Budget Modification for Laserfiche and Server Upgrade
Financial Impact:
Establish Capital Budget for laserfiche upgrade and new server
WHEREAS the Town Board of the Town of Southold adopted a 2013 Capital Budget which
includes a $73,019 appropriation for the Laserfiche upgrade to be funded by borrowing funds
and a $5,500 appropriation for Restoring Early Town Records funded with General Fund
appropriations, and
WHEREAS the maximum estimated cost of the Laserfiche upgrade with a new server is
$35,000, and
WHEREAS the Town Board has determined that the Laserfiche upgrade should be funded with
General Fund appropriations rather than through borrowing funds, and
WHEREAS the Town Board has determined that the $5,500 appropriation for Restoring Early
Town Records should be used to partially fund the Laserfiche upgrade, and
WHEREAS the Town Board has determined that residual funds for other Capital projects are
available on the Capital fund including the automobiles for Central Garage and Programs for the
Aging, and
WHEREAS the Town's Capital Budget process requires a resolution to formally establish
Capital Budget items in the Capital Fund, now therefore be it
RESOLVED that the Town Board of the Town of Southold hereby modifies the 2013 General

Comment regarding resolution 854
SUPERVISOR RUSSELL: I just want to clarify for the record, that seems like a huge sum of
money. Southold Town is not spending that money. That money is reimbursable from the
NRCS, a national agency called the Natural Resources Conservation Service, 75 percent and 25
percent is coming from the State of New York with an allocation from Superstorm Sandy relief.

SUPERVISOR RUSSELL: I would ask anybody that would like to address the Town Board on
any issue to please feel free at this time?
Robert Dunn, Peconic
ROBERT DUNN: Robert Dunn, Peconic. At the last meeting I was, we were discussing the
dredging at Goldsmiths. And again at this meeting we will be discussing the dredging at
Goldsmiths. I had said at the last meeting that up until very recent to that point I had thought
that there was no need for any dredging but I kind of agreed with going ahead with it at that point
because there had been a little change in the spit which was heading back into the dune which
could become destructive. I now kind of almost regret that. I mean the dredging that was done,
even though it was a very small part of what had been previously done was way overdone again.
The spit was literally taken out. I have a few pictures here. The permit that covers all of the
dredging, even as far as the schematics that would go through this spit and that is the original
one, that is not even taking into consideration what the study that you got today from (inaudible)
is. But even our original permits show cutting through that spit, not removing the whole thing
and in fact our permits, in a number of cases discuss taking sands to the east and much of the
sand that was taken out was put on the west side of the jetty. I don't believe it is helpful. I don't
believe you even need to spend the amount of money that was spent this time, I think what could
have been done would have taken less than a day. I mean nobody is going to go down there
without some minimal costs and not, so the least you probably could have done it is a day and it
just wouldn't be as impactful. The spit is now doing a certain amount of protection, what the
problem from the spit is that when it turns in then it gets, it becomes destructive. So to redirect it
and fill that part in and open up the center part so the water can come in and out which is the
whole purpose of dredging. Opening it up the way you did now is just (inaudible) really
counter-productive. And it changes, it already is changing rapidly. I mean I have seven rooms
counting the bathroom in my house, from four of them you have direct view, you can't walk
around my house (inaudible) and it's changing already. It was just too much. And it's where we
are putting the sands and how we are moving them and why we do it. I don't think we are
thinking the whole thing out fully. I think you are going to hear more from other people on this
whole issue.
SUPERVISOR RUSSELL: Good. I am happy to address it because I went out on-site prior to
and after the dredging and I am fully confident that what was done is exactly what was discussed
at this meeting two weeks ago. Furthermore, we located as much of the material as we could to
the easterly side of the jetty. We couldn't get all of the sand to the easterly side but as much as
we could under that current proposal. Some of the sand was located to the west of the jetty but it
was brought up high enough so that it would not be fed back into the inlet farther in should we be
subject to another severe nor'easter or superstorm. But I am completely confident though, with
the work that was done, it is exactly what was proposed to this Town Board two weeks ago.

