HomeMy WebLinkAboutTR-05/03/1971MEETING OF MAY 3. 86 The Southold Town Trustees me~ at the Town Clerk Office, Main Road, Southold, New York, at 7:30 P.M., Monday, May 3, 1971 with the following present: Alvah B. Goldsmith, President, John F. McNulty, Douglas Robertson, Frank Dawson, George Simpson, and Judith T. Boken, Secretary. The application and permit No. 638 of C. Raymond Rad~gan, Meday Avenue, Mattituck, to build a community dock 50 ft. by 3 ft. at the foot of Howard Avenue, Mattituck, N.Y. was brought up for discussion. Mr. Goldsmith stated that immediately following the last meeting of the Southold Town Trustees on April 5, 1971, they were advised by residents in the area that there would be objection to this dock, and advised the Secretary to hold the application pending the May 3rd meeting. The following neighbors from "Tollewood", Ma ttituck, N.Y. appeared before the Board to pro~est the granting of this permit to Mr. Radigan: Mr. and Mrs. Robert F. Moylan, Lots 51 to 53, "Tollewood"; Charlotte Davis, 1330 Meday Avenue; Mr. & Mrs. Royston R. Rind, Meday Avenue; Richard Olmstead, Meday & Howard Ave., Mattituck, N.Y. A letter from Mr. Radigan to the Southold Town Trustees was read, stating that he wished the appli- cation and permit adjourned until he has an opportunity to have a search made to determine convenants, easements and restrictions over the parcel in question. If after a search he finds he has no right to build a dock then he will withdraw his application. Mr. Radigan also stated he would like an opportunity to discuss the matter with the abutting home owners so that an amicable solution may be reached. On motion of Mr. McNulty, seconded by Mr. Robertson it was RESOLVED that Permit No. 683 to Mr. C. Raymond Radigan be rescinded and his fee returned. Vote of the Board: Ayes:- ALL. Members .of the Cutchogue- New Suffolk Park CommissiDn, Mr. Patric~Gorman, Park Commissioner, Mrs. Annetta Fogarty, Park Commissioner, Mrs. Francis Rogers, Clerk, and Mr. Richard Cron, Park District Attorney, appeared before the Town Trustees. Maps were presented relative to the relocation of a portion of Nassau Point Road., Cutchogue, N.Y., and a letter was read from Mr. Cron to Mr. Gorman advising him that a quit claim deed from the Town of Southold to those lands east of the easterly line of the new highway is expected. The Fark Commission wished to discuss with the Southold Town Trustees the filled lands lying west of the westerly line of the new highway and suggested a release or quit-claim of all those lands to the Park Commission. After the Park District purchased the property, it was dredged and the fill placed on the land in question, and now there is a strip of land between the north side of Nassau Point Road and. Bmmadwaters which should be part of the Park District property. The Trustees all agreed that this was a reasonable request, but would like to take the matter up with the Southold Town Board and Town Attorney 87 and advise the Park District of the disposition of this matter in the near future. On motion of Mr. Robertson, seconded by Mr. Dawson, it was RESOLVED that the minutes of the meeting ~f April 5, 1971 be approved. Vote of the Board: Ayes:- ALL. The Board signed approved permits: ~635, 2 stakes ~257 to Marie Hendrickson, fee paid; ~636 to Fred C. Koke, fee paid; ~634, Stake No. 256, to Lloyd W. Lindsay, fee paid; ~637 To Robert Islas~i fee paid. On motion of Mr. McNulty, seconded by Mr. Robertson, it was RESOLVED: That application of Fisherman's Beach Association, Fisherman's Beach, Cutchogue, New York to dredge to maintain channel~at Broadwaters channel, 50 ft. long, 12 ft. wide be approved, subject to disposal of dredged material uniformly spread alomg the beach facing Bay front with consent of property owners affected. No fee for maintenance dredging. Vote of the Board: Ayes:- ALL. Applications~ received from Ronald Lowell, Samuels S. Cohen, Robert F. White and Eugene Carroll, all of Leeton Drive, on Long Island Sound, Southold,New York, to install bulkheads at high water mark on Long Island Sound. The Secretary was instructed to notify all of the individials that inasmuch as this bulkhead appears to be above high water mark and on the shore of Long Island Sound, the Southold Town Trustees have no jurisdiction in this matter. An application was received from Mr. Edward R. Burke~, 1925 Bay Avenue, Mattituck, N.Y., for permission to build a bulkhead 100 ft. wide, on his property at James Creek. The Secretary was instructed to ho~d the application and secure from Mr. Burke the exact location of the property with relation to Town and private roads; letters from adjacent property owners waiving objection to this bulkhead; and high and low water mark and indication as to whether he wishes to place this bulk- head above or below high water mark, and if so, how high it extends. On motion of Mr. Dawson, seconded by Mr. Robertson, it was RESOLVED: That the application of William F. & Alysse E. Johnston, Lot 22, Fisherman's Beach,Road, Nassau Point, Cutchogue, New York, for permission to install floating dock 12 ft. by 6 ft. on their property at Haywaters Creek, Cutchogue, N.Y., be approved, all in accordance with the application submitted. Fee $22.50. Vote of the Board: Ayes:-ALL. On motion of Mr. Dawson, seconded by Mr. Simpson, it was RESOLVED: That the application of Joseph G. Hataier, 1400 Beebe Drive, Cutchogue, New York for a 30 ft. dock and 4 pilings at Eugene's Creek, Cutchogue, New York, be approved all in accordance with the application submitted. Fee $19.00. Vote of the Board: Ayes:-ALL. 88 On motion of Mr. McNulty, seconded by Mr. Robertson, it was RESOLVED: That the application of William Crawford, 83-12 Northern Boulevard, Jackson Heights, New York, for permission to build a bulkhead on his property at Smith Drive North, Goose Creek, Southold, N.Y., 172 ft. long, be approved all in accordance with the application submitted. Fee $49.40. Vote of the Board: Ayes:- Ail. On motion of Mr. Dawson, seconded by Mr. McNulty, it was RESOLVED: That application of Robert T. Halliday, 265 Westview Dr., Mattituck, N.Y. for permission to construct a floating dock at Long Creek, Mattituck, N.Y. 8 ft. by l0 ft., be approved all in accordance with the applicatiDn submitted. Fee $7.00. Vote of the Board: Ayes:- ALL. On motion of Mr. Simpson, seconded by Mr. McNulty, it was RESOLVED: That application of William Powers, Haywaters Rd., Cutchogue, New York, for permission to dredge in front of an 18 ft. dock, to allow for mooring of boat. Dredging area 18 ft. by 4 ft. Application was approved subject to disposal of fill on applicants property above high water marK. Fee $6.00. Vote of the Board: Ayes: All. On motion of Mr. Robertson, seconded by Mr. Dawson, it was RESOLVED: Tha~ application of Genevieve Nauqles Robinson, Naugles Drive, Mattituck, ~.Y. for permissiDn to build a small walkway and floats on MattituckCreek, directly north of Chambers property line, be approved all in accordance with the application submitted. Fee $38.00. Vote of the Board: Ayes:- All. The Southold Town Trustees were advised by Mr. William ~anm~ck, Bay Constable, that there appears to be a dredging project in front of the property of Mr. Frank G. Hundley, at Goose Creek, Southold. The Board instructed the Secretary to send a letter to Mr. Hundley advising him that a permit is necessary for dredging and enclose applications for submission to the Board. The next meeting of the Southold Town Trustees will be held 7:30 P.M., Monday, June 7, 1971 at the Town Clerk Office, Main Road, Southold, New York. Meeting adjourned at 10:15 P.M.
