Waive Building Department Fees for Habitat for Humanity Housing
WHEREAS, Suffolk County has developed a program known as GML 72-H Affordable
Housing to transfer real property of tax-defaulted properties taken by the County to
municipalities exclusively for the purpose of developing affordable housing, and
WHEREAS, Suffolk County has offered the Town of Southold a blighted property in the hamlet
of Orient, described as SCTM #1000-15-2-14, that the Town has accepted the conveyance of
said parcel to be developed as an affordable housing unit developed by Habitat for Humanity.
RESOLVED, that the Town Board hereby authorizes the Building Department to waive permit
fees for demolition of blighted property and building permit fees for the rehabilitation and
construction of an affordable housing unit on site of previous blighted property,

Comptroller to pay Elizabeth A. Neville for the accumulated leave time she had accrued prior to
her becoming Town Clerk as of January 1, 1998, all in accordance with the Collective
Bargaining Agreement in place as of December 31, 1997 and subject to the following conditions:

ISSUANCE OF NOT TO EXCEED $330,000 SERIAL BONDS OF
THE TOWN TO FINANCE THE BALANCE OF SAID
APPROPRIATION
THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF
SUFFOLK, NEW YORK, HEREBY RESOLVES (by the favorable vote of not less than two-
thirds of all the members of said Town Board) AS FOLLOWS:
Section 1. The Town of Southold, in the County of Suffolk, New York (herein
called the "Town"), is hereby authorized to construct improvements to the Town animal shelter,
consisting of the design and construction of shade structures, including installation of a
photovoltaic system and related improvements and other ancillary work. The estimated
maximum cost thereof, including preliminary costs and costs incidental thereto and the financing
thereof, is $527,000 and said amount is hereby appropriated for such purpose. The plan of
financing includes the expenditure of certain available funds of the Town to pay a part of the
cost, the application of energy rebates payable to the contractor which are to be applied as a
credit to the Town's cost, the issuance of not to exceed $330,000 bonds of the Town, and the
levy and collection of taxes on all the taxable real property in the Town to pay the principal of
said bonds and the interest thereon as the same shall become due and payable.

Section 2. Bonds of the Town in the principal amount of not to exceed $330,000
are hereby authorized to be issued pursuant to the provisions of the Local Finance Law,
constituting Chapter 33-a of the Consolidated Laws of the State of New York (referred to herein
as the "Law"), to finance a part of said appropriation.
Section 3. The following additional matters are hereby determined and declared:
(a) The period of probable usefulness of the object or purpose for which said
bonds are authorized to be issued, within the limitations of Section 11.00 a. 35 of the Law, is five
(5) years.
(b) The proceeds of the bonds herein authorized and any bond anticipation
notes issued in anticipation of said bonds may be applied to reimburse the Town for expenditures
made after the effective date of this resolution for the purpose for which said bonds are
authorized. The foregoing statement of intent with respect to reimbursement is made in
conformity with Treasury Regulation Section 1.150-2 of the United States Treasury Department.
(c) The proposed maturity of the bonds authorized by this resolution will not
exceed five years.
Section 4. Each of the bonds authorized by this resolution and any bond
anticipation notes issued in anticipation of the sale of said bonds shall contain the recital of
validity as prescribed by Section 52.00 of the Law and said bonds and any notes issued in
anticipation of said bonds shall be general obligations of the Town, payable as to both principal
and interest by a general tax upon all the taxable real property within the Town. The faith and
credit of the Town are hereby irrevocably pledged to the punctual payment of the principal of
and interest on said bonds and any notes issued in anticipation of the sale of said bonds, and
provision shall be made annually in the budget of the Town by appropriation for (a) the
amortization and redemption of the bonds and any notes in anticipation thereof to mature in such
year and (b) the payment of interest to be due and payable in such year.
Section 5. Subject to the provisions of this resolution and of the Law and
pursuant to the provisions of Section 21.00 relative to the authorization of the issuance of bonds
with substantially level or declining annual debt service, Section 30.00 relative to the
authorization of the issuance of bond anticipation notes and Section 50.00 and Sections 56.00 to
60.00 and 168.00 of the Law, the powers and duties of the Town Board relative to authorizing
bond anticipation notes and prescribing the terms, form and contents and as to the sale and
issuance of the bonds herein authorized, and of any bond anticipation notes issued in anticipation
of said bonds, and the renewals of said bond anticipation notes, and as to executing contracts for
credit enhancements and providing for substantially level or declining annual debt service, are
hereby delegated to the Supervisor, the chief fiscal officer of the Town.
Section 6. The validity of the bonds authorized by this resolution, and of any
notes issued in anticipation of the sale of said bonds, may be contested only if:
(a) such obligations are authorized for an object or purpose for which the
Town is not authorized to expend money, or

