Box 1179 Southold, NY 11971 Re: Application of J&J Bredemeyer Family Trust - SCTM No. 1000-26-1-18 2660 Village Lane, Orient, New York Gentlemen: We are the attorneys for John and Sarah Henry (the "Henrys"), the owners of property located at 2440 Village Lane, Orient, New York (SCTM No. 1000-26-01-17.1). I write this letter in connection with the above-captioned application. The J&J Bredemeyer Family Trust (the "Trust") owns a parcel of property immediately to the south of the property owned by the Henrys. The Trust seeks to culture shellfish under the dock owned by the Henrys. The Trust's application is noticed for January 22, 2014. First, I respectfully request that you reject the application, because the Trust has no ownership interest in any portion of the property that is the subject of its application. My understanding is that the bottomland in Orient Harbor is owned by the State of New York. The dock under which the Bredemeyer Trust seeks to locate its aqua-culture project is owned by the Henrys. Second, I request that you advise me in advance of January 22, 2014 whether the Bredemeyer Trust application will be on the agenda. If it is on the agenda, I intend to be there on behalf of the Henrys. (00500399) ESSEKS, HEFTER & ANGEL, LLP COUNSELORS AT LAW Res I 4~~ L-~)' ectfully yours, 4 ' , SRA:mw tephen Angel cc: Lori M. Thank you. [Continuing by such other "Reader" in support of the subject application:) 1, Eric Bredemeyer, the co-Trustee of the Bredemeyer Family Trust (BFT) and the Applicant, write in support of the subject application. By now you have the application, supporting materials, as well as an Original Official Certified Copy of the Recorded Deed for the Bredemeyer Family Trust (BFT) property at 2660 Village Lane, Orient, NY, and an Original Official Certified Copy of the Recorded Deed of the closest-adjoining neighbor's property at 2440 Village Lane, Orient, NY, and you have completed the Field Survey. I do request approval and that the permit be issued. The Bredemeyer Family Trust continues to cooperate and has tried to fully keep the Town, your Board and Panel Attorney advised. On the January 2014 evening of the Board's hearing on my (BFT) wetland application, I shall be standing by at telephone 305-609-7488 to participate. My brother, John M. Bredemeyer III, who is present in person at the hearing, as no doubt your minutes/record reflect has with him a cell phone with a speaker phone option which should handle connection logistics for calling me and placing me before you; or should you otherwise desire contact me at that number by another telephone. Please call me whenever you believe I may be of assistance in providing answers and information concerning my pending wetland application. If my request to appear telephonically as I propose is denied, or being considered for denial, I respectfully ask that you nevertheless call me for the purpose of discussing such possible denial and status of the situation. Finally, in the absence of a clear telephonic connection; and/or if there exists a prohibition in New York law to my telephonic appearance for this matter (or there is a sustained objection to my brother John III undertaking the limited role of authenticating me/my voice), I would respectfully then request that the subject BFT wetland application be formally moved to the agenda for the scheduled February 2014 Public Hearing of the Board of Trustees. Box 1179 Southold, NY 11971 DEC - 5 2013 RE: Application for Wetland Permit forAddress at 2660 Village Lane, Orient NY(P. O. Box 416, Orient NY) 11957, SCTMap 26-1-18,• application by The J n M. S,LtlitilJ Bredemeyer, Jr., and Jeanne R. Bredemeyer Family Trust Dear Town of Southold (TOS) Trustees: I am submitting the attached Wetland Permit Application for the subject address along with the required check for $250.00 fee. I, Eric Bredemeyer, am the Co-Trustee of the John M. Bredemeyer, Jr., and Jeanne R. Bredemeyer Family Trust (hereinafter BFT) owner of the home and land at 2660 Village Lane, Orient, NY. My parents John, Jr. and Jeanne live in the home. All my grandparents lived in Southold going back some 80 years. My brother, John M. Bredemeyer III, and I have assumed many of the affairs of my elderly parents who have lived on Village Lane for nearly 50 years. As a Trustee of the BFT, I am authorized on behalf of the BFT to make this application. John III, (is a Town Trustee as you know) and is Co-Trustee of the BFT. I, as the other, and may I add only other Co-Trustee of the BFT, hereby authorize Brother John III on behalf of the BFT to address the TOS Southold Trustees and any other officials or agents of the TOS associated with this Application and such things reasonably related to it. Brother John III should be considered by you as if I were before you. However, there may be certain matters from which John III may be precluded. Please be advised that any preclusion or prohibition of John III based upon his official status with the TOS should neither be considered a waiver/ default by the BFT nor myself as the other BFT co-trustee of any procedural or substantive matter associated with this application and matters directly or indirectly related to it. Your patience and cooperation with this situation is appreciated, too. My father, and grandfathers before, actively shell fished in Orient. One of my earliest memories is scooping dinner plate sized chowder clams off Long Beach by Bug Light with my father from his old 18 foot inboard. I was at best 7 or 8. Those clams were BIG. My Dad and grandfather continued helping me with shell fishing as I got older. Seeding/digging clams or spat (our primitive and informal aquaculture), dipping /dredging for scallops, or combing for oysters up in Hallocks Bay or in front of our house at Orient Harbor was great. Times were simpler, no doubt. My Mom still makes a mean scallop chowder. My parents both look out their window and today, and as ever, like to see their son(s)(and now their granddaughter and grandsons) using the bay before their house. I may practice law these days, but I have my first degree in biology from Stony Brook and Brother John III has his degree from Cornell and his work these many years on the waterfront (and mine in the Navy) thereby make this application appropriate. We should really wish that not only my folks but John III/me and our families can give this application meaning. We sincerely thank you for your time and consideration. Please feel free to ask Brother John III any questions in this matter or call me. We can supplement the application as may be required. very truly yours, v ERIC R.
