Opening Comments
SUPERVISOR RUSSELL: Please rise and join in the Pledge of Allegiance to the Flag. Thank
you. Before we get to the regular business of the town agenda, we have tonight with us John
Wohlham, he is the regional director for the Office of Real Property tax services located in
Newburgh, New York. He is the southern regional director. There has been a lot of discussion
with regard to the need for people to re-register for the STAR program. Mr. Wohlham is going
to come up and more or less explain the process to us. So without further ado.
JOHN WOHLHAM: Thank you very much, Supervisor Russell. I want to thank the Town
Board for allowing me the time to make this presentation. It should be about 15 minutes. Just a
little bit of a review about the STAR exemption. The STAR exemption is the only New York
State funded property tax exemption. All of the other property tax exemptions are welfare.
There are two forms of STAR. Basic which is available to property owners who own their
property, of course, and for whose property is their primary residence. Must be their primary
residence. There is also an income requirement. It is only the income of the resident owner and
any spouses residing on the property. It can't be more than half a million dollars. That is what
we are here to talk about primarily. There is also another version of STAR known as enhanced
which is for middle income seniors. They must be 65 years or older, own the property as their
primary residence and for 2014 the combined income of any owners and resident spouses can't
be more than $81,900. But this program, basic STAR registration does not apply to folks who
are getting the enhanced STAR exemption because folks getting the enhanced have always had a
requirement to apply each year through the Assessors office. They do that by submitting the
application with documentation and if they so choose, this is voluntary, they can fill out an
additional form to participate in something known as income verification through the New York
State Department of Tax and Finance. So without further ado, I do want to talk about the basic

STAR registration program because as Supervisor Russell said, this is something that affects
everyone who has received basic STAR for 2013. If you got it on the 2013 assessment role, if
you are going to receive the benefit on the school tax bill, the combined tax bill you get in
December which includes your school tax, you now have to reapply in order to keep getting this
in subsequent years. So this affects statewide about 2.6 to 2.7 million people, in Suffolk County
it is over 292,000 and in the Town of Southold I believe there are well over 4,500 folks who get
basic STAR. So there are a lot of people who have to reapply and our goal of being here tonight
is to make sure people are aware of this requirement because we want to make sure that everyone
who is eligible to receive it continues to get it. So again, this is recapping a little bit of what I
said, there was new legislation passed this year that authorized this program. Well, STAR in
particular has been around since the late 90's. For folks getting the basic STAR, you would have
applied through paper application to your Assessors office and so long as you continued to own
that property, you didn't move, you were done. You continued to get STAR each year.
Essentially what's happened is Assessor's who have been administering this, through no fault of
their own, really did not have a comprehensive way of determining if someone applying for
STAR was receiving that in another part of the state or if they necessarily had property outside of
New York State that was getting a residents based exemption. And as time developed, there is
now developing concern that there may be a fair number of people who are getting the STAR
exemption inappropriately, hence this reapplication process. The application process can only be
performed through the department of tax and finance. There are two specific ways: people can
go through the department's website which is www.tax.ny.gov <http://www.tax.ny.gov> and you
can apply directly online. I will talk about briefly the process for doing that or you can do it by
calling the department's call center which is (518) 457-2036. The department has a large
number of people dedicated to this application process. They will be happy to answer questions
for you and take your information over the phone to enter in the database. So those are the two
basic ways to do it. I have to stress that the Assessor's office cannot process your basic STAR
application for 2014 except for one very particular situation which I will talk about a little bit
later in a few minutes. So this is again, kind of reviewing something that I said, the rationale for
doing this program basically if you received STAR, a basic STAR exemption on the 2013
assessment role, you should have already received at this point a letter from the New York State
Department of Tax and Finance. That letter will have information as to how you apply and will
also have a seven digit or seven character code known as a STAR code, made up of a
combination of letters and numbers. If you have that STAR code, the simplest way to apply is to
go, as I mentioned before to www.tax.ny.gov <http://www.tax.ny.gov> Prominently displayed
on the department's homepage is a link to the application. The web based application. When
you click on that, you first are going to be brought to a screen that will ask you to enter 6
randomly displayed numbers. And for anyone who has done any sort of transaction on line, this
is pretty common. This is simply so the software knows it is dealing with a person as opposed to
a piece of scanned software that is trying to get into the system. So once you have entered those
6 digits and hit continue, it will ask you to enter your STAR code. When you do that, it will
bring up your properties location. You will simply verify that that is your property and then you
will be directly into the renewal process, the application process. What you will do is you will
enter the name, you will do this individually but you will need to enter the name of each owner
of record and the name of any spouse who happens to reside in the property if the spouse is not
an owner. For each of those individuals, you are going to be asked to enter a social security

