SCTM# 1000-52-2-20.1 This recommendation supplements the LWRP review submitted to the Board in 2008. DROUZAS REAL ESTATE DEVELOPMENT CORP. requests an Amendment to Wetland Permit #7891 to relocate the proposed dwelling to approximately 25' from the edge of wetlands; construct a slightly smaller two-story, single family dwelling; and to modify the location of proposed pea gravel driveway. Located: 54120 County Road 48, Southold. SCTM# 52-2-20.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with LWRP Policies 4.1 and therefore, INCONSISTENT with the LWRP. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards 3. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for. a. structures which functionally require a location on the coast or in coastal waters. b. water-dependent uses which cannot avoid exposure to hazards. C. sites in areas with extensive public investment, public infrastructure, or major public facilities. d. sites where relocation of an existing structure is not practical The proposed action does not meet the above criteria. The structure is located within the FEMA AO Flood Zone (Note that the map references AE el 10). The AO Flood Zone is subject to 100-year shallow flooding (usually sheet flow on sloping terrain) with average depth of 1-3 feet. Base flood elevation is undetermined. I approved, it is recommended that the structure be re-located to higher elevations (closer to C.R. 48) and increase the setback to the freshwater wetlands to further Policy 4.1 and Policy 6. The required front yard setback from C. R. 48 is 50'. The proposed front yard setback is 115.8' and there is the ability to relocate the structure increasing the setback to the wetland. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. SCTM#52-2-20.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The application is incomplete and therefore the Potential impacts from the proposed action cannot be adequately assessed at this time. The survey does not indicate all wetlands within a two hundred foot radius from the proposed action and is not in compliance with § 275-6 (S). Furthermore, durine a field visit to the site the location for the proposed action was not staked nor was the freshwater wetlands delineated (flaated) § 275-6 Application. A. Contents of application. A permit may be issued upon the written, verified application of the person proposing to perform operations on wetlands. Three copies of the complete application, including all written descriptions, pictures and surveys, shall be submitted to the Clerk. Such application shall contain the following information: [Amended 10-11-2005 by L.L. No. 17-2005] (8) Such application shall be accompanied by a survey and topographical map, created no more than one year prior to the date of application, with contours at two-foot intervals, showing all wetlands within a two-hundred-foot radius of the area from which the removal or in which the deposit of materials is proposed, or in which structures are to be erected, certified by a registered land surveyor or registered professional engineer, licensed by the State of New York Such survey and topographical map shall show the soundings of the area in which operations are proposed to be conducted. The horizontal control of said survey shall be based on an approved local coordinate system. The vertical control for elevations shall be based on the United States Coast and Geodetic Survey datum.
