Located: 1130 Little Peconic Bay Road, Cutchogue. SCTM# 111-14-17 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions are CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. All a p p l i c a n t s f o r p e r m i t s ' i n c l u d i n g T o w n o f S o u t h o l d a g e n c i e s , s h a l l c o m p l e t e t h i s C C A F for proposed actions that are subject to the Town of Southold W aterfront Consistency Review Law. This assessm ent is intended to supplem ent other inform ation used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town). If any question in Section C on this form is answered "yes" or "no", then the proposed action will affect the achievement of the LWRP policy standards and conditions contained in the consistency review law. Thus, each answer must be explained in detail, listin¢ both sul)portine and non- supportin¢ facts. Not Applicable In association with the removal of the existing dwelling and construction of the proposed dwelling, a drainage system of leaders, gutters, and drywells will be installed to collect roof runoff. By also reducing lawn areas and increasing the setback of lawn areas from wetlands by establishing a 10' wide, approximately 950 square-foot nonturf buffer adjacent to the tidal wetlands boundary, which can serve both as a sink and filter for stormwater runoff and contaminants, the quantity of runoff reaching the adjacent tidal waters will be decreased and the quality of runoff will be improved through a reduced concentration of potential fertilizers, pesticides, and insecticides. Site runoff will also be mitigated through the replacement of the existing asphalt driveway with a gravel driveway. Nance 1130 Little Peconic Bay Road Cutchogue, NY SCTM #1000-111-14-17 Policy 6 The proposed dwelling, which will be located entirely in a FEMA designated Zone X, will be situated in roughly the same location as the existing dwelling and no closer to the tidal wetlands associated with Wunneweta Pond. Lot coverage as a result of the redevelopment will only increase by approximately 302 square feet, or by 2.7 percent, and the wetlands setback of the new dwelling will remain aligned with the neighboring dwellings, consistent with§275-11(3). Mitigation measures are also included in the project design to offset any potential impacts of the proposed construction activities and to improve upon existing site conditions to create a net environmental benefit upon project completion. Specifically, as described in Policy 5 above, a drainage system of leaders, gutters, and drywells will be installed to collect roof runoff, and a 10' wide, approximately 950 square-foot nonturf buffer will be established adjacent to the tidal wetlands boundary, which can serve both as a sink and filter for stormwater runoff and contaminants. By thus reducing lawn areas and increasing the setback of lawn areas from wetlands, the quantity of runoff reaching the adjacent tidal waters will be decreased, and the quality of runoff will be improved through a reduced concentration of potential fertilizers, pesticides, and insecticides, thereby providing a net benefit to surface water quality. Additionally, groundwater and ultimately surface water quality will benefit from the replacement of the existing, nonconforming sanitary system with a new, Suffolk County Department of Health Services-conforming sanitary system located outside Chapter 275 jurisdiction and as far from Wunneweta Pond as possible. Therefore, the project will be consistent with Policy 6. Policy 10. Protect Southold's water-dependent uses and promote siting of new water-dependent uses in suitable locations.
