SCTM#1000-17-1-13 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type 11 category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated January 8, 2014 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Subject property is a non-conforming 15,714 Sq. Ft. lot in the R40 zone district. It is improved with a two story single family dwelling. It has 241.55 feet of frontage on Stephenson's Road, 131.90 feet along the northern property line, 145.64 feet along Birdseye Road (Private Road) and 81.57 feet on King's Highway State Road 25(Main Road) as shown on the survey dated 10-15-2009 last revised 12-10-2013 prepared by John C. Ehlers, LS. BASIS OF APPLICATION: Request for Variances from Article XXIII Section 280-124 and the Building Inspector's December 26, 2013, amended December 30, 2013 Notice of Disapproval based on an application for building permit to construct additions and alterations to existing single family dwelling, at; 1) less than the code required side yard setback of 10 feet, 2) less than the code required rear yard setback of 35 feet. RELIEF REQUESTED: The applicant is requesting to construct a one story garage addition, deck addition and screen porch addition requiring variance relief for a side yard setback of 2.4 feet where the code requires 10 feet and a rear yard setback of 18.1 feet where the code requires 35 feet. ADDITIONAL INFORMATION: During the hearing the applicant's agent was asked to provide more information regarding the number of houses accessing the Private Road (Birdseye), and the character of the neighborhood. On March 12, 2014, the Zoning Board received information that there are I I lots accessing Birdseye Road and two are vacant, 9 lots access Stephensons Road and two are vacant, many are seasonal homes. The agent provided surveys and a google map showing several properties with similar setbacks as requested by the applicant. Page 2 of 3 - March 20, 2014 ZBA46728 - Scofield SCTMk1000-17-1-13 FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 6, 2014 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant's single family dwelling and many other dwellings in the area were built before zoning was established, and these nonconforming structures are characteristic of the neighborhood. The applicant's agent provided documentation of several homes with similar setbacks as those being requested. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The dwelling currently has pre-existing non- conforming setbacks and any additions will require variance relief. The home is in an area of several non- conforming lots with homes that have non-conforming setbacks. 3. Town Law &267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 76% relief from the code for the side yard setback request and 48% for the rear yard setback request. However, this is mitigated by the fact the property has three street frontages, with Stephensons Road being the only legal access for ingress and egress to the subject property, and the fact that the proposed porch addition along the easterly side yard will maintain the pre-existing non-conforming 3 foot setback and the proposed deck addition will increase the side yard setback from 2.4 feet to 5 feet. 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and to enable the applicant to enjoy the benefit of additions and alterations of their home while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Horning, seconded by Member Dames, and duly carried, to GRANT, the variances as applied for, and shown on the survey dated 10-15-2009 last revised 12-10-2013 prepared by John C. Ehlers, LS. And the architectural plans dated 12-09-2013 prepared by Meryl Kramer, Architect, labelled Al-3. CONDITIONS L The applicant shall install a vehicular safety barrier between the porch and the private road, known as Birdseye Road. 2. An undesirable change will not be produced in the character of the neighborhood nor will there be a detriment to nearby properties as a result of the proposed work. The proposed additions requiring side-yard and rear-yard relief will be constructed partially over the preexisting structural footprint, and partially continuing the same setback, thus maintaining the preexisting nonconforming side-yard and rear-yard setbacks of the existing structure. Moreover, the style of the home will blend with the surrounding homes, using cedar siding, double hung windows and sloped roofs. 2. The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue, other than an area variance, because: a. Due to the preexisting location of the house, a two car garage addition on the north side of the house unavoidably requires relief from Article XXIII Section 280-124. Because of the irregular shape of the lot and the location of the existing house, any addition would require a yard variance except to add on to the front of the house, which is illogical. b. Due to the preexisting 2.4' side-yard setbacks of the principal structure, any additions to the principal structure unavoidably require relief from Article XXIII Section 280-124 pursuant to the interpretation that they would increase the degree of non-conformance with the minimum and total side-yard setbacks set forth by Article XXIII Section 280-124. In this case, the applicant seeks the benefit of expanding the ground floor living space with a screened in porch with views of the water. 3. The amount of relief requested is not substantial because: a. The rear yard setback relief requested from Article XXIII Section 280-124 for the garage addition (16.9 feet or 48% relief) is mathematically substantial. However, it is not actually substantial because of the irregular shape of the lot and the diagonal relationship of the house to the property line. The addition, at its closest point is 18.1' from the rear property line. At its farthest point, the addition is 35' from the rear property line. b. The existing deck which is located 2.4 feet from the side property line will be removed and the new deck will be constructed 5 feet from the property line, thus reducing the preexisting nonconformity. 4. The project will not have an adverse impact on physical or environmental conditions. Significant measures are included in the project design to offset any potential impacts of the proposed construction activities and to improve upon existing site conditions to create a net environmental benefit upon project completion. Specifically, a drainage system of leaders, gutters, and drywells will be installed to collect roof runoff, and an existing, nonconforming septic will be removed and replaced with a new, Suffolk County Department of Health Services-conforming sanitary system. Additionally, the reconstruction of the house will bring the house into compliance with current NYS Residential Building Code and NYS Energy Code 5. None of the variance relief requested is self-created due to the preexisting locations of the structure being renovated and the need for renovation. It appears that many of these homes are used seasonally. 2. Survey of property two lots north on the corner of Birdseye Road and Maple Lane indicating a 9 foot front yard setback. Indicated with a #4 on the attached map. The attached surveys and aerial photograph demonstrate that the minimal side yard setback we are requesting IS in character with the neighboring properties. Further, the danger of vehicular traffic is minimal, considering the limited access and wide shoulder. The existing house has been in its current location for many years (built mid- 1930's) and has not sustained damage thus far. There was some discussion regarding the paving of the adjacent Private Roads. Birdseye Road is, in fact, a paved road. There is an approximately 10 foot wide shoulder, which separates the paved area from the eastern property line. Stephenson Road is unpaved.