(b) the provisions of law which should be complied with at the date of the
publication of such resolution, or a summary thereof, are not substantially
complied with,
and an action, suit or proceeding contesting such validity is commenced within twenty days after
the date of such publication, or

constitution.
Section 7. This bond resolution shall take effect immediately, and the Town
Clerk is hereby authorized and directed to publish a summary of this bond resolution, in
substantially the form set forth in Exhibit A attached hereto and made a part hereof, together
with a Notice attached in substantially the form prescribed by Section 81.00 of the Law in "The
Suffolk Times, " a newspaper published in Southold, New York, having a general circulation in
the Town and hereby designated the official newspaper of said Town for such publication.

SUPERVISOR RUSSELL: That completes the business of the agenda, I would ask anybody at
this time that would like to address the Town Board to please feel free? I also would like to
acknowledge, we have three boy scouts in the audience today, I want to welcome you.
Peter Terranova, Peconic
PETER TERRANOVA: Peter Terranova, Peconic. I apologize for not having read through the
resolutions before I had an opportunity to talk. I didn't know we were so flush with money that
we can spend half a million dollars....
SUPERVISOR RUSSELL: The animal shelter improvements?
MR. TERRANOVA: Absolutely.
SUPERVISOR RUSSELL: We are actually just putting money in place, there are two principal
funds that are going to pay for most of the overwhelming majority of that cost. One is a gift on
the part of an anonymous donor, money that was raised over the years for the animal shelter.
And then the second component is the reimbursements that the contractor will receive from
LIPA.
MR. TERRANOVA: And what is the anticipated net for the town....
SUPERVISOR RUSSELL: It is less than $100,000, I have a breakdown in the office. I would
be happy to....
MR. TERRANOVA: Is that going to be bonded? That $100,000?
SUPERVISOR RUSSELL: It would presumably be bonded for a short term. Tax anticipation
notes and then paid for in the next budget cycle.
MR. TERRANOVA: Okay. It is just, you know, given the fact that we are using reserves to
help bolster up the budget for this year, I am sure many in the town can think of many different
ways to you know....

SUPERVISOR RUSSELL: Understood. And I don't think the Board would support spending
$500,000 for what amounts to shading at the animal shelter along with the photovoltaic array.
But again, we have a rather generous donation and she is very on board with this project.
MR. TERRANOVA: That's....
COUNCILMAN RULAND: Peter, I think it is safe to point out that the electric bill at the
animal shelter is staggering and that goes on year after year....
MR. TERRANOVA: You just built a brand new animal shelter.
COUNCILMAN RULAND: And I am still telling you that the electric bill is staggering.
MR. TERRANOVA: And why is that?
COUNCILMAN RULAND: It uses a lot of electricity apparently, so anything we can do to
offset that which will carry on for at least 20 years is the right thing to do.
MR. TERRANOVA: Inaudible.
SUPERVISOR RUSSELL: Let me point out that any of our out of pocket costs, the payback
period is estimated at less than five years with our energy savings because the photovoltaic array
is going to feed into the meter.
MR. TERRANOVA: Okay. Well, given, again, the controversy going on with money
expenditure for deer eradication or control, you know which effects everyone in the town not to
mention the livelihood and the development of our forests and that sort of thing, you know, the
money that you spend, okay, not that we shouldn't have an animal shelter, I am not saying that at
all. I am just saying that we need to be extremely careful when you look at, whether it is the
CSEA or whatever and people read this sort of thing okay, it raises a red flag.
SUPERVISOR RUSSELL: You are 100 percent correct and we should have clarified that before
we cast a vote. I am sorry.
MR. TERRANOVA: Okay. Thank you. Inaudible. This is something again I hadn't seen, the
GIS geo software, what is that used for?
SUPERVISOR RUSSELL: We are actually GIS based information systems for all departments.
We are actually basically going to new software. Currently the town uses as its GIS software
map info, it is antiquated, we are converting over to ESRI and that would be the cost, Betty I
believe secured a grant to pay for the upgrade.
TOWN CLERK NEVILLE: Yes, I secured a grant in the amount of $64,503 which includes
this Geodocs which is an integration into laserfiche, covers the server and it covers all of the

