A special meeting of the Board of Town Trustees was held Tuesday,
November 15, 1966 at 8:30 ~. M.
Present: Alvah Goldsmith, George Simpson, Frank Dawson, John F. McNulty,
and Douglas Robertson.
The Board travelled by car to visit various locations to inspect prop-
erties involved in applications pending.
The application of Henry Piechinski to bulkhead and dredge in the
vicinity of Sterling Harbor on the easterly side and south of the
Catholic Cemetery was studied. It appears that some of this proposed
work is within the boundaries of the incorporated village of Greenport;
some is on his own property and some in the waters of Southold Town.
Before this application can be acted upon the Trustees must have addit-
ional information as to just what areas are to be dredged and where
the fill will be deposited so as to determine the amount of Town owned
materials that will be involved.
The request from Larry Tuthill to inspect a bulkhead adjacent to Gull
Pond to determine whether or not it was located in Town waters was
discussed. The Board visited the site and unanimously decided that the
project was outside the Town Trustees jurisdiction as to the necessity
for a permit.
The Board visited the area north of Jockey Creek where George Ahlers
proposes to dredge a channel. The Board feels that the determination
as to this dredging should first be made by the Board of Appeals.
The Board visited the area filled in by William Victoria in Coreys
Creek. Th~ westerly boundary was measured and it was found that Victoria's
property line after the County dredge had completed it's bead of fill
in front thereof could not have been more than 200 feet from the south
west corner of a building shown on the aerial survey map, even allowing
for the subsequent natural grading off'of the filled material. Victoria
has filled at least 85 feet further than this line and this fill, if
naturally eroded, would extend the filled area much beyond the present
point. The Board is unanimous in the decision that Victoria must remove
this unauthorized fill.
The property involved in the application of Steve and Daniel Mitacchion?
to dredge a canal and fill a meadow area connecting with Broadwaters
Cove au~ west of land of Petrucci was inspected. The Board has request-
ed the~r~~e-a~ to pass on this request before any action is
taken.
The site of the proposed channel and boat basin requested by Henry
Smith was examined. The Board requires more information as to whether
or not the meadow will be filled-- whether the area will be bulkheaded
and where the fill will be deposited, particularly the fill that will
be taken from the arm of Corey's Creek.

The application of William Vander~eek~for permission to erect four
stakes in front of his bulkhead on an arm of Corey's Creek at Laughing
Water was approved. Fee $2.00.
The application of the Lauqhinq Water Property Owners Association for
permission to erect a bridge across the channel from their property
at the southeasterly side of Minnehaha Boulevard to the property on
the Bay was denied. The Board considers that the installation of perm-
anent pilings and structures of this nature in this location is not in
the best interests of the town. So~ type of floating walkway that has
at least a 20 foot opening might be considered by the Board.
The application of James Murrayto bulkhead and fill on his property at
Fisherman's Beach in Broadwaters Cove was considered. The Board visited
the supposed location but could not determine just where the proposed
work was to be done. Mo~ information as to location, amount of fill and
names of adjoining property owners is necessary~before a decision can
be made.(Mr. Rambo submitted the required information and the application
was granted. Fee $24.44.)
The application of Raymond J. Kenne¥ of Stillwater Avenue, Cutchogue,
was investigated. More information is necessary before action is taken.
This meadow land in front of Mr. Kenney's property should be preserved
if at all possible, in the opinion of the Board. An amended and detail-
ed description of what is proposed should be submitted for the Board's
consideration. None of the adjoining properties has been dredged or
filled and the Board is reluctant to establish any such precedent in
this area, particularly in view of the stand the Board has taken in
respect to all the areas of Broadwaters, Mud Creek and East Creek,
prior to the dredging therein.
The Board inspected the bulkhead erected in Mattituck Creek by Lizza in
view of the complaints made by the Mattituck Chamber of Commerce. The
Board does not consider the existing bulkhead to be any hazard to the
use of the Government channel. Surveys available to the Board indicate
that the Lizzas did not exceed the d~eded limits in the erection of the
bulkhead. They were advised by the Trustees that any encroachment on
Town waters beyond their legally owned boundaries would involve serious
penalties, and that the permits were issued subsequent to the actual
construction only upon that mutual understanding.
Applications approved at the previous meeting were signed.
