PASCALE County Clerk, Suffolk County Ob _7 o~ n Rk~ CERTIFICATE OF ABANDONMENT PURSUANT TO SUBDIVISION 3 OF SECTION 355 OF THE REAL PROPERTY LAW OF THE STATE OF NEW YORK Posillico Construction Co., Inc., with offices located at 346 Maple Avenue, Suite 12, Westbury, NY 11590 for the purpose of abandoning and canceling the subdivision of a certain tract of land, owned by them and hereafter described, pursuant to Subdivision 3 of Section 355 of the Real Property Law of the State of New York in order to file, subsequent to the recording of the abandonment, a four lot subdivision and open space situated at Arshamomaque, Town of Southold, County of Suffolk, and State of New York into Lots entitled "Final Plat for the Clustered Standard Subdivision of Conkling Point Estates", the affiants hereby certify: 1. That a certain map subdividing such tract of land and other land situate at Arshamomaque, Town of Southold, County of Suffolk and State of New York, into lots, plots, blocks and streets entitled, "Map of August Acres - Section One" was filed in the Office of the Clerk of the County of Suffolk on 6/3/1991 as Map No. 9107 (the "Lot'). 2. That more than two (2) years have elapsed since the filing of said map. 3. That the tract of land owned by the undersigned which is to be abandoned is Lot 37 as described in the Schedule A attached hereto. 4. Said abandoned map is being replaced with lot 1, 2, 3 and 4, together with open space lot, with a Subdivision Map entitled "Final Plat for the Clustered Standard Subdivision of Conkling Point Estates" in the Schedule B attached hereto. 5. The undersigned being the owners of Lot No. 37 which is about to be abandoned hereby consent to the abandonment of Lot No. 37. 6. That Lot No. 37, as described herein (Schedule "A") is hereby abandoned and canceled and effective with due approval and recording thereof, said Lot No. 37 shall no longer exist. 7. The undersigned agrees to indemnify and hold the Town of Southold harmless against any and all claims made by reason of this abandonment. 8. Endorsed hereon is the approval of the Board of Assessors of the Town of Southold. 9. Submitted herewith is an Abstract of Title to said Lot No. 37 to be abandoned covering a period of at least 20 years and a certificate of a Licensed Title to the effect that there is no unpaid taxes or tax liens against said land. Said point being distant 868.03 northerly as measured along the westerly side of Kerwin Boulevard from the extreme northerly end of the arc of a curve, which connects the westerly side of Kerwin Boulevard with the northerly side of Sage Spur; RUNNING THENCE South 46 degrees 50 minutes 20 seconds west along the northerly line of above said recharge basin, 316.45 feet to a point along the easterly line of land now or formerly of Breezy Shores Community Inc; THENCE along the easterly line of land now or formerly of Breezy Shores Community Inc. the following two (2) courses and distances: 1.
