That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90) calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. However, the renovations have been designed to maintain existing wetlands setbacks except for a 5' encroachment by a new on-grade patio to be constructed with pervious pavers and to create an approximately 1,037 sf net reduction in coverage of the property by impervious surfaces through the removal of an approximately 1,400 sf asphalt driveway, which is to be replaced with a pervious gravel driveway. The entire dwelling structure will also be raised 2 feet above the required base flood elevation established by FEMA and New York State, which will provide the substantial benefit of reducing and minimizing the risk of structural damage adjacent to the vegetated tidal wetlands as a result of flooding and erosion. Additional mitigation measures have also been included in the project design both to offset any potential impacts of the proposed construction activities and to improve upon existing site conditions and create a net environmental benefit upon project completion. Specifically, the project will result in an improvement to both groundwater and, ultimately, surface water quality as a result of the replacement of the existing nonconforming sanitary system likely resting in groundwater with a new, upgraded sanitary system with all of its components elevated at least 2 feet above groundwater and located no less than 100 feet from wetlands. Additionally, a drainage system of leaders, gutters, and drywells will be installed to collect roof and site runoff, and a 10' wide, approximately 1,112 square-foot nonturf buffer to be planted with native vegetation will be established adjacent to the tidal wetlands boundary, which can serve both as a sink and filter for stormwater runoff and contaminants. By thus increasing on-site groundwater recharge, reducing lawn areas, and increasing the setback of lawn areas from wetlands, the potential quantity of site runoff reaching the adjacent tidal waters will be decreased, and the quality of any runoff that does reach tidal waters will be improved through a reduced concentration of potential fertilizers, pesticides, and insecticides. Together with the above noted reduction in lot coverage by impervious surfaces, these mitigation measures will protect and restore the ecological quality of the site through the protection of on-site wetlands; establishment of wetland buffers and enhancement of indigenous vegetation; and protecting and improving groundwater and surface water quality.
