BOARD OF SOUTHOLD TOWN TRUSTEES
Meeting of February 9, 1976
A regular meeting of the Board of Southold Town Trustees was
held at 7:30~P.M., Monday, FebruaryI 9, 1976, at the Town Board
meeting room~ 16 South Street, GreenPort, New York, With the
following present:
Alvah B. Goldsmith, Chairman
Douglas M. Robertson
Philip G. Horton
George C. Bird
Joseph Hataier
Betty Neville, Secretary
Also presenT: William & Lorraine Terry, Paul Stoutenberg-North
Fork Environmental Council; Robert Rinklin-L.I. Traveler; Gertrude
Fullan-The Suffolk Times; Lawrence Tuthill.
On motion of Mr. Goldsmith, seconded by Mr. Hataier, it was
RESOLVED that the applicationo~f John Lowery, 650 Oak Street,
Southold, N.Y., for permission to construct dock 40'x4', ramp~
4'x~', and float12'xS' on Goose Creek, Southold, N.Y.,,be
TABLED for investigation and inspection of the property. Location
of this property inrrelation to the two recently approved permits
of the Goose Bay Civic Association to be determined.
Vote of the Board: Eyes: Mr. Goldsmith, Mr. Robertson, Mr. Horton,
Mr. Bird, Mr. Ha~aier.
Stanley Coffin, Attorney for A.B. Rosenberg appeared before the
Board in regard to. Mr. Rosenberg's application for dredging at
Sterling Creek, Gr~eenport. This application was not formally on
the agenda for this meeting. As of our last meeting, January 5,
1976, this application was tabled until such time as other information
or proceedings were received. The Board sent Mr. Rosenberg a letter
to this effect. No further infommation had been received to date.
Chairman Alvah B. Goldsmith excused himself from this application on
×the grounds of prejudice, and requested Philip Horton to act as
~ Chairman dd~ing the consideration of this application. Mr. Corwin
stated that he had expected Mr. Rosenberg to be present at th~s
meeting. He said that the Board's willingness to consider granting
the application in part-150ft, along the east end was not satisfactory
to Mr. Rosenberg. Mr~ Rosenberg is not only concerned with the boats
on the slip on the east end smd on the north end, but he is also
concerned about the larger boats tied up on the west side of the
marina that need space on the southeast in order to maneuver
adequately when the tide is low. Mr. Corwin asked the Board to
re-consider and go as far as 200 ft. to afford room to maneuver
the larger boats that are docking on the west~side, Mr. Corwin

stated that this is the reason that the applicant rejected the
150 ft. proposal; it had nothing to do with the boats north of the
east end. Mr. Corwin stated that 200ft. still will not bring it
down to Harry Rocker's property line. He again stated that this is
maintenance .dredging only amd theft i~ wilI not haveany affect
environrcantally. Mr. Bird questioned the locat~on as described by
Mr. Corwin. The location was discussed by the Board. Mr. Corwin
stated that there will not by amy additions or any increase~n the
size of the marina. Mr. Horton questioned what depth Mr. Rosenberg
will dredge. Mr. Corwin~stat~d 4ft. on the edge of the ba~k and
about 6-lOft. out. Mr. HakryR~cker(sou~herly adjacent property .
owner) and Mr. c~ar~nce-Powell~p~operty ~Wner .in the immediate ~rea)
questioned the necessity of this dredging as proposed. Mr..Rocker
stated that the original objection is not to have the spoil put on
the land. It is unsightly anda probable health hazard. Mr. Rocker
stated that if the spoils are allowed, to-be put on the property, he
visualizes.Mr. Rosenberg utilizing this as, a parking-area for a
commercial marina and that this is not a legal commercial marina.
He requested that Mr. Rosenberg be compelled to remove the spoils
by dump truck, if this app~ication~is g~anted. Mr. Corwin s~ated
that he thought Mr. Rosenberg w6uld object to the hauling away of
the spoil beo~ase it is anunnecessary and unreasonable expense.
A leng~hlydiscussion was held by-th~ Board and others p.resent
regard to this application. Mr. Goldsmith statsd-his reasons for
not acting on this application. He said that he would vote on this
application only ~is there is a tied vote. The Board will make
another insPection-of ~his properSy and contact other property
owners in the immediat'e area. This ma~ter wil-1 be put on the agenda
for the next meeting.
The Board inspected the file on the application of William Johnston,
/Fisherman'~ Beach, Cutchogue for permission to bulkhead and dredge
direotty"in front of his property at Fisherman'S Beach. The Board
requested Larry Tuthill to submit a survey of the property. This
application will be put on the agenda for the next meeting.
On motion by Mr. Goldsmith, s~conded by Mr. Robertson, it was
RESOLVED that Ernest W. Guettinger, He~lock Drive, Mastic Beach,
N.Y. 11951, be GRANTED permission to reconstruct and repair dock
/36"x4', and construct ramp 12'x2', float 20'x8', and to install
10 pilings i~Eugene's Creek, directly in front of ~sproperty
at Oak Street, Cutchogue, N.Y., all i~ accordance with the detailed
specifications as presented in the originating application. Fee ~&~.~.
Vote of the Board: Ayes: Mr. Goldsmith, Mr. Robert~on, Mr. Horton,~k~
Mr. Bird, Mr. Hataier.
Mr. Goldsmith ±nformed the Board~hat he had.received a call from a
/Mr~ Carey regarding bulkheading that is being constructed at Brushes
Creek, Matt~tuck. Mr. Goldsmith toldMr. Carey that this was on the
bayfront amd that the Trustees have no jurisdiction.
On motion By Mr. Bird, seconded by Mr. Robertson, it was
RESOLVED that ~he minutes of the-Board of South01d Town Trustees,
dated-January 5, 1976, be approved as submitted.
Vote of the Board: Ayes: Mr. Goldsmith, Mr. Robertson, Mr. Horton,
Mr. Bird. Mr. Hataier.

The secretary advised the Board that she had made an inquiry to the
Suffolk County Dept. of Public Works to Mr. Carl Eisenschmeid,
regarding the possibility of them providingkthe Trustees with copies
of the County Dredging Maps of the town waters and creeks..Mr.
~Eisenschmeid advised that they would furnish the Trustees With
these maps, free of cost, upon receipt of a letter from Supervisor
Martocchia requesting them on behalf of the Trustees.
On motion of Mr.~Mataier, seconded by Mr. Bird~ it was
RESOLVED that SupervisorMartocchia be requested to send letter
to the Suffolk County Dept. of PUblic Works requesting ~he
County Dredging Maps of the town waters and creeks on behalf of
the Southold Town Trustees.
Vote of the Board:~Ayes: Mr. Goldsmith, Mr. Robertson, Mr. Hataier,
Mr. Horton, Mr. Bird.
Larry Tuthill stated that Supervisor Martocchia is .presently
investigating the possibility of securing aerial, contour maps
from the Suffolk County Dept. of Public Works through Rudi
cammeron. Larry Tuthill suggested, the possibility of securing
~ set for the Town Trustees.
On motion by Mr. Horton,.seconded by Mr. Bird, it was
RESOLVED that the next regular meeting of the Board of Southold
Town Trustees be held at 7:30 P.M., Monday, March 8, 1976, at
the Town Board meeting room, 16 South Street, Greenport, N.Y.
Vote of the Board: Ayes: Mr. Goldsmith, Mr. Robertson, Mr. Horton,
Mr~ Bird, Mr. Hataier.
