residing at 9303 Slate Stone Court, Houston, Texas 77064
party of the first part,
Jana Rudink Ott and Gary L. Ott, her husband, residing at 9303 Slate Stone Court,
Houston, Texas 77064
party of the second part,
WITNESSETH, that the party of the first part, in consideration of TEN DOLLARS ($10.00),
lawful money of the United States, paid by the party of the second part, does hereby grant and
release unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever,
ALL that certain plot, piece or parcel of land, with the building and improvements thereon
erected, situate, lying and being at Arshamomaque, Town of Southold, County of Suffolk and
State of New York, being bounded and described as follows:
PARCEL 1:
BEGINNING at a concrete monument marking the Southwesterly terminus of the Northeasterly
line of Bayview Avenue and the Southwesterly corner of Lot 64 as shown on a certain map
entitled, "Map Showing Subdivision of Property known as Summerhaven, Belonging to William
G. Herx, near Southold, Suffolk County, New York", and filed in the Office of the Clerk of the
County of Suffolk on 7/5/33, as Map 1133, and running thence along the Southeasterly line of
said Lot 64, North 52 degrees 30 minutes East 150 feet to a concrete monument;
Thence South 24 degrees 42 minutes 57 seconds East 82.03 feet along land now or formerly
of Tillinghast Estate to an iron pipe;
Thence South 52 degrees 30 minutes West 131.85 feet to an iron pipe;
Thence North 37 degrees 30 minutes West 80 feet to a concrete monument and the point or
place of BEGINNING.
PARCEL II:
BEGINNING at a concrete monument marking the Southeasterly terminal of the Southwesterly
line of Bayview Avenue and the Southeasterly corner of Lot I as shown on said map, and running
thence South 37 degrees 30 minutes East, 25 feet to a point;
Thence South 52 degrees 30 minutes West 162 feet, more or less, to the ordinary high water
mark ofArshamomaque Pond;
Thence on a Northwesterly direction, 26 feet, more or less, to a point where the Southeasterly
line of a lot I, as shown on said map, intersects the ordinary high water mark of Arshamomaque
Pond;
Thence along the said Southeasterly line of said Lot I, North 52 degrees 30 minutes East,
160 feet, more or less, to a concrete monument and the point or place of BEGINNING.
TOGETHER with (1) an easement or right of way over premises lying between the above
described parcels for access to and from Bayview Avenue, and (2) all of the right, title and
interest, if any, of the party of the first part of, in and to lands under the waters ofArshamomaque
Pond.
BEING AND INTENDED TO BE the same premises conveyed to Jean Rudink by
correction deed dated October 29, 1992 recorded in the Suffolk County Clerk's Office on
November 10, 1992 in Liber 11570 at Page 218.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part
in and to said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part, covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever, except
as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and
year first above written.
