BOARD OF SOUTHOLD TOWN TRUSTEES
Meeting of December 6, 1976
A regular meeting of the Board of Southold Town Trustees was held
at 7:30 P.M., Monday, December -~6, 1976 at the town board meeting
room, Supervisor's Office, 16 South Street, Greenport, New York,
with the following present:
Absent: George Bird
Alvah B. Goldsmith, Chairman
Douglas M. Robertson
Philip G. Horton
Joseph Hataier
Betty Neville, Secretary
Also present: Orville Terry & Paul Stoutenburgh-North Fork
Environmental Council.
On motion of Mr. Horton, seconded by Mr. Robertson, it was
RESOLVED that w~w~a Pond Association, Nassau Point, Cutchogue,
~c~Y. be GRANTED permission for maintenance dred~in~ to restore
annel at Wunneweta Pond. Cutcho~ue. N.Y_. all in accordance
with the de~ailed specifications as presented in the originating
application. Fee $5.00. Spoil to be placed on upland property
at northerly end of the channel.

.dock at Little Creek, directly in front of her property at
West Creek Avenue~ Cutchogue, N.Y., all in accordance with
~he detailed specifications as presented in the originating
application, subject to obtaining wetlands permit from the
Southold Town Board, and permit from the New York State
Department of Environmental Conservation (if required.)

Mr. Warren Hardy and a number of other property owners who
live on or near Wunneweta Pond, Nassau Point, Cutchogue
appeared before the Board to protest the application of
George Quigley for offshore mooring at Wunneweta Pond,
Cutchogue. Mr. Hardy submitted a statement of protest for
the files. He stated that this mooring has been there since
gust. It swings back and forth into Mr. Kohns' bulkhead
d into the channel which is only 10-12 feet in width. He
also stated that the R.OoW. over which Mr. Quigley is gaining
access to the mooring is to be used only for embarking and
discharging passengers, as specifically stated in their deeds.
Mr. Hardy stated that there are other moorings at Horseshoe
Cove which would be safer and more convenient. He does not
think that the owners realize that they are in a very hazardous
area.
On motion of Mr. Horton, seconded by by Hataier, it was
RESOLveD that ~eorge Quigle¥, 4505 Vanston Road, Cutchogue,
N.Y. be_DENIED permission to place o~hore mooring at
Wu~neweta Pon~, Cutchogue, N.Y. There is no room for any
~ooring in this channel becuase of the very restrictive width
and depth of the channel. Any mooring would be considered an
obstruction to navigation. This mooring must be removed.
Fee paid $5.00

to construct turn-around at Sleepy Hollow Lane as approved by
the Southold Town Planning Board and filed in the Suffolk
p. 236
County Clerk's Office.
Although this matter does not come under our jurisdiction, we
feel that a wetland should not be filled for a turn-around on
a road. Howeverv the damage is done and it cannot be corrected.
The fault is not with the owner of the property~ but it is with
the boards who issued the approval for this.
We feel that there has been an error on the pa~t of the Town;
having approved a plan which permits the highway and turn-
around ko cover a wetland area. The same effect could have
been established by having the turn-around stop at the edge
of the meadow rather than proceed to the hig~water mark.

It was ~ported that William Johnston, Fishermans Beach, Cutchogue
is moving the main house but he has an O.K. to leave the guest house.
/~e got approval from the Board of Appeals to do this. The Trustees
question this and feel that the guest house should be moved back
alsoo They feel that this is all on filled land~ which is ~wn
property and if this is so~ then it shomld be moved back.

RESOLVED that the minutes of the Board of Southold Town Trustees
dated November lv 1976~ be approved as submitted.