number. Additionally , for each of those individuals, you will be asked two questions. First, is
this property that individuals primary residence, yes or no? Again, that is there because STAR is
based on your use of the property as your primary residence. The second question is, does that
individual own property outside of New York State that is receiving a residency based
exemption? And the best example I can offer is there are folks who own property in the state of
Florida who may receive what is known as a homestead exemption. Now Florida grants the
homestead exemption to people who own a piece of property for which that property is their
primary residence. So if I am applying for STAR in New York State and I own a property in
Florida for which I am getting a homestead exemption, there is a problem because I am claiming
both properties as my primary residence. Legally, we can only have one primary residence. So
in the event someone answers yes to that question, they will be asked to follow up what is the
address from that out of state property that is getting the residency based exemption? Once that
information has been entered for each owner of record and each spouse residing in the property
who may not be an owner, there is one additional substantive question. For the resident owners
(and this only applies to the residence owners and residence spouses) was your total income for
2012, the technical term would be the federal adjusted gross income, was that more than
$500,000? And again, that speaks to the income threshold that was added to basic STAR about 3
years ago. It is a yes no question. Once you have done that, you will be asked to enter one
owners name, one person's name as the point of contact along with a phone number and an email
address. It is unlikely that anyone from the department would contact you further but that
information is requested simply so the department has a way of clarifying anything that they
might need clarified. There again, it is unlikely you would be contacted further. The other way
again, as I mentioned, you can call (518) 457-2036 and you can do this process over the phone
with a call center representative. And we have covered that, I was doing too much talking, I
should have paid attention to the slides. I will simply say that for folks who have not done this
yet, the process is very simple. I did this a few weeks ago, it took me less than 5 minutes. So I
would encourage everyone who has received a letter to do it at your earliest convenience. My
mother always said to delay may mean to forget. There is a time deadline here. The deadline for
applying is December 31 and so we want to make sure that everyone who should reapply, who is
eligible for 2014 does so because you will receive a denial letter early next year if you don't. In
terms of the overall schedule, letters started going out statewide in August. The last batch of
letters statewide just went out within the past two weeks to Westchester and Suffolk counties. At
this point everyone in Suffolk should have a letter, in the event that you did not receive a letter or
the letter gets misplaced, I want you to know that it is not an impediment to registration. On the
department's website, the same place where you find the application, you will also find the link
to what is known as lookup, lookup is a way that you can determine your STAR code if you
don't have the letter handy. It is very simple, you would enter, you would go through the six
digits again for the security confirmation. On one screen you would Suffolk for your county,
Southold for the town in which your property is located, that will take you to another screen
where you will enter the first and last name of one of the owners of record, along with the street
number, street name and zip code of the property and that will display at the bottom the
associated property and the owners of record. You will just need to verify that that's your
property. Hit continue, that will bring up your STAR code. And again, once you have verified
that that's your property, that will allow you to then go into the application process that I have
described. So again, if you don't have the letter, not a big deal. Just go to the department's

website and use that lookup application. In terms of timing, for folks who may not do this within
the next month or so, the department will send out a follow up mailing around December 1 that
will only be going to people who as of a certain date, have not yet applied. It is going to be a
little reminder just to say, look, you need to do this, we haven't heard from you but you need to
do it absolutely by December 31. Folks who are denied basic STAR will get a letter will get a
letter in the early part of January 2014, also from the tax department. That letter will list the
reason for denial and it will describe the two step appeal process that is available to you if you
feel you should indeed be getting STAR. Now just as the local assessor's office cannot assist
you in reapplying for STAR if you have been getting for 2013, so too, your local Board of
Assessment Review cannot hear any complaints about the removal of your STAR exemption.
That can only be done in the first instance, by an appeal directly to the Department of Tax and
Finance and the letter will have information as to what you need to do there. In the event your
first step appeal is denied by the department, you can file a second step appeal with an entity
known as the State Board of Real Property Tax Services. So for anyone who is denied, there are
two opportunities to get that overruled if you think you really should be getting it. Sometime
before a tentative roll, and in Southold, tentative roll is filed May 1, the Assessor's office will
receive a list of properties for which basic STAR should be removed for 2014. So okay, this
talks about lookup, we have already hit that; communications, that is simply what I am here by
the good graces of the Town Board doing tonight. Again, we want to make sure that everyone is
aware of this requirement. We want to make sure that everyone who should be receiving basic
STAR in 2014 continues to do so. A couple of other real quick points, the Assessor's office can
only assist one specific group of property owner for application for basic STAR for 2014 and
those are folks who are applying for basic STAR for their property for the very first time. So if
you have just bought a home say in the latter half of 2013 or the first quarter of 2014, you would
need to submit the traditional paper application for basic STAR to the Assessor's office by
taxable status date which is March 1. You need to get it in by March 1, if it comes in after the
fact, it won't count for 2014, it will count for 2015. So again, if you are applying for basic
STAR for a property for the very first time, that is an instance in which you will want to go
through your Assessor's office. The other situation are again recipients of enhanced STAR but
they have always reapplied annually through the Assessor's office, so if you are getting
enhanced STAR you are not going to do anything different as in past years. You will make your
application through the Assessor's office unless you chose to apply for income verification.
Now, I am a little behind here but that is what this slide is saying. The other point that I want to
make is that one question that almost always comes up is whether this renewal process has to be
repeated annually and the good news here, the answer is no. What will happen is that all
municipalities that file assessment rolls are required by law to provide those assessment rolls to
the Department of Tax and Finance. Next summer, early fall, the department will use the 2014
assessment roll to identify all brand new recipients of STAR for 2014 and probably about a year
from now, all new recipients of STAR in 2014 will receive a letter that I suspect will be very,
very similar to what we received ourselves this year. That will ask those folks to register with
New York State Department of Tax and Finance at that time. That same process will be repeated
in subsequent years, 2015, 2016 and so on, so by keeping this up, there should be no need for a
statewide registration to ever have to be repeated. With that, I really can't think of anything else
to say. Again, the important thing is make sure you apply by December 31 through the
Department of Tax and Finance, either directly through the website or by calling the call center

at (518) 457-2036 and with that, thank you very much for you time and attention and thank you
again to the Town Board for allowing the time this evening for this.
SUPERVISOR RUSSELL: Thank you. We appreciate your coming. We thank you for the time
it took to come down here and chat with us. Thank you. While he is wrapping up, I am going to
invite anybody that would like to comment on any of the agenda items to please feel free to come
up at this time? On the agenda?
BENJA SCHWARTZ: My name is Benja Schwartz and I am talking about the agenda items
right now. I am trying to get that, the problem is one of the agenda items was on for this
mornings agenda and it really should be clarified since a potential claims relating to MS 4 permit
and clean water act compliance. Now I don't know what you meant by potential claims but there
are requirements when you hold an executive session which this was an agenda item for an
executive session and there are requirements that certain amounts are, you know, to some extent
be disclosed what you were discussing. So this is very mysterious. Does anybody wish to....
TOWN ATTORNEY FINNEGAN: It is not mysterious at all. It is pretty clear...
MR. SCHWARTZ: Well, are these specific claims, did somebody file a notice of claim?
TOWN ATTORNEY FINNEGAN: There was discussion in executive session about potential
litigation by the Town (inaudible)...
MR. SCHWARTZ: Oh, by the Town?
TOWN ATTORNEY FINNEGAN: Yes.
MR. SCHWARTZ: Okay, not against the Town?
TOWN ATTORNEY FINNEGAN: No.
MR. SCHWARTZ: Okay, well, you know, it is just very nebulous here. It appeared to me to be
a description of notices of claims filed against the Town, in which case would be required to
disclose the, you know. Okay, so the Town is thinking of suing somebody in regards to the MS
4 permits and clean water act compliance and nobody wants to discuss that with the public?
What the content of the lawsuit....
SUPERVISOR RUSSELL: That is something that would be discussed at an appropriate time in
the future but not right now. Today was nothing more than a discussion to discuss options that
the town may or may not have.
MR. SCHWARTZ: Well, MS 4, that's municipal separate storm sewer systems.
SUPERVISOR RUSSELL: That's right.
MR. SCHWARTZ: Okay, so we know a little bit about what you are thinking of. Agenda item
754 and then skips a little to 757, engages a financial, I don't know, accounting firm I guess.

