The Southold Town Board of Town Trustees met at the Town Clerk's
Office, Main Road, Southold, New York, on Monday, September 20,
1971 at 7:30 P.M,3_ with~ the.~_following present:
Alvah B. Goldsmith, Chairman, John F. McNulty, Frank S. Dawson,
Douglas M. Robertson, George A. Simpson, and Judith T. Boken,
Secretary.

Mr. and Mrs. Louis A. Zie~ler, Bayview Avenue; Shore Acres,
Mattituck, appeared before the Board to present their, application
for permission to build a bulkhead 100 ft. across thei~ property
to prevent further erosion. Last year 32 ft. of land was lost at
one corner of the Ziegler property due, to erosion caused mostly
by runn-off on Town road, Bayview Avenue.
On motion of Mr. McNulty, seconded by Mr. Dawson, it was
RESOLVED that a lstter be forwarded to Mr. and Mrs. Louis Al
Ziegler advising th~m that the Board of Town Trustees waives
any objection or issuance,of a permit, for the erection of a
bulkhead on their property at Bayview Avenue, Shore Acres,
Mattituck, New York, as this bulkhead is to be placed completely
on their 9wn property,,making it beyond the jurisdiction of the
Board of Town Trustees. (No permit, No fee.)
Vote of the Board~ Ayes: Mr. Goldsmith, Mr. McNulty,

An application was received from David O'Brien, Jennings Road,
Southold, New York, for permission to place a boat mooring
at the end of Gilbert Street, Jockey Creek, Southold. The
Board will investigate the site.

An application was received from Charles A. Kin~, south side
Mill Road, Mattituck, New York, for permission to rebuild and
widen, by 10 ft., an existing dock and bulkhead 70 ft. on
Mattituck Creek, to adjoining property of James King. The
purpose of the proposed work is to prevent flooding and land
erosion. The Board will investigate the site.
An application was received from James F. King, south side
Mill Road, Mattituck, New York, for permission to bulkhead
~230 ft. across his property on Mattituck Craek to stop flooding
and prevent further land erosion. The Board will investigate
the site.
An application ~w~s received from LeRoy DeMott~t 4 Nantucket Lane,
Oceanside, ~New York, requesting permission to replace an existing
bulkhead on his pD~perty at Bay Avenue, C~tchogue, New YOrk.
On i~motion ,of Mr. Dawson, seconded ~by Mr. l{obertson, it w-as
RESOLED that LeRo¥ iDeMot, t, 4 Nantucket Lane, Oceanside, iNew
York, be ~ranted permission to replace an existing bulkhead
59 ft. in length on his~roperty at Ba~ Avenue, Cutchogue,
New ~York, and dredge 60 yards of backfill. Fee $22.1~.<
Permit granted in accordance with application submitted, r~>

An application was received from Fred Melin, 325 ~terling Road,
Cutchogue, New York, requesting permission to place a, mooring
in Mud Creek at the foot of Sterling Road, Cutchogu~, New York.
On motion of Mr. M~Nulty, seconded by Mr. Robertson, it was
RESOLVED that Fred MeliD, 325 Sterling Road, Cutchogue, New
York, be granted permission to place a,boat mooring in Mud
Creek at the foot of Sterling Road, Cutchogue, New York,
approximately 50 ft. fromthe high tide line, and approximately
50 ft. back from the existing channel, all in accordance with
the application submitted. Fee $1.00.
Vote of the Board: Ayes: Mr. Goldsmith,,Mr. McNulty, Mr.
Dawson, Mr. Robertson, Mr. Simpson.
An application was received from Philip ~.. & Jeanne P. Marriner,
Deep Hole Drive, Mattituck, New York, requesting permission to
install a float in front of their property on James Creek,
Mattituck.
On motion of Mr. McNulty, seconded,by Mr. Simpson, it was

