SUBJECT TO Conservation Easement dated April 29, 2004 between New York State
Federation of Growers and Processors Association, Inc., as grantor and Town of Southold, as
grantee recorded on May 24, 2004 in Liber 12320 page 981.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated August 22, 2002 recorded September 5, 2002 in Litter 12207 page 425 and by deed
dated April 29, 2004 recorded May 24, 2003 in Liber 12320 page 982.
TOGETHER with all right, title and interest, if any, of the pony of the first part of, in and iouny sneels and roads abutting the
above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the
party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the
second pan, the heirs or successors and assigns of the party of the second pan forever.
AND the party of the first pan covenants that the party of the first pun has not done or suffered anything whereby the said
premises have been incumbeied in any way whatever, except as aforesaid.
AND the parry of the first pan, in compliance with Section 13 of the Lien Law, covenants that the party of the first pan will
receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund io be applied
first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any pan of the total of the same for any other purpose.
The word "party" shall he construed as if it read "parties" whenever the sense of this indenture so requires.

inclusive, as shown on a certain map entitled, "Map of Nicholas Aliano," Sled in the Suffolk County Clerk's Office on

BEGINNING at a point on the southerly side of Middle Road C.R. 48 (North Road) distant 952.24 feet westerly as
measured along the southerly side of Middle Road from the comer formed by the intersection of the southerly side of
Middle Road and the westerly side of Paul's Lane;

THENCE Easterly along the arc of a curve bearing to the left having a radius of 2989.79 feet a distance along said curve
