~- ~ MEETING OF JUNE 7~ 1971 The Southold Town Board of Town T~ustees met a~ the Town Clerk Office, Main Ro~d, Southold, New York, on Monday, June ~, 1971 at 3:30 P.M. with the followi~ present: ~ Alvah B. Goldsm~th~ Ch~ir~n, John,F. McNulty, Do~glaS'~bertson, Frank Dawson, George Si~ps0n,' and Judith Boken, Secretary. Hal~llday (2 stakes %260), ~643-W~lliam Powers; ~644-Genevieve Nau~!es Robinso.n_(8 stakes~,~261)~ Leffer%s Edson, Esq. appeared before the Board to reques~ a quit claim on a portion of property owned by Mr. Horace J. Williams on a private road '("Home'P~ke"},(Map 6f Point Pl&asank, Lots 8~ 9, 10, part of 11) Mattituck, New York, bounded northeasterly by Mattituc~ Creek. The area in q~estion is a portion along the shore where the high water mark has c~anged since a 1920 survey, du~ to dredging by the County of Suff~lk~ The property owners consented at {he time of the~dr~dging to the fill being placed on their property° It is~now necessary/for the Town to'quit Qlai~ this waterfront strip of property so that Mr. Williams will hav~ a clear title. Mrl Edson submitted a quit claim d~ed and the necessarY'surveys and a. $1.00 fee. On motion of Mr~ McNulty, seconded by Mr. Simpson, it was RESOLVED: That a quit claim deed by gra~ted Mr. Horace J. Williams and Hazel A. Williams, Westphaii~ Road, Mat~i'~'uck, New York, covering: All of the land filled area to the ordinary~high water mark thereof lying_on the bed of Mattituck Creek lying in front ok and contiguous with alI those certain lots at Mattituck, Town of Southold, Suffolk County~ New York, numbered 8, 9~ 10~.and the northwesterly half of 11~ as shown On "Map Of Point Pleasant, dated April, 1916,,Franklin V. Ov~rton, surv~yor"~and filed in the sdffolk c0u~ty Cler~,s office as Map No. 720, andn6rthWesterl~ and~the southeasterly lines or_the said land filled area being the extension northeasterly of the north- westerly line of Lot No. 8 and of the center line of ~ot No. 11 on said Map. A letter was reeeived~from Albert A. sacco, Hill Road, Southold, withdrawing ~is ~PPliCation for permission to bulkhead and dredge~ in Jockey Creek. Mr. Harold L. Smith, Secretary of the GooSe. Bay Civic Association, Inc. appeared before the Board to answer questions regarding an application he su~mit~e~ fOr permission to dredge and build a dock at the~.end of Pine ~Venue, Goose Bay Estates, Southold, New York. Mr. Smith stated that the dredging is being done to restore portion of a channel to 90 condition existing after dredging done in 1967 pursuant to a Town Trustees permit No. 429.' The present work was made necessary by accumulation of vast amounts of sand washed into channel by surface water from Pine Avenue and storm erosion of the beach. The dock was buil~ in 1957 and removed b~ the Goose Bay Civic ~ssoCiation this'spring in connection' with th~ dredgihg'Work and they wish permission to restore the dock and ramp to its original position ~(d°ck Permit ~466, April 1,~1968.).~ On motion of Mr. Robertson, seconded by Mr. Dawson, it was REsoLVED~-That permission ~o dr~dge in Goose Creek ~t th~ en~of Pihe Avenue (private ro~d) Goos~Bay E~tates, SoUth01a, New York, placihg fill~on the be~ch,~ res{bre channel du~ under Permit ~429, September 11, 1967~ Si~e of the~ area to ~e dredged is 7~ to'-100 ft. in length by 20 to 25 ft. in width. ~o fee required for maintenance dredging. ~ Vote of the Board: Ayes: Mr~ Goldsmith, Mr. ~Nul~y, Mr. ~bertson, Mr. D~wson, Mr.~Simpson~ On motion Of Mr~ MCNulty~ ~econded~by Mrl~SimPson, it was RESOLVED: That Goose Bay Ci~ic AsSgciatiOn Inc. be grahted permission to restore a dock and_ramp at the~end of Pine Avenue (priVate road), Goose Bay Estates, SOuthold, New Yor~, removed in connection with dredging work and Originally granted bY. permit 9466, A~ril 1, 1968. Size of the dock is twO 8 ft. by 10 ft. platforms. This permit is granted all in aceordance with appli- cation submitted. No fee required for this restoration work. Mr. Patrick Carrig appeared before the Board to answer questions relative to three-~applications submitted to the ToW~ TrUstees for bulkheads: ApplicatiOn of Ca____rl Hockemeye_9~ BayView Aven~e, ~ Sout~old, New York on Mill creek;'Application of~Yolanda G~attan Bay~i~ew,Avenue, Southold, New York on Mill creek~ APplication Of Yol n a ~ b ' Deep Hole Drive, Mattituck, N~W York ~nDeep HOle Creek. The Trustees advised Mr. Carrig they would'inSpect the properties and would like him to submit a deed and survey Of the property in question to verify the distance from the existing roads to the proposed bulkheads. Mr. Sdward R. ~ 1925 Bay Avenue, MattitUck, New Y6r~ appeared before the Town Trustees to submit additional information in support of his application to build a bulkhead on hiS property at James Creek. Mr. Burke submitted letters from~his adjoining property owners, Mr. Edward Yanke and the Mattituck Park Distr~ict, both showing no objection to the proposed bulkhead. He also .submitted a survey map of the property. The b%lkhead is to be approximately 100 ft. along the ordinary high water ~ark on James Creek. The Board wil~ inspectrthe site~ A copy Of ~ lette~ Was received from the Southold Town Planning Board to RuSSell Cas~, dutch0gue, New York relative t6 the fact Mr. Case is deepening the gutter at his property in Cutchogue~in 'order to obtain material to'raise the level of the~eadow in order to be above the high tide at the Cedars Golf Course.~ They questioned the dredging of a canal across the front of Mr. Case's property and state that as long as~ he m~intai~s ~the pr°perty~as a'-golf~cour. ._~e~ ~n ~"A~ ~esidential and ~Agri~u~tural. District~the~e~ would he-no problem.'/ However, if,he plans to)subdivide the-land, canals are Prohib~te~:~nde~"The Rules and Regutati0fls for the Subdivision of Land" without a specific permit from the Planning Board. The Trustees inspected this property, in~September 1970 a~d~it was the decision of the Board that inasmuch as the land in qUestion was6Wned ~y the a~pliCant' and the wor~ w~uld be done~on hi~r°perty and'has no bearifig on Town Waters, the'Trustees would waive Objection in th~s ~atter%and there wo~ld be ~o formai-permi~ required. ~ On motion of Mr. Dawson, seconded by Mr. Simpson~ it was~ RESOLVED: That th~ minutes of the meeting of May 3! 1971 be approved a~ read~ .....