RESOLVED that Ph~lip~ R. & Jeanne P. Marriner, Deep,Hole ~rive,
Mattituck, New York, be granted permission to install a float
15 ft. by 4 ft. in front of their property on Sailor's Needle
Road on James Creek, Mattitu~k, New York, all in accordance with
the application submitted. Fee $9.50.
Vote of the Board: Ayes: Mr. Goldsmith, Mr. McNulty, Mr. Dawson,
Mr. Robertson, Mr~ Simpson.'
An application was received from Will.iam F. & Alysse E-. Johnston,
8 Larkspur Drive, West, Islip, New York, requesting permission to
ex~end an existing bulkhead 40 ft. plus a 46 ft. return, to permit
access to their property, Lots 17, 18, 19, Fisherman's Beach,
Hayw~ers Road, Nassau Point, Cutchogue, New York, and install a
floating dock~6 ft. by. 16 ft. in front~of Lot 19. The Board will
investigate the site.
An application was received from Rudolph Koubek., west side Harbor
Lane, Cut~hogue, New York, for permission to build a 12 ft. dock
in front of his property on Eugene's Creek.- Ther~ is presently
an application before the Board from Mr. I4oubek for permission to
dredge in this same area. The Board will hold both applications
for further study and investigation.
An application was received from How~rd G. Meinke, Broadwaters
Road, Nassau Point, Cutchogue, New York, for permission to rebuild
his dock on Haywaters Cove.
On motion of Mr. Dawson, seconded by Mr. R°bertson, it was
RESOLVED that ~oward G. Meinke, Br0adwaters Road, on Haywaters
Cove, Cutchogue, New York, be granted permission to rebuild and
enlarge an existing dock to 47 ft. by 2½ ft., all in accordance
with the application submitted. Fee $23.80.
Vote of the Board: Ayes: Mr. Goldsmith, Mr. McNulty, Mr.
Dawson, Mr. Robertson, Mr. Simpson.
An application, was received from ~ay~i~w. Development Corppration
(Victoria Mote! & Cottages), Bay_view Road, Southold, New York,
for perm~on t~install a floating dock with bulkheaded landfall
as a modificatio~to Permit ~285 issued to William & Regina G.
Victoria on July 27, 1964. Bayview Development Corporation proposes
to add 24 ft. to the total length of the dock, increas~ the main
dock 1 ft..in width, and add fingers forming slips.
In view of the following letter contained in the Victoria
file, it was the decision of the Board of Town Trustees to refer
the proposed application to the Planning Board for their recommenda-
tions and comments:

"May 12, 1966, Mr. Willi~ V~c$or~ia, Bayview ~oa~L Southold, New
York. Dear Mr. Victoria: In as much as no map has been filed
with ~he Planning Board, or no application for a subdivision has
been filed with the Planning Board, and no approval has been given
for the canal which has been dug into your property on the south
side of Main Bayview Road, Southold, New York; you are therefore
advised to fill in the canal to its original condition.
No building permits will be issued an any of the property and
the Board of Appeals will be advised not to grant any exceptions
or permits for a marina or grant any variances until this matter

On motion of Mr. Simpson, seconded by Mr. McNulty, it was
P~ESOLVED that the minutes of August 9, 1971 be approved as
submitted.

On motion of Mr. Robertson, seconded by Mr. Simpson, it w-as
RESOLVED that the next meeting of the Southold Town Board of
Town Trustees will be held 7:30 PoMo, ?MeRday, October 4, 1971
at the Town Clerk,s_Office, ~ain Road, Southold, New York.
Vote of the Board: Ayes: Mr. Goldsmith, Mr. McNulty, Mr.
Dawson, Mr. Robertson, Mr. Simpson.
The 1972 Budget Estimate was discussed, and
On motion of Mr. Dawson, seconded_by Mr. Robertson, it was -
RESOLVED that the following Annual Estimate submitted by the
Southold Town Trustees for the fiscal year beginning January 1,
1972 be submitted to the Southold Town Board:
Expenditures:
Expenses and Supplies ......................... $ 300.00
Four (4) Trustees ~1,500---~ ................ 6,000.00
President of Town Trustees .................... 1,700.00
Secretarial Services .......................... 1,500.00
Total--' ............. $9,500'.00
Receipts:
Amount received from permits, etc.---approx.--$ 700.00
Note:
comparable services in other departments are budgeted
at much high rates for personal services than are the Town
Trustees. This condition has existed for years and we believe
a nominal increase is warranted.

Furthermore, The Town Board has made no provision for the pay of
the secretary to the Board of Town Trustees over the past years.
This oversight is inexcusable and must be considered as part of
our budget now and in the future.
Vote of the Board: Ayes: Mr. Goldsmith, Mr. McNulty, Mr. Dawson,
Mr. Robertson, Mr. Simpson.
The Board discussed the proposed amendment to the Building Zone
Ordinance to wit:
Article III, Section 9., Subdivision
9. Boat docking facilities for the docking, mooring, or
accommodation of non-commercial boats, subject to the following
requirements:
(a) There shall be docking or mooring facilities for no
more than two boats than those owned and used by the owner of the
premises for his personal use.