MR. DUNN: I would have to differ with you a little bit on that. I mean, the same thing was
done last year because of we did a lower impact dredging and the sand that was put up to the
west all disappeared 100 percent. It was put up in the same manner, not quite as much as this
time and not beyond the rock. Some of it is protected, I agree with you on that, some of it is
protected but the sands that was put the last year up on that west side, west bank, it all
disappeared. Okay. It is out of our one design, the original scope that, the original plans that we
put out on, for the dredging, we wouldn't go that far to the west and I don't know why there was
a need to go that far to the west this time. I just don't understand it. We spent half a million
dollars between us and the county on dredging and studies in the past 10 years and a lot of
people think that we just, you haven't made any progress. So I mean, I guess I am offering more
criticism than (inaudible) but it just, if we are backpedaling, we are not going forward. It might
be good that if the Board can find some time to go down there with some of the community and
maybe maybe maybe we don't all have it right, we don't think right. But that we can all come to
something where we would all agree that where it is going and where it should go and then we
wouldn't be having these discussions post anything.
Lillian Ball, Southold
LILLIAN BALL: Hi. Lillian Ball, Southold town. I was there with Jamie for a number of things
that happened that give me pause. I guess my point is that there are always unintended
consequences no matter how we seem to address the dredging of the inlet. Whether it be
removal of peat that held down that corner or removal of a cistern that held down that corner or
regarding the beach which is essentially what happened after the small area that Jamie opened,
was opened. Because of how it was done with the tractor, he had to re-grade the beach on both
sides and I just have a picture that was from about 4:00 PM on Tuesday after it was finished
(inaudible) that shows you how the beach was re-graded. I have before pictures also but it was
just re-graded all the way across and all that grading was where the spit was. So the unintended
consequences are what concerns me and I also would say Jamie at one point we were discussing
things and at one point I said isn't he going too far down the beach to the east, he said yes he is
and I said well, call him off. You know cell phones don't work here and I said yeah but you
don't have a walkie talkie? You don't have any means to communicate with him? So he said,
no I have to get out, so he got out of his car and he walked down to the inlet and started waving
his arms. So that the tractor driver would stop and the tractor driver stopped and got out and
said, what, said what, what? Twenty minutes it took to make it clear that Jamie didn't want him
going any further down the beach. So number one I would like to see him have a walkie talkie
so he can communicate with these people because they are tractor drivers, they are not looking at
the drawings, there was no flagging done, there was no delineation saying okay, we are going to
dredge from here to here and they are not going to touch the rest of this spit. So I think the
unintended consequences are really frightening and from my perspective, I would rather see no
dredging done at all until we digest the recommendations from the study that was done, really
give some thought to this, delineate, flag, be very, very clear about what is going to be done and
make sure that what is supposed to be done is done and there are none of these unintended
consequences that do have ramifications down the way. When that peat was removed, that
shoulder started to migrate east. So it was, it was just a series of unintended consequences that
scares me and I would be very, very loathe to see him do any more dredging and he has told me
that he intends to try and do the dredge on the old permit before January 15'h and that I think
would be a real mistake. Either we get a new permit that somehow reflects (inaudible) the old

permit talks about, you know, dredging much wider and deeper and not as far back into the inlet
as I think the recommendations say. haven't had a chance to read all the recommendations since
they were just released this morning but I really would caution, I would make a plea, I beg you,
don't let them dredge anymore....
SUPERVISOR RUSSELL: Okay, first of all, I think it is inappropriate to refer to a specific
official of this town in the manner that you are doing. If you have a complaint with the job
performance of an official you should put it in writing, give it to this Board and we will consider
any of your concerns. Secondly, let's remember that we have h ired a consultant. He is not the
project engineer, it is a consulting firm. We have just received the final report. We are digesting
and evaluating that report but at the end of the day, we are referring to a report that hasn't been
accepted by this Board yet. Alright, it is subject to public comment.
MS. BALL: Of course. Of course it is subject to public comment but it deserves to be reviewed
before any further dredging happens, that is my request. Whether anybody is doing it or not, I
am not making any specific accusations, I am just saying things happen and it would be very
wise of us to review all the issues before we allow any further dredging.
COUNCILMAN TALBOT: Just give it a couple of weeks. Mother Nature will re-grade it for us.
MS. BALL: There is no doubt about that. It is happening and it is happening in ways that we
didn't even anticipate as a result of how it was dredged and how the sand was put up on the jetty.
So it happens that it takes longer for it to maintain a steady state. If in fact we are looking at the
spit as a protected feature, I would be very concerned about anything that does fluff up the sand
and allow it to be delivered into the inlet. So that is what regarding the beach did. Four guys
with shovels could have made the hole that was made there without using a tractor. That is what
they do at Georgica Pond, that is what they do in Sag Pond. They do minimal dredging, I believe
Bob says they take 6,000 cubic yards from Georgica Pond, we took 17 from Goldsmiths Inlet,
that's what is on our permit, 17 cubic yards. It is a whole different...
COUNCILMAN TALBOT: Grab the shovels. Get out there and dig it.
MS. BALL: Shovels are.... you and I would be happy to do that.
COUNCILMAN TALBOT: Have at it. That's what I say. Save the taxpayers some money.
MS. BALL: I think it would. I think in the long run, this is not a wise use of the taxpayers
money....
COUNCILMAN TALBOT: I agree 100 percent on that. Too much has been spent down there.
MS. BALL: And in the short run, it's damaging to the inlet. There is more sand entering the
inlet than needs to enter it. so I think we need to work together on this, I was here in this room
when we all agreed that the dune was in danger and we thought the minimal amount would be
done to restore the proper angle of the inlet. But more than the minimal amount was done and it
is unfortunate. So that is my position.

