Notice of Public Hearing to Consider Amending Town Code
Section 330-55 To Establish Lot Coverage Percentages and
Accessory Structure Setbacks on Lots within the Old Filed
Map Overlay District
RESOLVED, that the Town Board of the Town of Southampton hereby directs that a public
hearing shall be held on March 25, 2014, at 6:00 p.m., at Southampton Town Hall, 116
Hampton Road, Southampton, New York, to hear any and all persons either for or against a
local law entitled: "A LOCAL LAW to consider amending Town Code Section 330-55 to
establish lot coverage percentages and accessory structure setbacks on lots within the Old
Filed Map Overlay District," which provides as follows:
LOCAL LAW NO. OF 2014
A LOCAL LAW amending Town Code Section 330-55 to establish lot coverage percentages
and accessory structure setbacks on lots within the Old Filed Map Overlay District.
BE IT ENACTED by the Town Board of the Town of Southampton as follows:
SECTION 1. Legislative Intent.
In 1986, the Town Board adopted Town Code §330-115 (Continuance) to provide owners of
non-conforming lots some relief from the larger setback requirements of the new zoning for
their principal dwellings without the cost or burden of applying for a variance. This section
was subsequently amended to provide relief for both lot coverage and accessory structure
setbacks. While Town Code §330-55 B was enacted to provide undersized lots located in the
Town's Old Filed Map Overlay District with relief for their front, rear, and side yard setbacks
this provision was not amended to address lot coverage or accessory structures on the
properties. This amendment proposes to offer relief for lot coverage and establish accessory
structure setbacks for parcels located in the Old Filed Map Overlay District.
SECTION 2. Amendment.
Town Code §330-55B is hereby amended by adding the underlined words as follows:
§330-55. Transfer of development rights procedure
B. Notwithstanding any other provisions to the contrary, the minimum required yard
dimensions applicable to a one-family dwelling in the Old Filed Map Overlay District
shall be as follows:
(1) The front and rear yard dimensions shall each be 0.3 of the actual lot depth;
however where 25% of the actual lot depth along the block frontage within
200 feet of the proposed lot on the same side of the street are of a lesser
actual depth, the front and rear yards of the proposed lot shall be computed
on the basis of the average actual depths of those lots, provided that no such
front or rear yard shall be less than 30 feet nor more than that required in the
applicable standard district/

(2) The total dimensions of both side yards for the principal building/dwelling
shall be 0.4 of the actual lot width; however no one side yard dimension shall
be less than 0.4 of the total dimension for both side yards computed as
aforesaid, and no side yard dimension shall be less than 10 feet.
(3) The lot coverage and accessory structure setbacks applicable to those parcels
located in the Old Filed Map Overlap District shall be as set forth in Section
330-115D (4) and (5).
SECTION 3. Authority.
The proposed local law is enacted pursuant to Town Law §264 and §265 and Municipal
Home Rule Law §10(1)(ii)(a)(12) and §10(1)(ii)(a)(14).
SECTION 4. Severability.
If any section or subsection, paragraph, clause, phrase or provision of this law shall be
judged invalid or held unconstitutional by any court of competent jurisdiction, any judgment
made thereby shall not affect the validity of this law as a whole or any part thereof other
than the part or provision so adjudged to be invalid or unconstitutional.
SECTION S. Effective Date.
This Local Law shall take effect upon filing in the Secretary of State pursuant to Municipal
Home Rule Law.
AND BE IT FURTHER RESOLVED, that the Town Clerk is hereby directed to forward a copy of
the proposed law to the Southampton Town Planning Board as well as the Suffolk County
Planning Commission for their review and recommendations; and be it further
RESOLVED, that the Town Clerk is hereby authorized to publish the following Notice of
Public Hearing:

public hearing shall be held on March 25, 2014, at 6:00 p.m., at Southampton Town Hall,
116 Hampton Road, Southampton, New York, to hear any and all persons either for or
against a local law entitled: "A LOCAL LAW amending Town Code Section 330-55 to
establish lot coverage percentages and accessory structure setbacks on lots within the Old
Filed Map Overlay District."
Summary of Proposed Law
This amendment to Section 330-55B of the Town Code proposes to establish lot coverage
percentages and accessory structure setbacks (consistent with those established for other
nonconforming lots) for parcels located within the Old Filed Map Overlay District.
Copies of the proposed local law, sponsored by Supervisor Throne-Holst, are on file in the
Town Clerk's Office, Monday through Friday, from 8:30 a.m. to 4:00 p.m.