Albrecht, Viggiano and Zurek, I don't know if anybody else bid on this contract but it is a nice
little piece of business. I don't know if these prices are good or not but $85,000 for an annual
financial audit, 457 plan audit, I am not sure what that is and the 2014 financial audit only for
$457? I don't, I am sorry, there is no price there, then it says a plan audit, a 457 plan audit for
$13,000. So we have that twice 457 plan audits once it is $12,700 then it is $13,000. Maybe it is
different years. I don't know but we are talking over $100,000 and then we go down a couple of
agenda items and we have the same firm I think, being awarded another contract for $13,000.
Now I am not saying these are not fair and reasonable, I don't, were they bid out to different
firms or, that's a lot of money for just going over the books. I think we have a pretty good
accounting department in the town. Why does it cost over $100,000 just to review?
SUPERVISOR RUSSELL: First of all, these aren't contracts, these are letters of engagement.
Secondly....
MR. SCHWARTZ: What's the difference?
SUPERVISOR RUSSELL: Their professional services. An engagement letter was for the
professional services of an accounting firm.
MR. SCHWARTZ: A type of contract?
SUPERVISOR RUSSELL: It's, however, the fees that you see there I believe are $80,000 and
$82,500. There's contingencies, $5,000 for a single audit should one be required. You might
remember just a few years ago, town's were required to go out and audit the CPF funds because
of the result of well, poor management of the CPF funds in one town on the east end. So we
have to have a pre-understanding of what those costs might be should those needs come up.
MR. SCHWARTZ: That is not what I saw there but I will take your word for it.
SUPERVISOR RUSSELL: There was a full, open discussion on that issue today at the work
session.
COUNCILMAN TALBOT: Benja, Councilwoman Doherty asked the same question that you
just asked.
MR. SCHWARTZ: Okay. I am just looking for my agenda here because there weren't any
printed copies left so I am able to pull it up on my little tablet which is pretty top-rate good work
there Betty. So I am seeing here on the engineering design and construction support for
highway maintenance facilities at a cost not to exceed $230,000 and then I see the building,
inaudible, a cost of $74,000. So I don't know, it looks like we are spending $230,000 to plan a
$75,000.....
COUNCILMAN TALBOT: That is a separate building. A building that was purchased a
number of years ago, down for use at the landfill. It was never installed and this is going to be
installed down there. Separate from the engineering prices that you are seeing. That was put out
to bid for the possibility of the new highway barn. That is what the engineering costs are for.
The other one is separate from the engineering costs.

MR. SCHWARTZ: So this $230,000 is to plan a complete new engineering barn and we are
going to spend that much just to consider the idea?
SUPERVISOR RUSSELL: It is a maintenance facility for the highway department. I think
there is three components for it. one is (inaudible) for highway, one is to completely redo the
fueling system and consolidate all resources there and the third I believe is a storage facility for
the highway department. This firm will not only design it, they will create biddable documents
so we can bid this project out in the future.
MR. SCHWARTZ: I just wish you had put all that into the public record so that we knew
what....
SUPERVISOR RUSSELL: It actually says that, if you read where it starts with `resolve...
TOWN ATTORNEY FINNEGAN: Inaudible.
MR. SCHWARTZ: It says highway and maintenance facilities, welding bays, service bays,
toilet and administrative spaces. Fueling spaces. Okay, you know, but it doesn't tell you the
how this particular resolution fits into whether you have already passed a bond to fund
construction of the entire project or...
SUPERVISOR RUSSELL: We didn't, what we did was we had to put a money allocation in
place in order to go out to bid. The decision to build the structure is going to be based on what
kind of bids we receive. There is still a lot of decision making to be made down the road. But
we need to know what the cost of these projects are going to be and that is why we have engaged
the services of this firm, which is spelled out pretty clearly here.
MR. SCHWARTZ: So the $250,000 more or less is a little bit less maybe but it will probably
come out to more in the end is just a preliminary, to get an estimate of whether you are going to
go forward or not.
COUNCILMAN TALBOT: No, it also included oversight of the building, drainage systems,
review of the construction as it is taking place from start to finish.
JUSTICE EVANS: It says not to exceed here, so it depends on how far along we go when they
get paid.
MR. SCHWARTZ: Alright. Thank you.
SUPERVISOR RUSSELL: Thank you. Would anybody else like to address the Board on any of
the agenda items? Mr. Tillman.
ART TILLMAN: Art Tillman, Mattituck. This perhaps would be helpful for Benja and answer
some of his questions. Friends tell me that in other towns, all meetings in town hall, virtually all
of them are televised digitally which I assume then can be broadcast in real time. Channel 22
from what I see is seriously underutilized, all we get are the town board meetings. I would like
to know why the work session couldn't be televised, Zoning Board of Appeals, Planning Board

