing this additional funding, HFHS will be better able to ensure that we will
have the funds necessary to not only demolish the existing home in a timely manner but to begin construction on a new,
affordable home for a deserving working class family within the Town of Southold. Thank you.

Dwayne Wagner, Peconic Community Council
DWAYNE WAGNER: I have a hand-out for the Board. Good afternoon, my name is Dwayne Wagner, I am appearing
on behalf of Maureen's Haven. I am an immediate past chair of Maureen's Haven and I thank you for allowing us to
present again to you, I have appeared before you in the past. For those that aren't familiar with Maureen's Haven, the
mission of Maureen's Haven is to provide temporary shelter to homeless using houses of worship in the community of
the north and south forks from the months of November through March. Specifically in the Town of Southold
Maureen's Haven has partnered with the First Unitarian church of Southold, First Presbyterian church of Southold, St.
Patrick's Roman Catholic Church in Southold, St. Peter's Lutheran Church in Greenport and Sacred Heart Roman
Catholic Church in Cutchogue. To give you an update, last winter we made 5,433 beds using volunteers in the houses
of worship not only in Southold but in a number of other south fork and north fork towns. We used the money that you
have generously provided to fund not only the day center, I don't know if you are familiar with this but last year we
opened a day center in the Town of Riverhead which was an expanded facility which it was intended to actually bridge
the gap past the immediate sheltering needs of the homeless and provide job training and next step services so that the
individual clients that we serve could become employed and become self-sufficient. It also provided, that center,
provided some computer training and a place for our clients to be during the day, so that they weren't forced after being
in a church, a house of worship at night, being turned out on the street. This day center which you helped pay for as far
as its monthly operating costs, allows them to actually get training and be off the street in the middle of the winter
rather than be placed back on, essentially being placed back on the street until they were brought back in in the evening
to another house of worship. So in summary, that is how we operate. Really our strength is the volunteers, 1,500
volunteers in 32 houses of worship donate their time to basically provide this day to day sheltering from November 1 to
April 1. Given Sandy and the economic conditions, we greatly appreciate your continued support and would

SARAH BENJAMIN: Hi, I am Sarah Benjamin, I am the director of Community Action Southold Town and we are in
our 48'h year and I know that you are aware that our mission is to promote self-sufficiency and to provide a safety net

for Southold Town residents in need. CAST answers the requests of over 6,000 people a year. It is about 25-30 people
a day that come in for one reason or another. We have 266 families certified for our food pantry and we are asking
again for your continued support as we provide for the 281 adults, 260 children and 35 seniors that take advantage of
our food pantry. As per the Town of Southold comprehensive plan census of 2010, there are about 276 families
affected by poverty in Southold Town. That was about 4.5% of the families. But the numbers have increased sharply
in the past 3 years and food scarcity is an ongoing concern for many people even here in Southold, our home.
Government assistance is down and food prices are up. You could spend $3 to $5 on a loaf of bread and $4 on a gallon
of milk and American cheese is $6.99 a pound. It is difficult. Times are tough. Thanks to your support, we are able to
help families on a regular basis with basics to help with their food budget. Thank you and please consider that again
and in the future. We would like to ask just one more consideration, if it is not out of line, not to bring, take away
anything from your consideration of funding our food pantry but CAST is implementing a new program called North
Fork Parent Child Home Program this year. It is an early literacy family support for families of poverty, it is home
visiting which is a method of service delivery that has been effective with families of poverty for hundreds of years in
America. And we are getting back into home visiting here in Southold Town. The program, the Parent Child program
also has a 48year history here on Long Island. It is in over 155 different sites and different countries in the country and
in other countries. But it would be the first time for Southold Town. We really believe that the key to the self-
sufficiency part for families is education and it starts really early. Scientists told us what happens early lasts forever.
And that children can be ready for school and ready to learn that they are going to graduate at a higher rate and become
more self-sufficient. We have 5 nursery schools in the Town of Southold and Head Start is the main one that provides
for families of poverty and they are down to serving 36 children. So it is an underserved population, our early
childhood people and families of poverty in Southold Town. We are not talking tens of thousands but we are talking
maybe a 1,000 children with 36 slots. Not all of them are families of poverty. So we are trying to make a difference
with CAST, with this new initiative, the funding for this is coming from grants from several foundations outside of our
town and we wanted you to at least be aware, the other schools are mostly all for people that can pay tuition, so this
would be a new initiative to reach young children and parents and help them. Thank you.