Louise Harrison, Diamond Lane, Peconic
LOUISE HARRISON: Good evening, Supervisor, Members of the Town Board. I am Louise
Harrison. I live on Diamond Lane which is on the east side of Goldsmiths Inlet. I went down to
the mouth of the inlet today and took some pictures I brought for you. But I was comparing what
I saw with the permit and the permit I must admit is the one that expired on January 14, 2012. I
had heard that the new permit that was issued in the beginning of this year was essentially the
same but allowed a little bit more dredging to the south but that all the conditions were the same
and I don't know that to be a fact but that's what I was told. So I am going with the old permit
because that is the only one I have a copy of. And the reason I am bringing this up to you is I
have introduced myself to you before but years ago worked for the DEC and I was very closely
involved with permit compliance and enforcement for wetlands work so I am familiar with what
goes into the conditions and so forth and I can read the schematics and I understand how the
DEC wants things done and I am concerned that what I saw doesn't appear to be in compliance
with the permit, at least the one that I have that, as I said before expired in 2012 but if the new
permit is essentially the same, then I can say that what I saw does not comply. And my concern
is, I hear a lot about how much money has been spent on all these operations and I wouldn't want
the town to incur fines and also the additional expense of undoing something that they did that
the DEC might require. So I am just going to give you the pictures that I took today which have
some notations on them. A copy of this old permit with a few little asterisks and things you can
look at of where I think you should pay special attention. But of course you want to look at the
current permit and see, one of the main things I saw was the deposition of the dredged material
which is apparently only supposed to be to the east and significantly to the east. So it doesn't
seem to be proper to put it on top of the jetty or even west of the jetty. That is a concern. And
one more point and this may seem minor but it's something that is important to citizens who
want to participate in the process, these permits and here is a copy of the old one. These are
supposed to be posted whenever any work is done. You can put it on, drive a stake to the ground
or even attach it to a tractor but the idea is the citizens can then get the permit number off of here
if they want to and go to the DEC website or call the DEC and get a copy of the conditions. Any
place the DEC ever gives out permits, one of the requirements that is boilerplate in all permits is
they are supposed to be posted. So that might be something you ask your town employees to do.
So anyway, I would just like to give you these pictures today and ask you to please examine your
current permit and make sure you are in compliance so that there is no further expense to the
town or any compliance issues. Thank you.
SUPERVISOR RUSSELL: I am going to restate the comment that I made before, the majority
of the material was placed to the east of the inlet. It doesn't, it is not foreseeable now because
tides come and go the material doesn't last there for very long. Some of the sand was located to
the west but it was located so that it would be above the risk of being flushed back into the inlet,
that is why it looks like a buildup there. The material to the east simply disappears in no time. I
mean, I am going to again, reiterate that we discussed this issue two weeks ago, everybody
agreed to a plan. We went out and executed that specific plan. Would anybody else like to
address the Town Board?