etc. etc. and from what I understand if this is digitally done, it can be transposed onto websites
and other places so that people in town would be better informed as to what is going on. I guess
the cameras are in place in various rooms in other town halls like Huntington. From what I
understand, this gentleman broadcasts (inaudible) it is on the internet but how are your recording,
is it,
UNIDENTIFIED: Inaudible.
MR. TILLMAN: Yeah, but what is the method you are doing it on, I understand this gentleman
has to be paid how much to come in here?
SUPERVISOR RUSSELL: Let me explain just a couple of things. First of all, the budget that
we are going to propose to the public includes money that would give the town a production
capability to do the very things you talk about. Currently the franchise agreement requires
Cablevision to reimburse us our costs for the taping of the regular town board meetings. It
doesn't reimburse for the costs of the works sessions, the ZBA, the Trustees or the Planning
Board etc. We recognize that it is a very costly proposition, we thought the most fiscally
effective way of accomplishing that was developing our own production capability, relying on
the talents of the students of the three high schools, utilizing members of the public who bring
know how to it and being able to get somewhat into the production business to make fuller use of
the channel 22. The budget includes an earmark allocation, we are looking for an allocation
through the franchise agreement with Cablevision and we also think we can take those funds and
then match them to grants that are out there so we can have something up and running in 2014.
MR. TILLMAN: And that would include televising of all board meetings?
SUPERVISOR RUSSELL: We would very much like to televise as much as we can. The
Trustees for years have been asking to have their meetings televised, the ZBA, the Planning
Board, possibly the work sessions depending on how much we can get done in the next year and
again, we are going to be relying on volunteers and members of the community to help us.

SUPERVISOR RUSSELL: No, I do not. We haven't adopted the budget yet so I don't even...

know, it sounds like what you are doing is very similar to the suggestion that I made a year ago
and I asked you how much it would cost to televise the town board work sessions and you said
you didn't want to know about that.
SUPERVISOR RUSSELL: I said it was cost prohibitive. We looked into it which is why we are
developing our own production capability, we are at least going to try to.
MR. SCHWARTZ: And maybe use some volunteers which is great.
SUPERVISOR RUSSELL: But the franchise agreement didn't reimburse us.
MR. SCHWARTZ: You organize it, that's great. You probably have to use the special projects
coordinator, that we have been paying for years, to actually organize the volunteer effort to make
it really economically a good deal for the town and the public, so good luck with it and if I can
help, as I offered over a year ago, I would be happy to help you with that. It was my idea a year
ago.
SUPERVISOR RUSSELL: Is there an agenda item?
MR. SCHWARTZ: Yes, on the agenda. The agenda, it says on the agenda that the agenda is
generally available the Friday before the meeting. Well, today's agenda was only available, I
don't know, yesterday. I don't know who is doing the landscaping, the flowers, the gardening
out in front of town hall, it's beautiful. But I got here at 4:30 today. it was, you know, my, I was
in a hurry this morning, I looked at it and I thought it was a 4:30 meeting. Town Hall was
locked like Fort Knox. You couldn't get into town hall. I guess everybody goes home at 4:00.
It is a nice job if you can get it. anyway, the planting's very nice but I had an idea for you that
maybe you know, you could put a sign up that would say meeting tonight at 7:30 and then I
thought about it and I thought about maybe you could get a little computer monitor and have a
page from the website displayed, like viewable from the window so you could see all the
upcoming events and the schedule of town hall meetings just by walking up to the side of town
hall and it could be there 24/7. Anyway, it's an idea. I did make it and I am not going to go into
the minutiae here of the details but why is it that the agenda is not generally available until the
Friday before the meeting? I am not going to ask you about this week, I know you have got a lot
of budget issues and I want you to spend time on that, so you know, a few minutes, you know, a
few days late once a year whatever, that's fine but as a general matter, I believe that much of the
agenda is already available to you for the next meeting. I am sure you don't just plan meeting by
meeting, I am sure you have meetings planned in advance. So it seems to me you could have
draft agendas proposed for future meetings. And they could change, they could be, you know,
subject to revision but why the public, if we are going to meaningfully participate in town board
meetings, we need to know what is going to come up and what's involved in it. And to have the
agenda the day before really doesn't give time to prepare. Chris, if I had nothing else to do, you
know, I would probably have time.

every Friday.

SUPERVISOR RUSSELL: First of all, don't overestimate our ability to submit things at the last
minute for the agenda. That generally happens at 2:30 on a Friday. It also, it was difficult, I
couldn't get the agenda out on Friday because I was out of town attending the funeral of a friend
who lost his father. It had to wait. The budget, all those other issues, right now we have been
meeting every day to get the budget done, so on a rare occasion, the agenda comes out on a
Monday. Generally it is out on Friday. Which gives people ample time.
MR. SCHWARTZ: I appreciate the need to make changes at the last minute and I want you to
retain that right and to keep doing that but if you know what might be on the agenda two weeks
from now, it would be nice if you could let us know.
COUNCILWOMAN DOHERTY: Benja, we meet every two weeks as you know and there is a
process. The clerk's office works very hard to form the agenda for us and then after the meeting,
they have to process each resolution. And they start working on the next agenda and all that time
for the few weeks, the weeks in between, we are working on stuff and we don't know what is
going on the agenda at that moment. Somethings need resolutions, somethings are just
discussions. So we are constantly working everyday on the issues. So it's not like we canget
an agenda out the next day after a meeting, it takes time. We do meetings every two weeks.
MR. SCHWARTZ: I also advise and I prepare agendas, and you know, I do all of this. And in
my experience everything is not done at the last minute. There are things that are available a
week before.
SUPERVISOR RUSSELL: Friday is not the last minute by far. Friday, Saturday, Sunday,
Monday. It is not the last minute.
MR. SCHWARTZ: I made my point. I hope you heard what I had to say. You don't agree with
me, fine but you can at least acknowledge....

Law entitled, "A Local Law in relation to Parkins on Second Street in the Hamlet of New
Suffolk" reads as follows:

A Local Law entitled, "A Local Law in relation to Parkins on Second Street in the Hamlet
of New Suffolk".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
1. Purpose.
Parking on Second Street in the hamlet of New Suffolk has resulted in conditions that
impact the public health, safety and welfare in the surrounding community. These
conditions consist of undue congestion, restrictions on access and maneuverability as
well as dangerous traffic impacts. Accordingly, it is necessary to prohibit parking in this
area to protect the public and restrict the public's ability to block the ordinary flow of
traffic. Accordingly, an Amendment to Chapter 260 is warranted.
II. Chapter 260 of the Code of the Town of Southold is hereby amended as follows:
4260-10. Parkins prohibited durins certain months.

