WATER LINES MAINS AND APPURTENANCES
THIS INDENTURE, made this day of December, 2013 is by and between
Wickham Bungalow East, LLC, a New York limited liability company with offices c/o
Thomas Wickham, P.O. Box 999, 28700 Main Road, Cutchogue, New York 11935
hereinafter "WB East"; and
Wickham Family, LLC, a New York limited liability company with offices c/o John L.
Wickham, 11752 Harford Road, Glen Arm, MD 21057-9355, hereinafter "W Family";
and
Pamel Wickham, residing at 4299 New Suffolk Road, New Suffolk, New York, 11956,
hereinafter "Parnel".
Whereas, WB East owns real property located at 4787 New Suffolk Road, New
Suffolk, New York 11956, as more fully described in Schedule A, attached hereto, and
Whereas, W Family owns real property at 5005 New Suffolk Road, New Suffolk,
New York 11956, as more fully described in Schedule B, attached hereto,
Whereas, Pamel owns real property located at 4299 New Suffolk Road, New
Suffolk, New York 11956, as more fully described in Schedule C, attached hereto, and
Whereas, all parties wish to grant and convey to the others a permanent and
perpetual casement over the portion of each party's property within or near the traveled
road areas, as described on Schedule D, attached hereto, to permit the parties to install
subsurface water service lines from New Suffolk Road to their respective properties, to
be used solely for the purpose of providing water service from the public water
distribution system and underground utilities to the properties described in and across
the properties described in Schedules A, B, & C.
WITNESETH:
Therefore, in consideration of Ten Dollars ($10.00) and of other good and valuable
consideration, paid by each party to the other, each party does hereby grant and convey
unto the other parties, its heirs, successors and assigns:
1. From WB East, Grantor, over the portion of the land described in Schedule D
which crosses the land described in Schedule A to W Family, and Pamel, Grantees; and
2. From W Family, Grantor, over the portion of the land described in Schedule D
which crosses the land described in Schedule B, to WB East and Pamel, Grantees,
all of such conveyances being for and conveying from each Grantor named above to the
Grantees named above, a permanent and perpetual easement, running with the land,
over the land of the Grantor, consisting of the right to install, operate, maintain, repair,
remove and replace, at the cost and expense of the Grantee, the party for whose benefit
the line or lines are installed, a subsurface water service line or lines and appurtenances
within the portion of Grantor's Property described in Schedule D attached and made a
part hereto (hereinafter the "Easement Area").
The water service lines installed pursuant to this easement shall be used solely for
the purpose of transmitting water from the public water distribution system to the
respective Grantee's Property across the Easement Area and shall be and remain the
personal property of the Grantee, its successors and assigns, forever.
In addition, this grant of Easement shall permit the installation, maintenance and
repair of underground utilities within the Easement Area, provided same are installed
and located so as not to interfere with the installation, operation and maintenance of the
subsurface water services lines and appurtenances.
The Grantee shall promptly and at its own cost and expense restore the Easement
Area to a condition substantially similar to the condition which existed prior to the
installation of service line or lines and after each exercise of its right to maintain, repair,
remove or replace the service line or lines if activity disturbs the Easement Area.
This easement shall be forever binding the parties, their heirs, successors, and
assigns for the benefit of other parties, their heirs, successors, and assigns.
IN WITNESS WHEREOF, Grantors and Grantees, in the capacities described above,
each have hereunto set their hands and seals on the day and year first above written.

BEGINNING at a point of the intersection of the northerly line of land now or formerly of
Wickham Family, LLC and the southerly line of land now or formerly of Wickham and Suffolk
County (Development Rights) with the northwesterly line of the premises herein described, said

BEGINNING at an interior point where the southwesterly side of land now or formerly of
Pamel Searl is intersected by the northerly side of land now or formerly of Wickham
Bungalow East, LLC and the southerly side of land now or formerly of Wickham Family,
LLC; said point or place of beginning the following two courses and distances from the
easterly side of New Suffolk Road;
1) South 72 degrees 00 minutes 30 seconds East 1621.52 feet;
2) North 64 degrees 19 minutes 00 seconds West 198.83 feet to the true point or
place of beginning:

An Easement for Water Lines and Utilities in accordance with the Agreement to
which this Schedule D is attached over the following described properties:
ALL that certain plot, piece or parcel of land, situate, lying and being at New Suffolk, in
the Town of Southold, County of Suffolk and State of New York, being a strip of land 50
feet in width, the southerly line of which is bounded and described as follows:
BEGINNING at a point on the easterly side of New Suffolk Road, at the
southwesterly corner of Lot #1 as shown on a certain map entitled "Minor Subdivision
made for John Wickham", filed in the Office of the Clerk of the County of Suffolk on
12/9/92 as Map #9297.
Running thence along the southerly side of Lot #1 on said Map the following four (4)
courses and distances:
1. South 72 degrees 00' 20" East 110.00 feet; thence
2. South 79 degrees 00' East 255.0 feet; thence
3. South 46 degrees 00' East 135.0 feet, thence
4. North 86 degrees 35' 50' East 297.42 feet.
Running thence through lands of Lot 1 North 86 degrees 35' 50" East 280 feet, more
or less, to the northerly side of said Lot 1 and lands of Wickham Bungalow East, LLC;
Continuing thence through lands of Wickham Bungalow East, LLC North 86 degrees
35' 50" East 280 feet, more or less, to a point; hereinafter referred to Point 1; running
thence
a) northeasterly along the southerly side of the traveled road on a course bearing

of land of Pamel Wickham; the easement granted herein to Pamel Wickham being 50
