THIS INDENTURE, made the O day of September, 2013

party of the first part, and
U.S. Bank National Association not in its individual capacity, but solely as Legal Title Trustee
for LVS Title Trust 1, 314 S Franklin St. 2°d Floor, Titusville, PA 16354./'
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, as set forth in the annexed Schedule A.
Said Premises being known as: Hedge Street Lot 9
Fishers Island, New York 06390
IT BEING the intention of the parties that the aforementioned mortgage shall not merge into the
fee interest conveyed hereby, but that such mortgage shall remain as a good and valid mortgage,
separate and apart from any other interest of the party of the second part in the fee.
THIS DEED is an absolute conveyance of title in effect as well as form and is not intended as a
mortgage, trust conveyance or security of any kind. The consideration therefor is the full release
of the parties of the first part from all debts, bonds, notes, obligations, cots and charges
heretofore subsisting on account and by the terms of the aforementioned mortgage, and by
acceptance of this deed the party of the second part automatically grants such release.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
This deed is an absolute conveyance, the grantor(s) having sold said land to the grantee for a fair
and adequate consideration, such consideration, in addition to that above recited, being full
satisfaction of all obligations secured by the mortgage executed by Dante Oliveri and Cynthia
Oliveri to JPMorgan Chase Bank, N.A. (as mortgagee) dated October 29, 2007 in original
amount of $450,000.00 and recorded in Liber: 21636 Page: 523 on November 21, 2007 in the
office of the County Clerk of Suffolk, and the note(s) or bonds(s) secured thereby. Said
mortgage was further assigned to U.S. Bank National Association not in its individual capacity,
but solely as Legal Title Trustee for LVS Title Trust I by way of assignment to be recorded
simultaneously herewith.
Grantor(s) declares that this conveyance is freely and fairly made, and that there are no
agreements, oral or written, or other than this deed between grantor(s) and grantee with respect
to said land.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture
so requires.

Town of Southold, County of Suffolk and State of New York, as more particularly
bounded and described as follows: f
BEGINNING at a stone monument on the northeasterly line of Hedge Avenue, said
monument being located 1906.94 feet north of a point which is 519.64 feet West of
another monument marking the US. Coast and Geodetic Survey Triangulation
Station "PROS"; and
THENCE RUNNING North 40 degrees 37 minutes West 57.3 feet to another
monument;
THENCE South 40 degrees 00 minutes West 64.1 feet to another monument;
THENCE CONTINUING South 40 degrees 00 minutes West 35.95 feet to another
monument;
THENCE South 50 degrees 00 minutes East 25.65 feet to a point on the said

Dante N. Oliveri and Cynthia Oliveri being severally and duly sworn, depose and say as
follows:
1. We are the owners in fee of premises commonly known as Hedge Street Lot 9, Fishers Isl,
New York 06390, which premises are more particularly described in a certain deed made by
Dante Oliveri to your deponents, dated October 29, 2007, recorded in Suffolk County Clerk's
Office on November 21, 2007 , in Liber 12531 of Conveyances, Page 132. Said premises are
presently subject to a mortgage held by U.S. Bank National Association not in its individual
capacity, but solely as Legal Title Trustee for LVS Title Trust I on which there remains owing a
principal balance of $448.188.34 with interest thereon.
2. We are no longer in physical possession of the premise and that we have fully vacated
and surrendered said premises. We have left the premises free and clear of all personal
belongings.
3, Said premises are also subject to the following judgments which are against your
deponents:

4. The attention of your deponents has been called to the following judgments which are
not against your deponents, or either of them, but are against some person or persons of the
same or similar name:

5. Your deponents, and neither one of them, is or are insolvent, and their insolvency is not
imminent.
6. None of the deponents listed herein are members of the United States Military or any branch
therefore, whatsoever. Notwithstanding the aforementioned, if any or all of the undersigned
deponents are or have been a member of the United States Military. Your deponents waive any
and all rights he or she may have under the service members Civil Relief Act, 50 U.S.C App
501 et. Seq (The `SCRA'). Moreover, your deponents, and each of them, make such waiver
knowing the full extent of any and all rights under the SCRA witch may or may not apply, and
having had the opportunity to consult with outside counsel, assistance from the office of the
judge advocate general, and/or military one source.
7. Your deponents are about to execute a conveyance of the said premises known as Hedge
Street Lot 9, Fishers Isl, New York 06390, to U.S. Bank National Association not in its
individual capacity, but solely as Legal Title Trustee for LVS Title Trust I. Said conveyance is
being given and accepted in lieu of a foreclosure of the aforesaid mortgage held by U.S. Bank
National Association not in its individual capacity, but solely as Legal Title Trustee for LVS
'T'itle Trust I, with the understanding that U.S. Bank National Association not in its individual
capacity, but solely as Legal Title Trustee for LVS Title Trust I is accepting said deed subject to
the aforesaid mortgage held by U.S. Bank National Association not in its individual capacity,
but solely as Legal Title Trustee for LVS Title Trust I.
8. There are no judgments against your deponents or either of them in any Court of this State or
of any other State or any Court of the United States of America, excepting only judgments, if
any, which are set forth above. Your deponents are the owners in fee of said premises, and are
in possession thereof. As far as either one of your deponents knows, no person has made any
claim against said premises or the possession of your deponents, nor is anybody disputing the
title and possession of your deponents.
9. In the opinion of your deponents, said premises have no value over and above the amounts of
the mortgages held by U.S. Bank National Association not in its individual capacity, but solely
as Legal Title Trustee for LVS Title Trust I and said judgments, if any, noted above.
10. The deed being given by your deponents to U.S. Bank National Association not in its
individual capacity, but solely as Legal Title Trustee for LVS Title Trust I is, and is intended to
be, an absolute conveyance. There is no agreement for U.S. Bank National Association not in
its individual capacity, but solely as Legal Title Trustee for LVS Title Trust I to reconvey said
premises to your deponents or either of them under any circumstances whatsoever.
11. This affidavit is made to induce any title company to issue policies of title insurance
affecting said premises.
12. Your deponents agree to hold harmless and indemnify the aforesaid grantee, U.S. Bank
National Association not in its individual capacity, but solely as Legal Title Trustee for LVS
`T'itle Trust 1, against any and all expenses, including attorneys' fees, damages, judgments, fines
and amounts paid in settlement and any other amounts that grantee becomes legally obligated to
pay because of any claim or claims made against or by me in connection with any threatened,
a
pending or completed action, suit or proceeding, to which grantee is, was or at any time
becomes a party, or is threatened to be made a party, pursuant to the subject property and deed.
