Located: 3825 Stillwater Avenue, Cutchogue. SCTM# 137-1-3.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the LWRP and listed policy standards provided below. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. The dock structure will extend into Public water and result in a net decrease in public access to/on public underwater lands The applicant eniovs access to public water via an existing permitted dock structure. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. LWRP Consistency Assessment Form By way of this letter we request an amendment to the previously approved application submission. The proposed scope of work has been modified based on the request of the NYSDEC (permit enclosed) and revised plans included for your review. The new scope of work is as follows: The proposed project includes the installation of a 97' long x 4' wide fixed pier, 12' long x 3' wide aluminum ramp & 20' long x 6' wide floating dock in the same location as the original which have been lost during storms. The proposed fixed pier will have Thru-Flow grating above the limits of wetlands and the remainder will have un-treated decking. The proposed scope of work was revised per comments by the NYSDEC and their requirement to meet the minimum water depth of 30" at mean low water. This was accomplished by rotating the floating dock 90 degrees and extending the pier 21: These revisions to the layout extend the seaward edge of the float a mere W further into the water body but allow for the minimum water depth. A permit (1446) was issued in 1980 for a dock structure with a catwalk length of 36': a 12' ramp and 10.4 x 8 float. The current proposal does not conform to the permitted catwalk/dock dimensions. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