Comments regarding resolution 745
COUNCILWOMAN DOHERTY: It's a small section of New Suffolk but it's part of a bigger
problem, so I would like to review it further. I asked the Town Engineers to come up with some
more parking on the town parking area and it might end up one has nothing to do with the other
but I think we should hold off on making a decision and explore other options.

agreement with the Natural Heritage Trust for such financial assistance to the Town of Southold
for the Downs Farm/Fort Corchaug Site Restoration Project and if appropriate, a conservation
easement/preservation covenant to the deed of the assisted property.

since this is for 2013 and 2014 and it is something that has to be done, we don't have a choice. We
are going to move ahead with this but we will look into other companies and look into the fees for
the next two years, 2014-15 to make sure that these numbers are right on and not paying too much
for the town.

WHEREAS, the State of New York provides financial aid for household hazardous waste
programs; and
WHEREAS the Town of Southold, herein called the Municipality, has examined and duly
considered the applicable laws of the State of New York and the Municipality deems it to be in
the public interest and benefit to file an application under these laws; and
WHEREAS, it is necessary that a Contract between the People of the State of New York, herin
called the State, and the Municipality be executed for such State aid;
NOW, THEREFORE, BE IT
RESOLVED by the Town Board of the Town of Southold:
1. That the filing of an application in the form required by the State of New York in conformity
with applicable laws of the State of New York including all understanding and assurances
contained in said application is hereby authorized;
2. That Supervisor Scott A. Russell or his designee is directed and authorized as the official
representative of the Municipality to act in connection with the application and to provide
such additional information as may be required and to sign the resulting contract if said
application is approved by the State;
3. That the Municipality agrees that it will fund the entire cost of said Household Hazardous
Waste Program and will be reimbursed by the State for the State share of such costs;
4. That five (5) certified copies of this Resolution be prepared and sent to the NYS
Department of Environmental Conservation together with a complete application.
5. That this resolution shall take effect immediately.

SUPERVISOR RUSSELL: That concludes the business of the agenda. I would invite anybody
that would like to come up now and speak on any issue? Mr. Tillman?
ART TILLMAN: Yes, thank you. I have a couple of unrelated questions and comments. I take
it the Southold Town has an employee assistance program?
SUPERVISOR RUSSELL: Yes.
MR. TILLMAN: Well, I want to commend you on that. That is just a wonderful thing. I had to
take use of it once when I was on the job and I tell you the truth, I don't know what I would have
done without the advice I got from that coordinator, so congratulations on that. Second comment
regarding the re-use center, I go there frequently as do many other people, many less fortunate
than I. in talking to Stan down there, who makes an excellent point, if we could have an
inexpensive cover over that area to protect it from the rain, a lot of things could be saved and
truly reused. I was down there last week and most libraries don't even have this, they had an
English, I guess unabridged dictionary, I don't know what you call it, about that thick. It was a
wonderful thing and I was thinking about grabbing it and I went over to pick it up and it was
soaking wet. I mean this thing, god knows what it cost, but it was ruined by the moisture or the
rain from the night before. So I would ask you to think about that, I think it would be a great
public service. And also would save a lot of work, moving that stuff in and out every time it
rains. There is a lot of time spent once it rains getting rid of that stuff. If it is good weather they
will let it stay there. and thirdly, perhaps most important, here today are many of friends and
acquaintances I have had over the years, employees of the CSEA. We all know the wonderful
job they do, particularly in times of crisis, storms. I often go down to the nutrition center, I see
how wonderfully they handle the old folks there. they really are a blessing to this town and they
really don't make that much money. I don't understand why it is going on a year and they don't
have a contract. I don't understand why some members of the town board will not sit down with
a negotiator and be in on these hearings. Certainly you must have a greater feeling for what you
do, in Southold Town I understand this agency Zuckerman...
SUPERVISOR RUSSELL: Zuckerman is the labor attorney for the town.
MR. TILLMAN: Now he is an out of town resident, right?
SUPERVISOR RUSSELL: I believe he lives on the south shore.
MR. TILLMAN: Alright. Well, I believe that you people have a greater feeling and
understanding of the personnel and the particular problems in Southold Town and I believe that

some of you, at least, should sit in on the negotiations. Also, this has to be terribly costly to hire
this fellow. Does anybody have an idea of how much it costs?
SUPERVISOR RUSSELL: Just so there is some clarification here, representatives for the town
do sit as part of those discussions. I believe the Town Attorney and the Town Comptroller are
part of that negotiating team. This town board is involved with every step of the process. We
are briefed on everything and we are part of the decision making every step of the way.
MR. TILLMAN: Well, don't you think it would be a good idea if some of you sat in on it
instead of getting it second-hand? I mean, that is just my suggestion and I know that's what
some of my friends and colleagues would like you to do and I don't think it is an outrageous
thing to do. So I would ask you to consider that and also, come to a contract agreement soon. It
is not fair to have people dangling out there in this economy, not knowing what their future will
be. Thank you.
TOM SKABRY: Members of the Town Board, my name is Tom Skabry. Art, thank you for
those wonderful words. As far as Mr. Russell, you comment regarding knowing exactly what is
happening at the table, after the fact, and I know this for certain, you were not apprised of what
transpired at the last mediation session which was on September 25. I am not going to go into
details in public on that, I think we hashed it out in the interim but that particular incident was a
perfect example of why we need have a a member of the town board there. yes, we have the
town attorney there, yes we had John Cushman there. Yes, we had Rich Zuckerman there and
yes we had Allison Matthews, the attorney, assistant attorney for Lamb Bemosky, the law firm.
Scott, when you first got elected as Supervisor, before then you and I sat in the room and we
discussed the idea how to progress with negotiations and you taking up the right decision and the
two of us working, sitting at the table along with two other town board members helped get that
process moving a lot faster and from what I understand, it is one of the few contracts ever got
negotiated before the old one had expired. Even though we are in mediation, I can tell you
legally speaking, I don't know what your lawyer had told you, you do have, every single
member of this town board has the legal right to sit in at the mediation session. Strategic wise,
you might not want to say anything, I am sure you have been advised that by your attorney but I
can tell you, legally speaking, you have every single right as an elected official of this town, to
sit in on those meetings to prevent the nonsense that happened on September 25 from happening
again. The other issue too is, why do we have to wait until December 11 for our next session to
sit down with the town? Our contract expired on December 31 of last year. This is kind of
ludicrous. If the town is really honest in trying to come to an agreement, in a reasonable amount
of time, they should not, we should not have to wait three months to sit down with the town's
representative. So please, take this back to Rich Zuckerman, discuss it amongst yourselves, see
whether or not you can actually expedite, the mediator has already told us that he can meet
earlier. It is not the mediator's issue, it is not CSEA's problem. From what we have been told, it
is purely the Southold Town representatives who are not available to meet prior to December 11
and I think as a bargaining unit of town employees who do your work for the benefit of the
town's residents and business owners, to do the right thing and work with us in trying to resolve
a fair contract, not just for our members but also for all of the Town of Southold. Thank you.