LOCAL LAW NO. 2013
A Local Law entitled, "A Local Law in relation to Amendments to Chapter 245, Taxation, to Provide Assessment
and Tax Relief to Property Owners Impacted by Superstorm Sandy".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
1. Purpose.
Superstorm Sandy caused catastrophic property damage in Suffolk County in the Fall of 2012. Many homes
were either destroyed or severely damaged by the high winds, rains and flooding associated with Superstorm
Sandy. Superstorm Sandy struck the Town after assessment rolls were prepared; as a result, property owners
who experienced substantial damage to their homes and businesses were required to pay their normal property
tax bill in 2013. The State of New York has enacted legislation which addresses this inequity by authorizing
local governments to grant assessment relief to Superstorm Sandy victims whose properties were substantially
damaged or destroyed. The Town of Southold was included in the Federal Disaster Declaration of Superstorm
Sandy and, therefore, is eligible to extend assessment relief to its residents. As such, the Town Board believes
it is fair and equitable to provide relief to residents who saw their properties damaged or destroyed and their
lives upended by Superstorm Sandy.
Therefore, the purpose of this local law is to elect to provide assessment relief to persons substantially impacted
by Superstorm Sandy as authorized by the "Superstorm Sandy Assessment Relief Act", enacted by the New
York State Legislature as Chapter 424 of the 2013 Laws of the State of New York.
II. Chapter 245 of the Code of the Town of Southold is hereby amended as follows:
ARTICLE IX
Assessment and Tax Relief for Property Owners
Impacted by Superstorm Sandy
4245-20. Definitions.
Unless otherwise expressly stated the following terns shall for the purpose of this Chapter, have the meanings
as herein defined. Any word or term not noted below shall be used with a meaning as defined in Webster's
Third New International Dictionary of the English Language unabridged (or latest edition)
IMPACTED TAX ROLL - the final assessment roll which satisfies both of the following conditions: the roll is
based upon (a) a taxable status date occurring prior to October 28, 2012, and (b) taxes levied uon that roll were
payable without interest on or after October 28, 2012.
IMPROVED VALUE - the market value of real property improvements excluding the land

PROPERTY - Real property, property or land as defined under paragraphs (a) through (g) of subdivision 12 of
New York Real Property Law.
RELIEF ACT - the Superstorm Sandy Assessment Relief Act as enacted by New York State Legislature,
Chapter 424 of 2013 Laws of the State of New York.
SUPERSTORM SANDY - the storms, rains, winds or floods which occurred within the State of New York and
the County of Suffolk during the period October 29, 2012 and ending November 3, 2012.
TOTAL ASSESSED VALUE - the total assessed value of the property prior to any and all exemption
adjustments.
§245-21. Implementation and Adoption of Superstorm Sandy Assessment Relief Act.
This law adopts and implements the provisions of the Superstorm Sandy Assessment Relief Act, as enacted by
the New York State Legislature, Chapter 424 of the 2013 Laws of the State of New York, granting assessment
relief to the victims of Superstorm Sandy_
6245-22. Eligibility criteria and relief granted.
Notwithstanding any provision of law to the contrary, the Town of Southold elects to provide assessment relief
for properties damaged by Superstorm Sandy, as authorized by the Relief Act, as follows:

6245-23. Other provisions.
A. To receive relief under this law, a property owner must submit a written request to the Town Assessor's
Office on a form approved by the Director of the New York State Office of Real Property Tax Services
and in accordance with the specific requirements of the Relief Act. Such request shall attach any and all

determinations made by the Federal Emergency Management Agency, any and all reports made by
insurance adiusters, and describe in reasonable detail the damage caused to the property by Superstorm
Sandy and the condition of the property and shall be accompanied by supporting documentation, if
available.
B. The percentage of loss in improved value shall be adopted by the Assessor from a written finding of the
Federal Emergency Management Agency, or where no such finding exists, shall be determined by the
Assessor in a manner provided by the Relief Act, subject to review by the Board of Assessment Review.
C. Where an Assessor determines a property has lost at least 10% of its improved value due to Superstorm
Sandy, the assessed value attributable to the improvements on the property on the impacted assessment
roll shall be reduced by the appropriate percentage specified in X245-22 of this law, provided that any
exemptions which the property may be receiving shall be adjusted as necessary to account for such
reduction in the total assessed value. To the extent the total assessed value of the property originally
appearing on such roll exceeds the amount to which it should be reduced pursuant to the Relief Act and
this local law, the excess shall be considered an error in essential fact as defined by subdivision 3 of
Section 550 of the Real Property Tax Law. If the error appears on a tax roll, the tax roll shall be
corrected in the manner provided by Section 554 of the Real Property Tax Law or a refund or credit of
taxes shall be granted in the manner provided by Sections 556 or 556-b of the Real property Tax Law.
If the error appears on a final assessment roll but not on a tax roll, such final assessment roll shall be
corrected in the manner prescribed by Section 553 of the Real Property Tax Law.
045-24. Applicability.
This law shall apply to the impacted assessment roll, as that term is defined in the Relief Act and this local law.
II. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of competent
jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part thereof other than
the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law take effect immediately upon filing with the Secretary of State as provided by law.
I have a notice that it was posted in the Suffolk Times on November 14 and on the Town Clerk's bulletin board on
November 12, 2013 and that is it.

know we had some severe damage with Sandy and I saw, things that I read so far said it was based on the FEMA
assessment. We have an assessment from the small business administration, I assume that would be the equivalent.
SUPERVISOR RUSSELL: Let me just ask those, that is, the property you are referring to owned by New Suffolk
Waterfront Fund?
MS. MCINTYRE: Correct.
SUPERVISOR RUSSELL: Would that be tax exempt parcel?
TOWN ASSESSOR ROBERT SCOTT: Ninety percent.
SUPERVISOR RUSSELL: Ninety percent exempt.

retroactive effect. Most exemptions only go forward but I would urge you to sit down with the assessor's and
determine how much you might qualify for.

TOM SKABRY: Good evening, Tom Skabry, CSEA unit president for Southold Town. I know that each and every
one of you do understand that we are in the process of negotiations at this point. I have asked over a couple of Town
Board meetings for Town Board, in person involvement in the negotiations process. As you are all well aware, we
have December 11 is our next mediation session, informally there was a package fairly recently that was presented to
the Town Board's outside counsel. I hope the Town Board, everyone here, has had the opportunity to review it,
comment on to it and bring that information to a meeting which is supposedly scheduled for tomorrow outside of the
regular mediation. I have to say right now publicly, that package was put forth reluctantly and just let you Town Board
members realize that it is basically a bottom offer. Subject to our mediation session on December 11, if there is no
Town Board member present for that mediation session and if we are not at an agreement or extremely close to an
agreement, that will leave us undeniably with an opinion that the town is not taking CSEA serious and is not taking the
negotiations seriously. And we just hope moving forward that some kind of an agreement will be worked out which
will benefit the workers as well as the Town of Southold. People who do the work for you, the elected officials for the
benefit of not just the residents but the business owners and tourism. Thank you.