COUNCILMAN TALBOT: Just looking at the pictures I had the last time we did it and the spit
that was there before and the spit that was gone, it looks pretty much like what we have now. it
is almost exactly. So it is the same thing we did the last time.
MS. BALL: Last year they removed the spit and this year they were not supposed to remove the
spit but (inaudible)
COUNCILMAN TALBOT: It is almost an identical photo of what you have submitted here.
MS. BALL: Yeah and that was supposed to be a very different dredging last year, before Sandy.
Is that what you are talking about?
COUNCILMAN TALBOT: But this was one that you guys at the time had thought was
wonderful.
MS. BALL: Yeah but that, I don't know what you are talking about.
COUNCILMAN TALBOT: I just go back to saying, we spend too much money dredging that
inlet down there and I would say, have at it with the shovels.
MS. BALL: Any dredging that happened before this time removed the spit. One of the most
important (inaudible) what I can tell from recommendations of the hydrological engineer is don't
remove the spit (inaudible)
COUNCILMAN TALBOT: I think my opinion on this is, with the jetty on the west side you can
do all the studying you want with it, Mother Nature is going to do whatever the heck she wants
with that inlet no matter what we spend on it, how much we dredge on it, how much sand is
kicked up inside. We have got....
MS. BALL: Inaudible.
COUNCILMAN TALBOT: Well, I mean, you recommend the company E-design out of the
Bronx or wherever they are from and this is what we got, response out of it.
MS. BALL: Inaudible.
COUNCILMAN TALBOT: That's what they said when they were here.

MS. BALL: When you remove the spit you would get dynamics from the jetty again, the
funneling effect that the jetty creates. The spit protects against that funneling affect. The
funneling affect is what shovels the sand into the inlet. That is my understanding....
SUPERVISOR RUSSELL: The discussion we had two weeks ago focused specifically on the
spit. That is what was done. And everybody was in agreement two weeks ago.
MS. BALL: Inaudible. But in fact, Jamie explained it very well to me, because of how the
tractor has to approach the entrance to the (inaudible) it is not something where you can just,
yeah, Bob can explain it better because he is an engineer but because of this kind of equipment
that you used to keep the costs down, the tractor had to travel from the west side where the
permit says everything should be accessed through the east side, the tractor had to travel through
the west side and make a little bit of an angle to get down to remove 10 or 15 feet, am I correct?
And then make another angle to get out. So it was the equipment that kind of (inaudible) but we
didn't need that equipment (inaudible)
MR. DUNN: Inaudible.
MS. BALL: Yeah. Because you need to push the sand in all directions that was already there in
a (inaudible) in order to get that hole in the middle. Maybe....
COUNCILWOMAN DOHERTY: Unfortunately with this, as you know, from many years we
don't know what we need there because we just keep trying and Mother Nature keeps doing what
she wants to do and we just don't know what she is going to do and I am kind of leaning towards
what Chris said, we just spent a lot of money on this area and it just keep coming back.
MS. BALL: Inaudible. To leave the spit which has never been done before in any dredging.
COUNCILWOMAN DOHERTY: Well, we just got those recommendations today.
MS. BALL: Right.
COUNCILWOMAN DOHERTY: So...right.
MS. BALL: Inaudible.
COUNCILWOMAN DOHERTY: Correct.
MS. BALL: So I think that before any other dredging happens, this is all I am saying, please
before any other dredging happens, don't let Jamie go ahead on schedule just because the
dredging window closes on January 15.
COUNCILMAN DINIZIO: Well, that wasn't the only reason. I mean, two weeks ago the
explanation was that that spit was causing the erosion on the east side of that.

MR. DUNN: At the end of the spit (inaudible) when you get north wind the spit grows, the spit
keeps growing forever but when you get north winds, it pushes the end of the spit (inaudible) and
if you leave it alone (inaudible) put some of that sand to the west, close (inaudible) and then just
let (inaudible) which is kind of what they are saying, don't remove the spit. Use the spit, as the
spit builds it stops sand from coming. As it is building (inaudible)
COUNCILWOMAN DOHERTY: It acts like a jetty.
MR. DUNN: I am sorry?
COUNCILWOMAN DOHERTY: It acts like a jetty in that way.
MR. DUNN: Correct. (inaudible) It acts like a dike and keeps sand from getting out. Now you
have to have (inaudible) a huge amount of water that is scouring the west bank initially and
now scouring once it gets in past (inaudible) is scouring the east bank inaudible. It is not a
straight path. I just wanted to say something to follow up on what Mr. Talbot said about it will
do what it wants to do. There is a positive thing that I see happening already in only five days,
six days, the spit is reforming. It is interesting now, you only see it in really low tide, it is
reforming further out which could end up being a positive thing. But we really need to come up
with a way to do this with the least amount of impact and I believe with the least amount of
money going forward and as Lillian said, I think we really ought to consider what they have said
in the report before anymore dredging is considered. I mean, a lot of money was spent on that
report in itself and we ought to give big consideration to what they have done. You might reject
(inaudible) but consider it.