added on ESRI software pieces which amount and add up to the total amount of the grant of
$64,503.
MR. TERRANOVA: Okay and follow up....
TOWN CLERK NEVILLE: So basically....
MR. TERRANOVA: Follow up question, is the environmental systems research, the Arc GIS
server enterprise system...
SUPERVISOR RUSSELL: I am going to defer that to John Sepenoski.
MR. TERRANOVA: Because that includes, I guess you got the, you've got the purchase of
8160, that software...
TOWN CLERK NEVILLE: Yes, that is the server for which I just explained....
MR. TERRANOVA: Okay. And then there is an ongoing annual fee of 14 2?
TOWN CLERK NEVILLE: That is also covered under the grant for this year, yes.
MR. TERRANOVA: Okay. And once the grant money is expired though, if we continue to use
that software we are looking at that amount of money?
TOWN CLERK NEVILLE: For the maintenance yes. Which it will be tremendously beneficial
to all of the town land management departments, building department, planning board, the town
engineers. It will be extremely useful.
MR. TERRANOVA: So this is replacing an existing software package?
TOWN CLERK NEVILLE: An existing, antiquated, outdated software.
MR. TERRANOVA: So is there an associated credit for the reduction of the maintenance of the
old software?
SUPERVISOR RUSSELL: To be perfectly candid, I don't think it was supported by....
TOWN CLERK NEVILLE: It was so old it wasn't....
SUPERVISOR RUSSELL: Yes, I think it was, to be perfectly candid, a paste and glue approach
by the very talented mind of the gentleman who works with the GIS in town government, John
Sepenoski. But I don't think there was tech support on map info for years. Most towns have
transported over to Esri.
MR. TERRANOVA: Okay. Thank you.

LILLIAN BALL: Hi, Lillian Ball, Southold. I for one will be very sorry to see Elizabeth
Neville go.
TOWN CLERK NEVILLE: I am not going anyplace.
MS. BALL: Oh, you are not?
TOWN CLERK NEVILLE: I am not retiring (inaudible)
MS. BALL: Good, good. And I was going to point out you did just secure that big grant for the
GIS (inaudible)
TOWN CLERK NEVILLE: I officially retired from the New York State retirement system only,
not from my job as Town Clerk.
MS. BALL: Oh. Okay. Oh, good. That is a relief because you do a great job. We would all be
lost without you I think. Number two was I wanted to say welcome to Bob Ghosio, I am really
happy to see you sitting up there and having worked with you as a Trustee, I am happy to have
somebody, well, now we have got two ex-Trustees, right? People who know about nature and
the biology of our wonderful town and the third thing is, I am thrilled to also see there is solar
being done at our landfill, I would like to know a little bit more about what is being done at the
landfill and really happy to hear that large price tag for the solar on the animal shelter is being
provided by an anonymous donor, that is fantastic. Can you talk a little bit more about the
landfill?
SUPERVISOR RUSSELL: Yes, what we are doing is we have done this in the past, we have
submitted basically through a third party a submission as part of the (inaudible) LIPA, as you
know, is looking to expand its energy portfolio with alternatives and renewables, every once in a
while they issue an RFP looking for production. We have a third party that is proposing
installing a photovoltaic array on about 15 acres up at the transfer station. I believe it is about 2
megawatts of production. They will have a separate agreement with LIPA, they will produce the
electric and they will sell the electric to LIPA but they will pay Southold town is basically a
ground use for the use of that facility, so it creates revenue for the taxpayers and at the same time
expands LIPA's holdings in terms of renewable energy. We have submitted in the past, it hasn't
been selected. We are certainly optimistic it will be selected this time.
MS. BALL: Uh huh. And so then there is no option for the town to use the power created by the
landfill for operating?

SUPERVISOR RUSSELL: Generally when you create RFP's or when you participate with
LIPA, LIPA wants the electric fed into your grid and then they will turn around and sell it back
to the municipalities and other agencies that use it. To my knowledge it wouldn't be permissible
to use it for on-site consumption. That would perhaps be subject for discussion for a future
project, that we could do on-site, similar to what we are doing at the animal shelter.
MS. BALL: Yes, that would be, I think that would be fantastic because I did make the decision
this year to go for my own solar at my house and as Mr. Ghosio knows, I have already had solar
hot water and I have been very pleased with the way these things work and I know that the
rebates are tremendous for that and especially for commercial usage, so I would be really
interested in hearing about more opportunities to use the landfill for generating solar power. The
wildflowers are beautiful there but it does have tremendous potential for our town to use...
SUPERVISOR RUSSELL: We would agree. We were disappointed it wasn't selected the last
time. I think LIPA, every time they issue a RFP they get inundated with proposals back and they
have a hard time sorting through all those proposals. We weren't selected last time but we are
going to be early in this time and hopefully it will be a project that is picked. That is a lot of land
that should be put to good use.
MS. BALL: I agree. Thank you. Happy New Year.