BETH STEARNS: My name is Beth Stearns, I live in Mattituck. And I am very unhappy with
the direction that things are going with the public sentiment regarding the deer problem in
Southold Town. I very much meant to come to the last meeting and was not able to get there, so I
waited for the local paper to come out and find out what had been presented and found no, even
though I understand that there are scientists on the committee that handle it found no evidence of
any sort of scientific inquiry or suggestions of how the problem might be solved. I was glad to
read the article by Susan Switzer regarding the roles that deer play in the life cycle of the deer
tick, which I did not know but I feel that as society, a global society, that people are becoming
more appreciative of the presence of animals in the balance of nature and in just our quality of
life and so therefore are supporting the growth of animal populations and of course, as we are
doing this there are going to be some unexpected consequences but I feel that it is just very
regressive that our response should be that we are going to then kill the animals. I mean, you
know there are too many kangaroos in Australia, too many (inaudible) too many starlings, too
many raccoons, too many of a lot of things but to just go back and kill them off I think is just not
a very creative, inventive, intelligent way to respond. I don't know what the answer is but I
would like to know, not having the background, not having being able to find out what the
committee is learning. You know, are they investigating possible developments....
SUPERVISOR RUSSELL: Yes.
MS. STEARNS: They must be.
SUPERVISOR RUSSELL: We have looked at all options. We didn't come to that lightly. I
think you have known me for many years. I am not a hunter, I didn't grow up in a family of
hunters. The reality is that most of the options that people put on the table such as contraception
and all those things are either too costly or they are simply prohibited by state and public health
law. This notion of putting salt licks out, they can, the biologists have told us not only will it not
work, public health law doesn't let us put chemicals in the food supply and venison is still part of
the food supply. You can get special dispensation from time to time and little towns have tried
this but you know, in a town that covers 53 square miles, it is very difficult with such a large
population of deer and the devastating affect that deer have on other animals that live in the wild
and other natural habitats for all sorts of eco-system members. I mean, it is a difficult challenge.
We didn't get because we wanted to get there, we got there because all other options just didn't
seem fiscally sound or simply plausible.
MS. STEARNS: May I ask, on the issue of giving contraceptives to the animals, you know, and
then be a part of the food cycle. Is that, does that only involve with hunters taking the meat and
then eating it? is that where it enters the....
SUPERVISOR RUSSELL: Not just hunters, actually venison is donated to Feed New York,
Long Island Cares and other hunger relief organizations. Venison is a very healthy product,
meat product. It's, the need for it is always th ere and the concern is that you are introducing
chemicals into a food supply for a program that might not work. I mean, biologists haven't
found any evidence to suggest that other than the small, captive populations that you might see
on Fire Island or other locations, for these large areas they tell us it is just not effective.

MS. STEARNS: Well, it just seems to me that the amount of killing that would have to go on to
bring the animals down to a reasonable level, it is just not, the changes that you have made in the
hunting program the last few years have apparently not sufficiently addressed the problem and
when I think of the sharpshooters coming in and the carcasses being, I guess, trucked out of here
or something, I don't think all of those deer are going to be eaten. It just, you know, I am
wondering if we are going to approach the legislative body to roll back regulations that are in
place in regard to hunting, why don't we approach them and roll back the regulations involved
with the contraceptives? Because it just seems like, you know, if the deer are eating so well that
they are producing twins and triplets, you know, it just seems to me to stop at the source. Rather
than get to the point that they are growing up and we are just killing them all off. You know, is it
really, you know, when you consider all of the options, is it really more important to allow the
deer to be part of the food chain, you know, for humans as opposed to perhaps, you know just
not having the same population explosion. I mean, anytime we have a new thing that comes on
the scene, whether it is global warming or you know, proliferation of garbage because of our,
you know, increased population whatever it is, when it is something new, of course we do not
have a ready solution. You know, of course, it is very challenging, of course it is expensive, of
course it means a changing of our mindset, it means a changing of our habit. But I think, I think
it is worthwhile to many people that we just have a different appreciation of animals. So thank
you for listening.
SUPERVISOR RUSSELL: Thank you.
COUNCILWOMAN DOHERTY: Can I just make a comment? One reason we are reluctant
with the contraceptive is that we have been told that although it works, the deer need a booster
after a few months, so it is kind of difficult to chase around the deer and figure out who got the
contraceptive and who gets the booster and it is just, so that is a major reason why we are not
going that way. But we are trying you know, we are not just putting all our eggs in one basket,
we are trying all different things as we learn more and more about this.
MS. STEARNS: Do you have people on the committee that are bambi lovers?
SUPERVISOR RUSSELL: We would invite anybody that wants to be part of the committee to
please feel free to attend, those meetings are noticed to the public, you know, it is a deer
management committee, so they are just trying to get a handle on the number of deer that are in
Southold Town. We have a wildlife biologist on the committee, we have hunters on the
committee, we have farmers on the committee. we have a broad spectrum of people and if you
want to participate in the meetings, you are welcome to come.

