(631) 765-1809 • Fax (631) 765-9064 ~ Southold Town Clerk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF FEBRUARY 20, 2014 ZBA FILE 6720 NAME OF APPLICANT: Christopher Pavone PROPERTY LOCATION: 560 Village Lane, Orient, NY SCTM 1000-25-1-11 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated January 31, 2014 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The applicant's property is a non-conforming 12, 569.20 sq. ft. parcel in the R-40 zone. The northerly lot line measures 124.84 feet along a residential parcel. The Easterly lot line measures 101.10 feet along Village Lane. The southerly lot line measures 125.17 feet along another parcel, and the westerly lot line measures 100 feet along two other parcels. The property is improved with a single family dwelling and detached garage, as shown on the survey drawn by Joseph A. Ingegno, Land Surveyor, dated Sept. 16, 2004, and with proposed new construction and setbacks shown on the site plan prepared by Fairweather Design Associates, Inc., dated Oct. 22, 2013. BASIS OF APPLICATION: Request for Variance from Article XXIII Section 280-124B and the Building Inspector's November 15, 2013 Notice of Disapproval based on an application for building permit for partial demolition, additions and alterations to existing single family dwelling, at; 1) more than the code permitted lot coverage of 20%. RELIEF REQUESTED: The applicant requests a variance to partially demolish and construct additions and alterations with proposed 23.4% lot coverage, where 20% maximum lot coverage is permitted by Code. ADDITIONAL INFORMATION: The applicant's construction plan includes an actual reduction of total lot coverage from existing 23.5% to a proposed 23.4%. The applicant submitted information showing other lot coverage variances in the neighborhood. Page 2 of 3 - February 20, 2014 ZBAN6720 - Pavone SCTMN 1000-25-1-1 l FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 6, 2014, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(H. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The long-established neighborhood contains many non- conforming structures on non-conforming sized parcels. The applicant's single family dwelling, and many other dwellings in the area were built before zoning was established, and these nonconforming structures are characteristic of the neighborhood. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant or cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant seeks to rebuild a deteriorated portion of the dwelling, and the existing (23.5%) lot coverage exceeds that allowed by Code. Although the proposed (23.4%) new total lot coverage will be slightly reduced, a variance for excessive lot coverage is necessary in order for the applicant to proceed with the renovations. 3. Town Law 4267-b(3)(b)(3). The variance granted herein for 23.4% lot coverage is mathematically substantial, representing 17% relief from the code. However, the variance is mitigated by the fact that the proposed total lot coverage will be slightly reduced from the existing 23.5% lot coverage, and also by the fact that the parcel is small. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law &267-b(3)(b)(Q. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of new additions and alterations, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Horning, seconded by Member Weisman (Chairperson), and duly carried, to GRANT, the variance as applied for, and shown on the site plan prepared by Fairweather Design Associates, Inc., dated Oct. 22, 2013. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The addition being requested, is similar in size and location to the series of existing, poorly built add-ons that we propose to remove. The work is in the back yard and not visible from the street. All the required setbacks are easily surpassed. (We are asking to replace approximately 854 square feet of structures with 836 square feet of single story new construction) 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The proposed addition is .1% less than the existing, substandard structures that are to be removed. To keep it below the 20% lot coverage would mean a loss of 430 square feet of existing lot coverage/living space or half of the living space requested. Had the existing structures been structurally sound they might have been able to be renovated. The space is needed to comfortably house a young family in a safer environment. 3. The amount of relief requested is not substantial because: it is to replace lot coverage that had long existed prior to the current owners purchase in 2004 with a deck addition having been allowed to previous owners in 1990. These old structures to be replaced were built on ballast stones from colonial times and may have pre-existed the street fagade of the home. 4. There were two which with Vicki's help I can provide. Both were issued to Richard Boardman for the property at 690 Village Lane. Which is a smaller piece of property 2 homes down. #4472 May 7, 1997 #4614 October 15, 1998 Both findings note that "this neighborhood is densely built on small lots, with relatively high lot coverage" as shown in the attached SC GIS map that contains Village Lane. As we discussed at the hearing: • the existing lot coverage is non-conforming at approximately 23.5 % and we wish to replace this with new Rooms that bring it back to a lot coverage of approximately a 23.4% total lot coverage. • The area of the home we wish to replace is at the rear, not in view of the road and is well set-back from all property lines as required by code. The lot coverage problems seem to have arisen by the approved additions made by the previous owners as follows: 1. by of a new 2car garage in 1972 as per permit #6203 written 10/27 72 with attached CO written3/14/73 2. and an addition of a deck- permit # 19297Z dated 8/6/1990 with attached CO dated 9/11/90 All of the existing structures have been given a pre-CO dated 10/08/04 - prior to the McIintosh/Pavone purchase. And were granted to the Dormans without having required a variance. We are not seeking to increase the current lot coverage, and decreasing the home's living space by the 3.4% overage to meet code would result in a hardship of lost living space nearly the size of the garage that had previously been allowed.
