This agreement is made this ~ day of January, 2014 by and between
Gregory W. Van Kesteren with an address of 1785 Cedarfields Drive, Greenport,
New York (Owner) and Ce!0 io Rodriguez, with an address of 1815 Cedarfields
Drive, Greenport, New York ("Neighbor).
A. Owner is the owner of real property commonly known as 1785
Cedarfields Drive, Greenport, Town of Southold, County of Suffolk ,
State of New York, District 1000, Section 040100 Block 05.00, Lot
001.007 more particularly described indeed recorded in Liber 11213,
page 539, (Owner's Property), which property is shown on the
attached survey map dated December 20, 2013, made by Peconic
Surveyors, P.C., which survey is made a part of this agreement.
B. Neighbor is the owner of real property commonly known as 1815,
Cedarfields Drive, Greenport, Town of Southold, County of Suffolk,
New York, District 100Q Section 040, 00 Block 05.00, Lot: 001.006
more particularly described in deed recorded in Liber 12444, page
815 which adjoins the Owner's Property ("Neighbor's Property)".
C. There is a fence with the boundaries of the Owner's Property located
as follows: fence encroaches up to 1.8' South of part of the Northerly
record line.
D. The parties which to establish the common boundary line between
Owners Property and Neighbor's Property.
NOW THEREFORE, in consideration of the premises and mutual
promises made in this Agreement and the sum of One dollar and xx/100
($1.00) and other good and valuable consideration by each of the parties
to the other in hand paid, the receipt and sufficiency of which is hereby
acknowledged, the parties covenant and agree as follows:
1. The Neighbor hereby conveys, releases and quit claims unto the
Owner and Owner's successors and assigns, forever all of Neighbor's
right, title and interest in and to 1.8' South of part of northerly record
line.
2. The placement of the fence upon Owner's Property does not and shall
never ripen into nor become a right to use a portion of the Owner's
Property and by the Neighbor, but is and shall continue to be a use by
sufferance of that portion of the Owner's Property.
3. The Parties agree that this Agreement will inure to the benefit of the
Owners, current or future, of their respective Properties.
IT IS MUTUALLY COVENANTED AND AGREED by the parties
that this Agreement shall run with the land, insure to the benefit of and
be binding upon the parties, their heirs distributes, legal
representatives, successors and assigns.

ALL that certain plot, piece or parcel of land, situate, lying and being at Greenport, Town of Southold, County of Suffolk
and State of New York, known and designated as Lot Number 7 on a certain map entitled "Subdivision of Cedarfields at
Greenport" filed in the Suffolk County Clerk's Office on 6/27/90 as Map No. 8966, said lot being bounded and described
as follows:
BEGINNING at a point on the westerly side of Cedarfields Drive where same is intersected by the division line between
Lots 8 and 7 on the above mentioned map;
RUNNING THENCE along said division line, South 83 degrees 31 minutes 23 seconds West, 287.23 feet to lands now or
formerly of Moores Lane Holding Corp.;
THENCE along last mentioned land, North 16 degrees 01 minutes 50 seconds West, 148.32 feet to the division line
between Lots 6 and 7 on the above mentioned map;
THENCE along last mentioned line, South 76 degrees 28 minutes 37 seconds East,-337.64 feet to the easterly side of
Cedarfields Drive;
THENCE along the easterly side of Cedarfields Drive, along an arc of a curve bearing to the left having a radius of 90 feet
a distance along said curve of 31.42 feet to the point or place of BEGINNING.
THE POLICY TO BE ISSUED under this commitment will insure the title to such buildings and improvements on the premises which
by law constitute real property.
FOR CONVEYANCING ONLY: Together with all the right, title and interest of the party of the first part, of in and to the land lying
in the street in front of and adjoining said premises.

BEGINNING at a point on the northwesterly side of Bennett Road where the same is intersected by the division line
between IM 5 and 7 on the aforesaid map;
RUNNNG THENCE from said point or place of beginning along the division litre between lots 6 and 7 North 76
degrees 28 minutes 37 seconds West 337.64 feet land now or formerly of John A. Costello;
