BOUNDARY LINE AGREEMENT
Agreement made the 6 Yday of November, 2013 by and between MARK BENNETT and
DAWN BENNETT, his wife, both residing at 1120 Bridge Lane, Cutchogue, New York (hereinafter
referred to as BENNETT); and HENRY OMAN and CHRISTINA J. OMAN, his wife, both residing at
1380 Bridge Lane, Cutchogue, New York (hereinafter referred to OMAN)
WHEREAS, BENNETT are the owners of certain premises commonly known as 1120 Bridge
Lane, Cutchogue, New York, bearing Suffolk County Tax Map No. 1000-085.00-02.00-006.000, more
particularly described in Exhibit A attached hereto and made a part hereof.; and
WHEREAS, the OMAN are the owners of certain premises commonly known as 1380 Bridge
Lane, Cutchogue, New York, bearing Suffolk County Tax Map No. 1000-085.00-02.00-005.000, more
particularly described in Exhibit B attached hereto and made a part hereof; and
WHEREAS, the property belonging to BENNETT and OMAN are adjoining as set forth on the
survey made by Thomas Matarazzo, L.S., dated October 3, 2013, which is attached hereto and made a part
hereof as Exhibit C; and
WHEREAS, the said survey provided to OMAN and annexed hereto as Exhibit C indicated that a
certain wood post and wire fence is located on the property owned by BENNETT, which said fence is
located up to 2.0 feet southeast of the common boundary line between said properties of BENNETT and
OMAN.
NOW, THEREFORE, the parties hereto agree, as follows:
1. That the common boundary of the premises of BENNETT and OMAN are accurately shown
on Exhibit C. That said common boundary line begins at the northeasterly side of Bridge Lane and runs
North 46 degrees 10 minutes 00 seconds East a distance of 319.20 feet.
2. That all of the above clauses are incorporated herein with as much force and effect as if more
fully set forth herein at length..
3. That BENNETT agrees to pay all fees associated with the preparation and execution of this
agreement, including but not limited to the recording fee for same.
4. That in consideration of the foregoing and upon the mutual promises of the parties hereto, the
parties agree that they will make no claim against the other to any of the property at issue herein either by
adverse possession or otherwise and particularly BENNETT makes no claim as to any property northwest
of the common boundary line set forth in Paragraph 1 above and OMAN makes no claim as to any property
to the southeast of the common boundary line set forth in Paragraph 1 above.
5. That the parties further agree that they will execute any and all other documents necessary to
incorporate the tetras of this Agreement including, but not limited to the Acknowledgment of No Claim By
Reason of Encroachments annexed hereto as Exhibit D..
6. That the parties hereto covenant and agree that this agreement shall be binding on their
respective heirs, successors and assigns.

HENRY OMAN and CHRISTINA J. OMAN, each being duly sworn, hereby depose and state as follows:
That we are over the age of eighteen years.
That we are the fee owners of real property known as 1380 Bridge Lane, Cutchogue, New York, which is
known and designated as Suffolk County Tax Map No. 1000-085.00-02.00-005.000 and is more
particularly described in Exhibit B annexed hereto and made a part hereof

That said property is located northwest of the premises known as 1120 Bridge Lane, Cutchogue, New York
which is known and designated as Suffolk County Tax Map No. 1000-085.00-02.00-006.000 owned by
MARK BENNETT and DAWN BENNETT. Our southeast property line abuts the northwest property line
of BENNETT.
That BENNETT owns a certain wood post and wife fence, which is set inside their property up to
approximately 2.0 feet southeast of their northwest property line.
That we have not, in the past, nor do we now, make any claim of ownership, actually or by adverse
possession, to any of the property owned by BENNETT as shown on the survey made by Thomas
Matarazzo, L.S. dated October 3, 2013 and attached hereto as Exhibit C, which we have reviewed and more
