THIS INDENTURE, made the 3rd day of December, Two Thousand Thirteen
BETWEEN
MARK P. GAYNOR and ANN MARIE GAYNOR, husband and wife, residing at 1905 Marlene
Lane, Matti tuck, New York 11952
party of the first part, and
ALEXANDER E. REGRUTO and DORIS E. REGRUTO, husband and wife, residing at 21
Harriet Drive, Syosset, New York 11791
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being near Mattituck, Southold Town, County of Suffolk, and State of
New York, more particularly described as follows (Lot 61 and '/z 62):
BEGINNING at a point on the easterly line of Marlene Lane, 673.03 feet northerly along said
easterly line from a concrete monument set on the northerly line of Peconic Bay Boulevard; and
running along said easterly line of Marlene Lane North 20 degrees 39 minutes 10 seconds West,
100.0 feet to land of James Corrigan and wife;
THENCE along the last described land, being at right angles to said easterly line of Marlene
Lane, North 69 degrees 20 minutes 50 seconds East, 150.32 feet to the east line of land now or
formerly of Abitz;
THENCE along east line of land now or formerly of Abitz two courses as follows:
1. South 19 degrees 33 minutes 50 seconds East, 72.41 feet to a concrete monument; thence
2. South 19 degrees 11 minutes 10 seconds East, 27.62 feet;
THENCE along other land now or formerly of said Abitz on a line at right angles to said easterly
line of Marlene Lane, South 69 degrees 20 minutes 50 seconds West, 148.23 feet to the point of
BEGINNING.
TOGETHER with an easement for passage between Peconic Bay Boulevard and Peconic Bay
over a certain 10 foot right of way, in common with all others now having such right of way and
those to whom hereafter such right of way and easement may be granted, which right of way is
more particularly described as follows:
ALL that parcel of land situate near Mattituck, Southold Town, Suffolk County, New York,
bounded and described as follows: The easterly line of subject 10 foot right of way is described
as follows:
BEGINNING at a point on the southerly line of Peconic Bay Boulevard, 200.20 feet westerly
along said line from the northeasterly corner of land of Haggerty Estate;
RUNNING THENCE along said land of Haggerty Estate on a line parallel to the easterly line of
said Haggerty Estate and 200.0 feet westerly therefrom, South 20 degrees 23 minutes 00 seconds
East 500 feet, more or less, to ordinary high water mark of Great Peconic Bay; the westerly line
of said 10 foot right of way is parallel to and 10.0 feet westerly from the easterly line herein
described, and runs from Peconic Bay Boulevard to Great Peconic Bay.
Said easement is subject to the following covenants and conditions:
1. Said easement is for foot travel only.
2. It shall not be obstructed in any way and the maintenance thereof shall be the joint
responsibility of all those having a right to use said right of way for the.time being.
3. Said easement shall be perpetual and shall run with the land but no easement or rights in
said right of way shall vest in the general public. It shall be a private right of way.
TOGETHER with an undivided 4/246ths interest in the park near the premises, more particularly
described in "Park Dedication Deed from William F. Abitz and Edward G. Abitz" recorded in
Liber 3842 of Deeds at Page 220, subject to the limitations, covenants and restrictions as set forth
in said deed.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated June 10, 1986, and recorded June 16, 1987, in the Office of the Suffolk County Clerk
in Liber 10059, Page 223.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.

first above written.
