The Southold Town Trustees met at the Town Clerk's Office, Southold, N.Y.
on Monday, May 4, 1970 at 7:30 P.M. with the following present:
Alvah B. Goldsmith, Frank Dawson, John F. McNulty, George Simpson an~
Douglas Robertson, Marion Regent, Sec.
The next meeting of the Town Trustees will be held on Monday, June 8,
1970, at 7:30 P.M. at the Town Clerk Office, Southold.
The Board left immediately to review the bulkhead on Bay Avenue, Cutchogue,
being constructed for Donald DeLalla. Dr. Samuels, President of Rambo
Inc. and Gary Olsen, Attorney, accompanied them. The application and permit
granted was for a bulkhead 50' x 1' on the high water mark in Baldwin
Creek, Cutchogue, the area to be dredged 6 to 8 '. When the Board returned,
a discussion was held and it was determined by the Board of Trustees that
the terms of the permit have not been adhered to as to location or length
of bulkhead. Since the bulkheading and filling of the existing structure
would encroach upon town property, it is the decision of the Board of
Trustees that all the staving shall be removed and that the structure
be converted to an open dock structure. Also, the Town Trustees direct
that any proposed dredging be accomplished by depositing the dredged
material above high water mark on the owner's own property.
The Trustees regret the necessity of this action but the best interest
of the Town must be upheld and the Trustees believe this to be the only
solution other than the complete relocation of the bulkhead to the original
high water mark as indicated on the survey and application.
Application of Ralph T. Preston, Inc. to dredge in Sterling Creek 300'
70' at a depth of 3' excavating 2300 yds was held in abeyance pending
examination of the area by the Trustees.

Application of Edwin Smith to bulkhead 57' x 60' in Broadwaters, Cutchogue,
was held for a more complete map and description of work to be done and the
relation to land of adjoining property owners. This area will also be
examined by the Trustees.
A letter was received from Mrs. Steven Majeski asking the possibility of
placing a small dock in James Creek at the foot of Salt Lake Lane,
Mattituck. The Trustees feel it unadvisab~if~r Mrs. Majeski to apply
for a permit for said dock without approval from the Salt Lake Village
Association and the property owners in that area since Salt Lake Lane is
not a Town owned road.
A letter was sent to Carmelo Tavormina advising him that the complaint
in reference to clam diggers at Long Creek has been referred to Supervisor
Martocchia requesting him to have the Bay Constable investigate the
situation.
Application of Elbert Luce, Jr. to place two (2) stakes in Orient Creek
was granted since permission is granted by John B. Tuthill, the upland
owner. Fee $2.00' paid.
Application of Fred Fischer, Indian Neck Lane, Peconic, to set a mooring
for a boat in Richmond's Creek was granted with permission from James P.
Knowles, upland owner. Fee $1.00.
Application of Dia Moy, Southold, N.Y. to build a floating dock and ramp
12'x 6'x 10' in West Lake off Cedar Drive West, in front of his own prop-
erty. Fee $10.00.
Application of Harvey D. and B. Loretta VomLehn, to place a mooring in
Corey Creek, Southold for a 30' motor sailer was granted. Fee ~1.00.
Application of John Norman to place a mooring in Mattituck Creek in front
of his property was granted. Fee $1.00.
Application of' William Hinchy, Bungalow Lane, Mattituck, N.Y. to skim
previously dredged area in Deep Hole Creek 50' x 10' x 3' in front of
his own property was granted. Fee $5.00.
Application of William Power, Jr., Haywaters Road, Fisherman's Beach,
Cutchogue, N.Y. to rebuild dock and dolphins in Br~adwaters Creek in
front of his own property was granted. Fee $10.00.
Application of Charles Wisseman, Wells ~venue, Southold, to build a jetty
in Jockey Creek 25' in length to the left of his property was granted.
Fee $6.25,
Application of David Ackerman, Salt Lake Lane, Mattituck, to build a
bulkhead in front of his property 147' in length along high water mark
starting 50' from the east end of the property was granted. Fee $39.00.
Application of Salt Lake Association, Inc., Artemas E. Ward, President,
to set six piles 10' apart to provide five slips for property owners
boats and to dredge within the area of slips where necessary in James
Creek was granted all in accordacne with the application submitted.
Fee $10.00 paid.
