WITNESSETH, that the party of the first part, in consideration of TEN DOLLARS ($10.00),
lawful money of the United States, paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever,
ALL that certain plot, piece or parcel of land, with the building and improvements thereon
erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New
York, being bounded and described as follows:

BEGINNING at a monument at the southeasterly terminus of the southwesterly line of Bayview
Avenue, from said point of beginning running along the southeasterly end of said Bayview
Avenue, North 52 degrees 30 minutes East 15.0 feet-,
THENCE along land of Magnuson, two courses:
(1) South 16 degrees 54 minutes East 42.64 feet; thence
(2) South 48 degrees 36 minutes West 156.0 feet to ordinary high water mark of
Arshamonoque Pond;
THENCE northwesterly along said high water mark on a tie line bearing North 31 degrees 35
minutes West, a distance of 25.66 feet to land now or formerly of W. Rudink;
THENCE along said land of Rudink, the following two courses and distances:
(1) North 52 degrees 30 minutes East 153.0 feet to the southwesterly line of Bayview
Avenue, if extended;

Avenue; from said point of beginning running along land of Rudink, two courses:
(1) South 37 degrees 30 minutes East 80.0 feet; thence
(2) North 52 degrees 30 minutes East 131.85 feet to land of Tillinghast Estate;
THENCE along said land two courses:
(I ) South 24 degrees 42 minutes 57 seconds East 224.20 feet; thence
(2) South 50 degrees 54 minutes 36 seconds West 200.22 feet to land of Byrne;
THENCE along said land of Byrne, North 24 degrees 42 minutes 57 seconds West 186.77

THENCE along said land of Magnusson, three courses:

(3) North 37 degrees 30 minutes West 91.0 feet to the southeasterly end of said Bayview
Avenue;
THENCE along said southeasterly end, North 52 degrees 30 minutes East 18.0 feet to the
point of BEGINNING.
Subject to an 18 foot right of way across the northwesterly 18 feet of the premises from said
Bayview Avenue to said land of Byrne.
BEING AND INTENDED TO BE the same premises conveyed to Jean Rudink by deed
dated June 17, 1998 recorded in the Suffolk County Clerk's Office on July 9, 1998 in Liber
11903 at Page 492.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part
in and to said premises,
TO HAVEAND TO HOLD the premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part, covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever, except
as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and
year first above written.
