Moore, Esq. on behalf of KRISTOPHER PILLES & NICOLE OGE requests a Wetland Permit for the existing 18'x2.5' and 6'x20' fixed "L" shaped dock; repair existing 6'x30' and 20'x14' wood walkway; and replace existing pile located to the east. Located: 560 Fisherman's Beach Road, Cutchogue. SCTM# 111-1-16 It is my recommendation that the proposal is INCONSISTENT with LWRP Policies 6.3 (below) and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction (c) Regulations for the placement and configuration of docking facilities. Residential docks. (Amended 10-11-2005 by L. L. No. 17-20051 [al Only one catwalk may be permitted per residential lot. Only one mooring or dock may be permitted per residential lot. Upon a showing of special need due to low water level and hazard to property, the Trustees may permit both a mooring and a dock for the same residential property. [Amended 12-18-2007 by L. L. No. 23-2007] Two docks occupy the same parcel and therefore the proposed action does not comply with Chapter 275 Wetlands and Shorelines of the Southold Town Code. % v Map Traffic Figure 1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. j . 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. A proposed action will be evaluated as to its significant beneficial and adverse effects upon the coastal area (which includes all of Southold Town) I' 3.
