L~ ans, Justice AV ES: Ghosio, Dinizio Jr, Ruland, Doherty, Evans, Russell Generated March I l,, 2014 Page 36 TOWN OF SOUTHOLD Policy for Fundraising by Agencies and Committees of the Town and Gifts to the Town March 11, 2014 This Policy sets forth guidelines for fundraising conducted by Town agencies and Committees and for gifts and donations received by Town agencies and Committees. 1. Fundraising Activities: a. Direct fundraising activities that involve the solicitation of monies or gifts by Committee members, officers or employees on behalf of the Town, a Town agency or a Town Committee are prohibited. b. Town agencies and Committees are not permitted to sponsor a fundraising activity. c. Any fundraising activity that is held for the benefit of the Town shall be administered by individuals in their private capacity or by community groups that are not affiliated with the Town. Such individuals or community groups may then make a donation to the Town as set forth below. d. However, any Town Committee members, officers or employees may provide general information to the public regarding voluntary gifts or donations, if required by a grant contract or similar obligation. ll. Gifts and Donations to the Town, a Town Agency or Town Committee a. The Town, Town agencies and Town Committees are permitted to accept gifts and donations that are to be used for municipal purposes. Gifts may be accepted on the condition that they be used for a specified municipal purpose so long as the condition does not require Committee members, officers or employees to surrender their powers and duties. b. Any monetary gifts or donations made to the Town, a Town agency or Town Committee shall be submitted to the Town Comptroller's Office for deposit or directly deposited by a particular Department into the appropriate fund and will be subject to audit, budget appropriations and competitive bidding requirements. To utilize funds that have been gifted or donated to the Town, an appropriation must be requested and approved by Town Board resolution. c. Any non-monetary gifts must also be reported to the Town Comptroller's Office to record on the Town's asset list, if necessary. Any inquiries regarding this Policy should be addressed to the Town Attorney.
