ZENESKI, as husband and wife, both residing at 48650 Main Road, Southold, New York 11,971 •` party of the second par[, 12 17 21 WITNESSETH, that the party of the first par4.by_yirtue of the power and authority given in and by said last will and testamer.4 and in consideration of ($335 , 000 .00} 'TRjME—,r4lN)Rf3H-,WH,1RTY,._ w FIVE THOUSAND . . . . . . . . . . . . • • • • • • •dollars, part, does paid by the party of the second hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being imkm at Southold, Town of Southold, Suffolk County, New York, known and designated as Lot 25 on a certain map entitled, "Map of West Creek Estates", filed in the Suffolk County Clerk's Office on August 19, 1963 as Map No. 3848; said lot being bounded and described as follows: ' BEGINNING at a monument set at the comer formed by the intersection of the southerly side of Glenn Road and the westerly side of said Glenn Road; RUNNING THENCE South 15 degrees 11 minutes 30 seconds East along the westerly side of Glenn Road, 221.20 feet to the ordinary high water mark of West Creek; THENCE westerly along said ordinary high water mark of West Creek, a tie distance of 130 feet, more or less, to Lot No. 24; THENCE North 12 degrees 00 minutes 00 seconds West along the division line between Lot Nos. 24 and 25 on said map, 233.90 feet to a monument and the southerly side of Glenn Road; THENCE South 80 degrees 30 minutes 00 seconds East along the southerly side of Glenn Road, 121.88 feet to the corner at the point or place of BEGINNING. PREMISES are the same as those described in Liber 9577, cp 430. TOGETHER with all right, title and interest, if any, of the party of the first part in and to.any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and also all the estate which the said decedent had at the time of decedent's death in said premises, and also the estate therein, which the party of the first part has or has power to convey or dispose of, whether individ- ually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvenknt before using any part of the total of the same for any other purpose. The word "party" shall he construed as if it read "parties" whenever the sense of this indenture so requires.
