SCTM#1000-122-4-15 &16 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed action is INCONSISTENT with the below listed LWRP policy and therefore INCONSISTENT with the LWRP: 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The Board of Trustees issued a Wetlands Permit (4324) in 1994 for a pool and deck. The "as built" structures do not comply with the plans on file (See Figure 1). Correspondingly, the wood walk over bulkhead shown on the as-built plans was not approved under the permit. In the event that the application is approved, it is recommended that the existing landscaping between the bulkhead and deck (Figure 2) be designated a landscaped buffer to further Policy 6.3. Protect and restore tidal and freshwater wetlands. It is recommended that the buffer extend for the entire length of the bulkhead. A sample definition for a Landscaped Buffer follows. LANDSCAPED BUFFER - A land area of a certain length and width which is planted with indigenous, drought-tolerant vegetation similar to that found within the immediate proximity of the parcel. Vegetation shall be installed in sufficient densities to achieve 95% ground cover within two years of installation. Survival of planted vegetation shall be 90% for a period of three years. Maintenance activities within the buffer are limited to removing vegetation which is hazardous to life and property, trimming tree limbs up to a height of 15 feet to maintain viewsheds, replanting of vegetation and establishing a four-foot-wide access path constructed of pervious material for access to the water body World United States - NY - SUfIblk Co. - Southold i f I G, t Figure 2. It is recommended that the installation of the de-watering drywell be verified.
