Y THIS INDENTURE, made the 29th day of October, nineteen hundred and ninety-six BETWEEN JOAN TYRER, as surviving tenant by the entirety of CLIVE TYRER, deceased 8/10/92, #1917P1992 party of the first part, and FREDERICK E. HYATT, IV and LYNN A. HYATT, husband and wife, both residing at 60015 Main Road, Southold, New York, 11971 party of the second part, WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL THAT CERTAIN PLOT, piece or parcel of land, situate, lying and being at Pine Neck, in the Town of Southold, county of Suffolk and State of New York, more particularly bounded and described as follows: BEGINNING at a point on the northerly line of a 50 foot right of way at the northwesterly corner of the section thereof about to be described, said point or place of beginning being located the following courses and distances from the corner formed by the intersection of the easterly side of Oaklawn Avenue with the northerly side of Pine Neck Road; 1) Northerly along the easterly side of Oaklawn Avenue, North 10 degrees 58 minutes 20 seconds East 283.40 feet to the northerly side of said 50 foot right of way; THENCE along the northerly side of said 50 foot right of way and the southerly side of land now or formerly of Macina and along the southerly side of land now or formerly of Ressy the following two courses and distances: a) North 83 degrees 34 minutes 40 seconds East 97.37 feet; b) North 74 degrees 15 minutes 00 seconds East 60.97 feet to the true point or place of beginning; RUNNING THENCE from said point of beginning along the northerly side of said 50 foot right of way North 74 degrees 15 minutes 00 seconds East 116.56 feet; RUNNING THENCE �outh 7 degrees 17 minutes 30 seconds West a distance of 179.29 feet; RUNNING THENCE South 83 degrees 34 minutes 40 seconds East 86.68 feet; THENCE North 1 degree 12 minutes 10 seconds West 155.97 feet to the point or place of BEGINNING. TOGETHER with a right of way from the premises over the existing rights of way to Oaklawn Avenue, Pine Neck Road, and to Jockey Creek, as described in deed recorded in Liber 3026 page 131, and also shown on survey by Roderick Van Tuyl made for Joan and Clive Tyrer dated December 26, 1985. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated December 24, 1985 which deed has been recorded in the Office of the Clerk of the County of Suffolk on February 7, 1986 in Liber 9975 page 55. TOGETHER with all fight, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof, TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
