SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated January 8, 2014 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated January 30, 2014. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is EXEMPT from Coastal Consistency Review PROPERTY FACTS/DESCRIPTION: Subject parcel is a non-conforming waterfront lot containing 19,383.30 sq. ft. located in the R40 zone district. It is improved with a 2 '/2 story dwelling with attached porches and accessory garage. It has 71.57 feet of frontage on Fourth Street, 173.92 feet on Great Peconic Bay, 154.60 feet along the west property line and 126.92 feet on the north property line as shown on the survey prepared by Nathan Taft Corwin, III, land Surveyor dated June 7, 2001 last revised September 4, 2013. BASIS OF APPLICATION: Request for Variance from Article XXIII Section 280-124 and the Building Inspector's November 18, 2013 Notice of Disapproval based on an application for building permit to demolish and rebuild a porch addition to existing single family dwelling: 1) less than the code required minimum rear yard setback of 35 feet. RELIEF REQUESTED: The applicant requests a variance to reconstruct and enlarge to an 8 foot depth, a first and second story porch having a 2.7 foot rear yard setback where the code requires 35 feet. ADDITIONAL INFORMATION: The adjoining property owner to the west supports the application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: Page 2 of 3—February 20,2014 ZBA#6717—Gilchrist-Mancino SCTM#1000-117-10-15 The Zoning Board of Appeals held a public hearing on this application on February 6, 2014, at which time written and oral evidence were presented. Based upon all testimony,documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed reconstruction and enlargement of 106+/- square feet of the existing porches will maintain the style and character of the existing dwelling and the neighborhood. There is no evidence that the existing porches are a detriment to the subject rear yard adjoining property, therefore the proposed reconstruction with enlargement of 106 square feet should not be a detriment at the proposed location. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The pre-existing non-conforming dwelling exists in a similar non-conforming rear yard location and the subject pre-existing porches, in their location, are a functional and characteristic element to this pre-existing dwelling. To relocate their reconstruction to a code conforming location would greatly diminish their functionality and change the characteristics of the dwelling. 3. Town Law &267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 92%relief from the code. However, the porches pre-exist in their non conforming location for more than 100 years without any evidence of causing a detriment to nearby properties or the environment. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law&267-b(3)(b)(Q. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 6267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of reconstructing the first and second story porches with an 8 foot depth, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Dames, and duly carried,to GRANT, the variance as applied for, and shown on the Survey / Site Plan prepared by Nathan Taft Corwin III, L.S., dated June 7, 2001, last revised September 4, 2013 and the Architectural Drawing sheet#1,prepared by MCH Design dated July 27, 2013 and stamped by James J. Deerkoski, P.E. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Appeal involved a request for a variance from Southold Town Code Article XXIII Section 280-124 arising out of the Building Inspector's notice of disapproval of an application for a building permit to demolish and rebuild a porch based upon non-conformance with rear yard setbacks. The Board granted the variance application and a building permit was issued. Construction of the porch thereafter commenced. It has now come to our client's attention that the construction of the porch was not in accordance with plans and specifications and applicable code requirements, although it was, however, installed in the proper location. The defects include, but are not limited to improper footing depth and size, improperly specified load bearing members, and improper construction means and methods. These defects require reconstruction of the porch and the footings in the same location. None of the reconstruction will change the degree of non-conformity, as the dimensions and location of the project will remain unchanged. A copy of the approved site plan is attached for your convenience. Footings will be installed per the original plan and load bearing members will be specified to exterior, not interior standards. All other existing construction defects will be cured on reconstruction. The matter is currently before the Trustees and we anticipate approval at the June, 2017 meeting for the reasons set forth above. We write to you at the direction of the Building Department and ask that you issue to the Building Department a letter approving this action as "de minimis".