COUNCILWOMAN DOHERTY: Tonight we are supposed to get it and tomorrow.
MR. SCHWARTZ: We are supposed to get it soon. But somebody said today since August.
Good old summer time. Well, we still have flooding on Fleetwood Road. It used to be we only
had flooding after a rain. But then I walk the dog there every day and I start seeing flooding,
constant flooding. There is half of the road is a puddle. I didn't realize why until I walked the
dog, I got home late one night and I walked the dog about midnight. There is a sprinkler system
on a new house that was built up on the hill and they put in drainage control drain in the middle
of the driveway. Well, the rain runs right around that, there is nothing bringing it, the drain
doesn't catch very much but the sprinkler systems sprinkle the lawn and the road and they do this
every night. And once the water gets on the road, it runs and flows and we have a little river
going down the side of the road because that's the roads are designed. It doesn't go just a couple
of feet, it goes about 1,500 feet until it ends up in the lowest spot in the neighborhood which is
where this puddle is, so you know, that was bad enough but a couple of months ago, they
renovated another house there and they did a beautiful job on the renovation but the landscaping
use to end at a split rail fence, four, five feet in from the road. That is theproperty line. Now
they have landscaped to within an inch of the road. There are boulders, they planted grass, they
put underground sprinklers within one inch of the pavement on public property, owned by
Southold Town but it is not owned by Southold Town to do what it wants with, it's owned by
Southold Town subject to the rights of way. The easements of the adjacent property owner and
the public. Well, with all due respect, Southold Town is not protecting those rights. It is not
defending, it is not respecting those rights. They are letting the adjacent property owners trample
all over the public rights. I emailed to the highway department and the code enforcement officer
a couple of weeks ago with the story and pictures and my contact information and never got the
courtesy of the received receipt, whatever. Okay, so enough negative. Let's see something
positive. I have been seeing the light. Have you all seen the lights? I t hink they are all over
town, they are in my neighborhood. Talking about the street, the new street lights. The LED
street lights. Are you aware of them?
SUPERVISOR RUSSELL: Yes, we are.
MR. SCHWARTZ: They are fantastic.
SUPERVISOR RUSSELL: Yes. We are the ones that are putting them in, so we know that.
MR. SCHWARTZ: Yes, and I would like to thank you for that. You, the town is putting them
in.
SUPERVISOR RUSSELL: Tim Abrams right there has been leading that for the town. Thank
you, Tim.

MR. SCHWARTZ: Great job. The only fault I could find is we need more of them.
COUNCILMAN TALBOT: Pete, before you go can we talk about this road?
MR. SCHWARTZ: Little by little. If you want to get back to the road now but real quick I
would like to touch on a little suggestion for you with regards to your budget process. Last year
at least the copies of the budget that were posted online were illegible. That means they couldn't
be, they were hard to read. Not only were they hard to read but they were impossible to index. In
other words, you could only read them with your eye, you couldn't copy the text or work with it
or find it if you stored it on your computer. The problem is, whatever the department, whoever
did it, they took the budget, they did it on a computer, but then they printed it out of the
computer through an old dot matrix printer that gives a very inaccurate, poor printout and then
they scanned it into a scanner back into the computer and saved it as a portable document filed to
post compressed to further deteriorate the quality to the point where if anybody is really
interested in the information they would be better off going down doing a FOIL request and
requesting a copy of a properly produced document. But it's much easier than printing it out and
scanning it in would be to just convert it straight to a PDF that retains the text and the image and
makes that available online so that people can really make use of what you are supposedly
putting up there. It can be really accessible. Somebody else wanted to comment about the
flooding or something?
COUNCILMAN TALBOT: No, I was pulling his leg. You haven't been here enough because
we were discussing those exact things about a month ago.
MR. SCHWARTZ: About the printing?
COUNCILMAN TALBOT: No, encroaching in the roadways and such. People putting rocks
out to the edge of the street, plantings out to the street, blocking you know, line of sight for
people coming out of intersections and that is coming up under the purview of the code
enforcement officer, he will be addressing them and has been addressing them.
MR. SCHWARTZ: Well, I don't know about that, I talked to him today and he was not very
helpful. But that was regards to another right of way and this is the problem, I have been here.
You haven't been listening, you haven't been talking to me. The road right of way, the public
trust doctrine applies to the sides of the roads, the right of ways along the roads. The same
doctrine applies to the beaches and the creeks and the waterways and not this town board but
Southold town board and this town board is the current incarnation of that, provided to protect
our shorelines by appointing a town board of trustees. And they have done a pretty good job.
What happened to them? The things that I have seen happen in the past couple of years are
giving me nightmares. This morning I woke up and I heard bang, bang, clank, clank and I went
down there and I saw two not one but two caterpillars on the sand. And calling the trustees
office, oh, we have issued so many permits, we don't know what we have done. And is it above
the high tide mark? Well then we don't have any problem with it. That's what I was told. Is that
right Jill?
COUNCILWOMAN DOHERTY: I am sure you weren't told....

MR. SCHWARTZ: That's what I was told. I was told that if it was above the high tide mark,
there was no problem with it. What sense does that make?
COUNCILWOMAN DOHERTY: I can't speak on what you...
MR. SCHWARTZ: It doesn't make any sense.
COUNCILMAN TALBOT: I agree with Jill, I don't think that you were told that we have
issued so many permits and all that you are talking about. I think there are two sides to every
story, Benja.
MR. SCHWARTZ: They did. They didn't ask me where it was. They said if you give us the
owners name or the street address then we can look up the permit.
COUNCILMAN TALBOT: Sure.
COUNCILWOMAN DOHERTY: They needed more information.
MR. SCHWARTZ: I could describe to them exactly, this is the dead end, it's the last house on
the road. It's not hard to find. You know what I did?
COUNCILMAN TALBOT: So the storyjust changed from what you said.
MR. SCHWARTZ: Alright, well, the part about them saying that if it was above the high tide
mark, they were not concerned. That's a quote. I don't know if it is above the hight tide mark. I
guess it's above most high tide marks. But I have some photos here, would you like to take a
look at them?
COUNCILWOMAN DOHERTY: If this is a trustee issue, you should be going to the Board of
Trustees.
MR. SCHWARTZ: It is not just a trustee issue, this is an issue about Southold Town and a
dramatic change that is happening very suddenly and very fast, there is development going on all
over town, along the roads and along the waterways and these are boulders that are replacing
grains of sand. The contrast could not be more dramatic. I don't, I know of one other house in
the creek that has rock along its shoreline and that one has its own little private inlet that is lined
with rock edges and it is stagnant and very unpleasant part of the creek to be in. This is right at
the entrance of the largest creek in the Peconic Bays. And why the trustees thought that it would
be appropriate to change the shoreline from a beautiful flowing line of sand and water that
changes with the tides, that moves, that fits with the landscape and the sky, beautiful, to a rock
wall, I just, it is beyond me. It is like taking a piece of my heart and....
COUNCILMAN TALBOT: Benja, did you see if there was a permit posted on the job?
MR. SCHWARTZ: Oh, they have got permits. They have got permits through the trustees,

