Telephone: 631 73136 Fax: 765 COU LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Jim King, President Town of Southold Board of Trustees From: Mark Terry, Principal Planner LWRP Coordinator Date: November 7, 2013 Re: Proposed Wetland Permit and Coastal Erosion Permit for JOHN & ELVIRA ALOIA SCTM#1000-118-4-9 A past Wetland Permit (5399) was issued in 1991 for the 16'x24' deck. A Wetlands Permit (4484) was also issued for the bulkhead and stairs in 1995. No permit was found for the slate patio and it was not shown on the 1991 survey. En-Consultants on behalf of JOHN & ELVIRA ALOIA requests a Wetland Permit to construct approximately 99 linear feet of vinyl bulkhead in-place of existing timber bulkhead; backfill with approximately 15 cubic yards clean sand filf''to be trucked in from an approved upland source; remove and replace existing +/-16'x24' on-grade wood deck and +/-13'x20' on-grade masonry patio, both adjacent to bulkhead; remove and replace steps at bottom of existing stairway down embankment; and remove and reattach existing +/-3'x7' steps to beach to new bulkhead. Located: 8145 Nassau Point Road, Cutchogue. SCTM# 118-4-9 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposal to is CONSISTENT with the LWRP. Further, it is my recommendation that the proposed actions to remove and replace existing +/-16'x24' on-grade wood deck and +/-13'x20' on-grade masonry patio, both adjacent to bulkhead are INCONSISTENT with the blow listed policies and therefore, INCONSISTENT with the LWRP. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. The following management measures to minimize losses of human life and structures from flooding and erosion hazards are suggested., A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. The majority of the portion and the patio and deck are located in the FEMA flood zone VE (Coastal flood with velocity hazard (wave action); base flood elevations determined) and does not meet this policy. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The above slate patio was constructed without Board of Trustees review or permit. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessm ent is intended to supplem ent other inform ation used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listine both supporting and non- supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and conditions, it shall not be undertaken. Not Applicable The project seeks to replace an existing timber bulkhead damaged during Hurricane Sandy with a vinyl bulkhead in the same location to maintain the property's historical method of shoreline stabilization and protection for the upland property against erosion and flooding. The existing shoreline has been improved with and supported and protected from flooding and erosion by a bulkhead since prior to 1977, and there is no viable non-structural alternative means of maintaining and protecting the upland portion of the property in its current location. Without replacement and maintenance of the bulkhead, the adjacent upland properties would be exposed to severe erosion, flooding, and damage to the residential structures located thereon. Therefore the project is consistent with Policy 4. i Attach additional sheets if necessary Policy 5. Protect and improve water quality and supply in the Town of Southold. Not Applicable Other than the ecological benefits of replacing a treated timber bulkhead with untreated vinyl sheathing, and maintaining the naturally vegetated embankment behind it, the project will effectively maintain the historically preexisting conditions along this portion of bulkheaded shoreline without any change in or significant adverse impact on the adjacent unvegetated wetland area or tidal waters of the Town.
