Main Rd. & Youngs Ave.) Southold, NY 11971 Telephone: 631 765-1938 O~~COU'~~ Fax: 631 765-3136 LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Jim King, President Town of Southold Board of Trustees From: Mark Terry, Principal Planner LWRP Coordinator Date: November 6, 2013 Re: LWRP Coastal Consistency Review for THOMAS & LINDA KELLY SCTM#1000-107-4-13 THOMAS & LINDA KELLY requests a Wetland Permit for construction of a 20'x40' with 12'x16' "L" extension in-ground pool; construct a 1,700sq.ft. pool patio; install 4' high pool fencing; construct a 10'x12' tool shed; construct a 700sq.ft. terrace seaward of existing covered porch; and re-vegetate previously cleared areas. Located: 4553 Wickham Avenue, Mattituck. SCTM# 1074-13 It is my recommendation that the proposed actions are INCONSISTENT with LWRP Policy 6.3 (below) and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The proposed 50' non-disturbance buffer is not the correct classification for the buffer since the area will be planted. It is recommended that the Board require that a landscaped buffer be applied. An example definition of the landscape buffer follows. LANDSCAPED BUFFER A land area of a certain length and width which is planted with indigenous, drought-tolerant vegetation similar to that found within the immediate proximity of the parcel. Vegetation shall be installed in sufficient densities to achieve 95% ground cover within two years of installation. Survival of planted vegetation shall be 90% for a period of three years. Maintenance activities within the buffer are limited to removing vegetation which is hazardous to life and property, trimming tree limbs up to a height of 15 feet to maintain viewsheds, replanting of vegetation and establishing a four-foot-wide access path constructed of pervious material for access to the water body. [Added 12-15-2009 by L.L. No. 15-2009] To further Policy 5, it is recommended that the Board require that a pool dewatering well be installed. Further it is recommended that the "tool shed" be located outside of the 100' minimum wetland setback distance. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
