Party of the second part,
Whereas, a certain execution was issued out of the Supreme Court, County of Suffolk. State of New York in an action
between GOGGINS & PALUM BO, Plaintiff and RONALD DIACI IUN, as defendant, who are the Parties named in
said action; ajudgment was rendered in favor of GOGGINS & PALUM BO, as judgment creditor
(judgment was assigned to TRI STATE Capital Holdings LLC, 2885 Sanford Avenue, SW 017763, Grandville,
Michigan 49468 by assignment of judgment filed on the 17ih day of January 2013 with the "Clerk of Suffolk County,
State of New York) for the sum of thirty four thousand, three hundred forty five dollars and 301100 ($34,345.30).
Balance remaining due and unpaid against said defendant. for the sum of thirty four thousand, three hundred forty five
dollars and 301100, ($34,345.30) as appears by the judgment roll filed in the office of the Clerk of the Supreme Court,
County of Suffolk, which said judgment was docketed in the office of the Clerk of the County of Suffolk on the 181h day
of October, two thousand and twelve.
Whereas, said execution was directed and delivered to the Sheriff of the County of Suffolk commanding him to satisfy
said judgment out of the real property belonging to the judgment debtor Ronald Diachun on the day when said judgment
was so docketed in said County of Suffolk, or any time thereafter.
Whereas, under the term of the execution, the interest of the judgment debtor of, in and to the premises herein after
conveyed and described was subject to the lien of said judgment when the execution was delivered to the Sheriff OR,
Whereas, the said Sheriff in obedience to the command of said execution duly sold at public auction on the twenty first
day of January 2014, all the estate, right, title and interest which on the 18i° day of October, 2012, the judgment debtor
had of, in and to said premises. The public auction was held in the auditorium of the Suffolk County Off-ice Building,
360 Yaphank Avenue, Yaphank, New York, 119K in the said County of Suffolk, having first given public notice of the
time and place of such sale, by advertising, serving and posting the same according to law, at which sale the said
premises were struck off to: TRISTATE Capital Holdings LLC, for the sum of one thousand dollars and 00/100
(S 1,000.00) they being the highest bidder and that being the highest sum bidden for the same.
Whereupon, the Sheriff of Suffolk County after receiving from the said purchaser the said sum of money so bidden as
aforesaid, gave to said TRISTATE Capital l ielc ings LLC, the proofs of publication, service and posting of the notice of
said sale as directed by the law be given.
Now This Indenture W itnesseth, That the said party of the first part, by virtue of the said execution, and in pursuance
of the act in such case made and provided, and in consideration of the sum of money so bidden as aforesaid, to him duly
paid, hath sold and by those presents draft, grant and convey unto the said party of the second part, all the estate, right,
tide and interest which the said defendant Ronald Diachun had on the eighteenth day of October, 2012, or any time
thereafter of in and to the following described property to wit:
SALE 1: All that certain plot piece or parcel of land with the buildings and improvements thereon erected situate lying
and being in the Hamlet of Laurel, Town of Southold, County of Suffolk, State of New York and further described as
follows: BEGINNING at a point on the northerly side of Peconic Bay Blvd at the southwesterly comer of the premises
herein described adjoining land of Murray, formerly of D.A. Young on the west, running thence along said land of
Murray, north 26 degrees 28'west 350 feet to land of George and Theodore Diachun; running thence along said land of
Diachun, north 61 degrees 59' east 83.7 feet: Running thence along land of Diachun and land of Oakes, south 27
degrees 45' east 362.77 feet to the northerly side of Peconic Bay Illvd: Running thence along the northerly side of
Peconic Bay Blvd, south 69 degrees 29' west 98 feet to the point or place of BEGINNING.
To Have and to Ifold the said above mentioned and conveyed premises unto the said parry of the second part,
And assigns of the party of the second part, their heirs or successors, as fully and absolutely as the said party
Of the first part, as Sheriff as aforesaid, can or ought to sell and convey the same by virtue of the said
execution and the law relating thereto. The word "party" shall be construed as if it reads "parties" whenever
the sense of this indenture so requires.
In Witness Thereor, the said JOHN P. MEYERRICKS, JR. Under Sheriff of the County of Suffolk. State of
New York, has duly executed this deed, die day and year fist above written. „