ROBERT DUNN: Robert Dunn, Peconic. As a follow up to the discussion this morning about the dredging, I really
kind of agree with the way it's going. If you had asked me three weeks ago, I would have said there is no dredging
necessary whatsoever. As some of you know where I live, I am not going to mention that street, but my house is the
only house that has a second floor view over the inlet and my computer is right there so I spend a lot of time, my
television is on the first floor and there are four windows behind that, so you watch TV, you are watching the inlet.
Three weeks ago there was no need, if you had asked me I would have said there is just no need for it. then the north
winds came and not only did that spit get longer but it made that turn into the beach and that is the critical point, when
you get that scouring on the other side you are very easily to wipe out that dune. There were some questions this
morning about what would happen if the dune left. Well, depending on how much of the dune left, Goldsmiths pond,
which is the other end of the inlet, could end up being a bay and if that was to happen, you had big swells, north winds
and high tide, you could have waves slapping on Soundview Avenue. Which would be good for nobody. I also agree
entirely with the idea of going with these smaller dredging. I mean, I think we were getting into a bad habit, spending a
huge sum of money every year that I think we all agree now was almost not effective but counter-productive. We spent
a lot of money last year on the armament which I think was direct result of that large scale dredging. So this is the way
to go and you may even need to do a little tune up before the window closes. It may come down to maybe doing it
twice but much smaller, much less harsh on the environment and I think in the long term much more productive. I
spoke with Jamie after the meeting this morning and I told him if it turns to be some sand that can be placed next to the
parking lot that I would be willing to put grass in there like I did over the armament. He doesn't know how much but I
am just letting you guys know that if that becomes available we can then put some grass in there that will protect that
dune long term. Thank you.

COUNCILMAN RULAND: Mr. Skabry, I would like to respond to your remarks. And the only thing I would say is I
take exception with one whether there was a pending threat that if we do not, so let me read a statement of the Town
Board to you and your unit members. As a point of clarification, the town and the CSEA are at impasse over a

successor contract to the existing collective bargaining agreement. Town employees are not working "without a
contract" rather as required by state labor law, all the terms of and conditions of the prior contract remain in effect until
a successor agreement is reached and as such, all the rights and benefits town employees enjoy under the prior contract
are still in full force and effect. Under the Taylor Law, the law that governs collective bargaining negotiations in this
state, the CSEA has the exclusive right to choose whomever they wish to represent them during negotiations and they
have done so. Likewise, the Town Board has the right to designate whomever they choose to represent the town in the
negotiation process and the Town Board has done so as well. This committee acts at the direction of the Town Board,
keeping the Town Board fully apprised of all aspects of the process. The committee does not act without the express
direction of the Town Board. Furthermore, state law requires that the town participate in the mediation process and the
town has done so by and through its representatives. The town has participated in every scheduled negotiation and
mediation session and will continue to do so as required by law. The mediator appointed by the public employees
relations board asked if the town could participate in a session on December 11, 2013 and the town has agreed to do so.
The current impasse has nothing to do with a lack of involvement by Town Board members in the process. It is solely
attributable to the inability of the parties to reach an agreement on the proposed terms of a successor agreement.

MR. SKABRY: Thank you very much for that extensive presentation, Mr. Ruland. I can only assume that was
actually done in advance by your special labor counsel. And again, that is just an assumption. What I can tell you for a
fact is that at the last mediation session that we, a formal mediation session that we had, which I believe was on
September 25, there was some certain actions that were clearly not authorized by this Town Board never mind
authorized by the Town Supervisor. So therefore, that statement is totally inaccurate and I will just leave it at that. The
only thing I am saying is, it is in everybody's interests to have a contract sooner rather than later. Let's move forward
and to prevent what happened on the 25`h from happening, as permitted by state law you do as elected officials of this
town, to sit in to monitor what is going on. We are not saying you are hiding from your responsibilities, we are just
suggesting that it could very well move the process along in a positive direction for all involved. Thank you.

Suffolk waterfront and I just have a question about the $98,000 grant money. Is there an avenue for us to suggest other
uses to that money? The handicap accessibility, road construction and the other categories.
SUPERVISOR RUSSELL: To be candid, I wouldn't be doing your any favors by answering questions off the cuff in
regard to the grant, we need to know the specific terms of the grant. Any in kind or matches. If you want to, I know I
got an email from you today. it was a town board work day so I couldn't respond but certainly I would be glad to sit
down with you at a future date and go over the specifics of that grant.