COUNCILMAN DINIZIO: They actually had a permit number?
MR. SCHWARTZ: Permits don't, yes I
COUNCILMAN DINIZIO: Why didn't you give that to the trustees so they could look it up?
MR. SCHWARTZ: Well, I talked to the trustees. I am talking to you now.
COUNCILMAN DINIZIO: We would know more Benja, if you could tell us exactly what it
was but you are being kind of vague here.
MR. SCHWARTZ: I will tell you more. East creek, at the head of Cutchogue harbor. Nassau
Point is the east side of East creek. As you follow the channel, the inner point, there is a house,
looks like a barn, it was built on the point. I don't know if it was 15, 20 or 25 years ago. But I
remember when it was built and I couldn't believe it and it didn't have a permit. So the trustees
at the time 20 years or so ago made them move the house that was already built but they only
moved it, I don't know, 25-50 feet up. But now, the current trustees are allowing them to put
rock wall farther out into the creek, closer to the marshes. I mean, the sandy beach is, it was
right up against the sandy beach and the marshes, you have got this hard rock wall.
COUNCILMAN TALBOT: Is that, are you talking about on the bay side or in the creek area
there?
MR. SCHWARTZ: That is a peninsula, that is in between the harbor and the creek.
COUNCILMAN TALBOT: So if you come down the end of the road....
MR. SCHWARTZ: Called Fishermans beach. Fishermans Beach road.
SUPERVISOR RUSSELL: That might have been a requirement of the DEC. the DEC would
opt for revetment more than bulkheading, so that might very well have been a requirement of the
DEC. but as Jim and Chris had mentioned, if you had given us more details or given the trustees
or the office more detail, they might have been able to give you a more satisfactory answer. You
can't call the trustees office and ask them a general question, they say which house is it, you say
the yellow one, they can't find out which house you are talking about. You need to give them
the permit number, the house number or something to identify the parcel.
MR. SCHWARTZ: No, no. Then knew. The code enforcement officer, when I walked in there
at 9:45 this morning, he knew exactly. He asked if I was talking about the Campo house. And it
sounding like he was friends with them, I don't know.
COUNCILMAN DINIZIO: Hold on, Benja? The code enforcement officer is right here. Can
you get up to the microphone here please?
MR. SCHWARTZ: You knew which house I was talking about, right?
PETER DOHERTY: Pete Doherty, Code Enforcement Officer. I researched it after you left...

MR. SCHWARTZ: No, when I was there you asked me if it was the Campo house and I didn't
know.
MR. DOHERTY: No, I went next door to the trustees and got the information because we had
another call on it.
MR. SCHWARTZ: You gave me a name.
MR. DOHERTY: But anyway....
COUNCILMAN DINIZIO: That's enough.
MR. DOHERTY: I went down and investigated, I had two bay constables meet me there and as
I told you, all their permits were in place.
MR. SCHWARTZ: And that is your job.
MR. DOHERTY: And that is what I did.
SUPERVISOR RUSSELL: You just implied that he somehow knows the owner. You know,
this is really going too far afield of the business of this board tonight. We have been more than
patient, Benja and I have always let you speak until as long as you wanted to speak but enough is
enough tonight. It has been a long night.
MR. SCHWARTZ: Alright. But I don't expect you to let me speak. That is not the point.
That's not why I am here. I expect you to listen.
SUPERVISOR RUSSELL: Well, you expectations are set a little high.
MR. SCHWARTZ: What I have been saying, oh, that's a good one.
SUPERVISOR RUSSELL: Thank you.
MR. SCHWARTZ: What I have been saying is the trustees are allowing the sides of our creek to
become stone fortresses. They are telling me that their jurisdiction doesn't extend above the high
tide mark which is not....
SUPERVISOR RUSSELL: I am pretty sure that is not what they told you.
MR. SCHWARTZ: Well, that is what I heard today.
SUPERVISOR RUSSELL: They have jurisdiction of 100 feet landward.
MR. SCHWARTZ: Well, when I see this stone wall, in my estimation and I have only been
there 50 years, there was no erosion at this point. There was no need for a revetment. In fact, I
honestly believe that the effect of putting those stones there might be to cause erosion. And I
have observed that as people have left their boats on the beach at high tide, when the tide goes
out the boats are stuck on the beach and the next tide the beach gets washed away and sometimes

stays that way, it changes the shape of the beach when you put a hard object onto an estuarian
beach. So with all due respect, I think you ought to think about what is happening because we
have a beautiful area here. Let's not lose it. Thank you.
SUPERVISOR RUSSELL: Would anybody else like to address the Town Board at this time?
COUNCILMAN DINIZIO: I would just like to say something. Last month, Benja, you came up
and asked about counting deer and car hits and I did a little investigation on that and
unfortunately those records are not in a searchable data base because there seems to be some
resistance to do anything digital in Town Hall, so I am going to see if I can get access to them
and get you at least a preliminary you know, where car hits, where deer hits are in Southold
Town. But it may take some time as it is paper and pen. I didn't want you to think I forgot
about it.
MR. SCHWARTZ: Thank you very much.
