OWNER is the owner of real property commonly known as 350 Private Road 21, Southold, NY, County of Suffolk, State of New York having a tax map number of 1000-078.00-09.00-039.00 which property OWNER obtained by deed dated September 12, 1979 and recorded October 4, 1979 in Liber 8717 page 179. Said property is also shown on the attached survey map last dated January 21, 2014 by Kenneth M. Woychuk Land Surveying PLLC. Which survey is attached and made a part of this Agreement B. ADJACENT NEIGHBOR is the owner of real property commonly known as 480 N. Bayview Road Extension, Southold, New York, County of Suffolk, State of New York, having a tax map number of 1000- 078.00-09.00- 041.00 and which is further described in deed dated July 19, 2012 recorded in the Suffolk County Clerk's office in Liber12700 page 598 which property adjoins OWNERS property described above. C. There is presently a Wood Rail Fence on OWNERS property that continues on to the ADJACENT NEIGHBOR'S property. D. The parties wish to establish a common boundary line between OWNER'S property and ADJACENT NEIGHBOR'S property and defined the use of the Wood Rail Fence. NOW THEREFORE, in consideration of the premises and mutual promises made in this Agreement the sum of One Dollar ($1.00) and other good indictable consideration by each of the acknowledged, the parties covenant and agree as follows: 1. The ADJACENT NEIGHBOR hereby conveys, releases and quitclaims on to the OWNER and OWNERS successes and assigns forever all of the ADJACENT NEIGHBORS right title and interest in and to ALL LANDS INCLUDING the Wood Rail Fence LYING SOUTH OF OWNERS NORTHERLY PROPERTY LINE AS SET FORTH ON THE ATTACHED SURVEY WHICH LINE IS ALSO THE SOUTHERLY LINE OF TAX LOT k 1000 078 09 041, THE ADJACENT NEIGHBOR'S PROPERTY. THE PROPERTY LINE AS SHOWN ON SAID SURVEY READS AS FOLLOWS, S 66 26' 20" EAST 163.27' FEET. 2. The Wood Rail Fence upon the OWNERS property does not and shall not ripen into nor become a right to use any portion of the OWNERS property by the ADJACENT NEIGHBOR. 3. The parties agree that this Agreement will ensure to the benefit of the mortgagee's, current or future, of the respective properties. IT IS MUTUALLY COVENANTED AND AGREED by the parties that this Agreement shall run with the land and inure to the benefit of and be binding upon the parties, their heirs, distributees, legal . representatives, successors and assigns.
