held at 7:30 p.m., December 5, 1978 at the Town Hall, M~n Road,
Southold, New York. Present were:

Trustee Hataier made a motion, seconded by ~Trustee Nickles~

November l, 1978 with the followinE correction. In the~ resolution
'regarding the. granting of a permit to Ralph Condit the-contractor's
n~me, J~mes H. Ramb~, Inc,, be included. ~ '
On motion made by Trustee Hataier, seconded by Trustee Nickles,
it was ' ~'
RESOLVED to approve the application of Charles S. Levien
to place a bulkhead and/Or retaining~wall off private property
of the applicant at East Creek, Cutchogue, subject to the
following:
1. A retaining wall be added along the southeasterly
boundary of the~property.
2. ~pPlicant'conf0rm with the 'building code for property
line setbacks.-
Vote'of the Board: Ayes: Horton, Harris, Hataier, Nickles,
Stoutenburgh
On motion made by Trustee Stoutenburgh, seconded by Trustee
Hataier, it was
RESOLVED to approve the application of Richard and Donnalee
Relvea to'place a'dock off private property of the applicant at
Mat%ituck Creek with the conditionthat the stationary part of
the dock does not protrude any further than an-imaginary line
drawn between the docks on either sideof this property.
Vote of the Board: Ayes. Horton, Harris Hataier, Nickles,
Stoutenburgh

On motion made by Trustee Stoutenbturgh, seconded_ by Trustee
Hataier, it was
RESOLVED tO approve the application ~f David and Delia Ricereto
to place a dock off private property of.the applicant'at the Lagoon,
Nassau Point, with the stipulation that the Board be notified if
there is any change in the location o£ the dock.
Vote of the Board:
Ayes: Herren, Harris, Hataier, Nickles,
Stoutenburgh

RESOLVED to approve the application 0fy!rginia,.$hec~er to
place a dock off private property 0f the applicant atJOckey
Creek with the following conditions:
1. The dock be located at the foot of the staircase.
2. The width not exceed four feet.

On motion made by President Herren, seconded by'Trustee Harris,
it was
RESOLVED to deny the application of Peter Kreh to place
floating dock off right-of-way at James Creek because Mr. Kreh
does not have exclusive use of the right-of-way°

If Mr..Kreh would like to submit an applicati0nfor a'dock on his
own Property which is adjacent, the Board would consider it,
On motion made by. Trustee Hataier, seconded, by Trustee Nickles,

RESOLVED to deny the application of Fra-~-k~ Pileski to place a
dock off right-of-way known as Rochelle Place oecause _~Ir. Pileski
does not have exclusive use of,.the rig_h_t-of-~my.

President Horton made a motion, seconded by Trustee Harris
and carried to notify Virginia VaD~okkelin that she is in violation
of the Code Of the Town of Southold in Ghat she has placed, a dock
at JAmes Creek without a permit. This permit wOuld he denied as
it is off the right~of-way known as RoChelle Place and ~she does
not have exclusmve use of the rzgh~ of-w=y,
The Town Attorney, Robert Tasker, has been consulted regarding
the above three matters and this was his advice to the Board.
On motion made by Trustee Harris, seconded by Trustee Hataier,
it was
RESOLVED to approve the application of Harry E. Evans to
place an offshore stake with pulley line to onshore stake at
town-leasedproperty at NarrOw River.
Vote of the Board: Ayes: Horton, Harris, Hataier, Nickles,
Stoutenburgh
On motion made by Trustee Nickles, seconded by Trastee Hataier,
it -was
RESOLVED to approve renewal of moorings on the list for
the monthof January with the exception of moorings #2 and #144
of RonaldLajda to be held for further investigation.
Vote of the Board: Ayes: Horton, Harris, Hataier, Nickles,

Trustee Nickles recommended that the Board of Southold Town
Trustees meet with the Town Attor~_ey regarding several matters
that the board has had under discussion. A suggested time was
3:45 p.m., Monday, December 18th. Mr. Tasker will be contacted
as to his availability~for-that day. .r~ -~
Harold Reese - letter from the Planning Board requesting any
comments theBoard of Town Trustees may have in connectiOn with
a proposal of Mr. Reese to extend his present canal in the
subdivision "Southold Shores" approximately 435 feet. This
matter is not in the jurisdiction of the Board of To~ Trustees
as it is all upland. There was some question of the fresh water
which is apparently on top of clay but which is not a source of
well wa~er in the community. Suggestion was made that James i.
Monsell, Supt. of Utilities of the Village of Greenport, beasked
for his recommendations and the Malcolm Pirnie report be referred
to.

Matt-a-Mar~ Trustee Stoutenburgh requested that the clerk write
again to the Town A~torne~y asking if the Board can rescind~the
1966 permit for bulkheading of this site. This will also..be
discussed at thsmeeting with the Town Attorney,~
The next meeting of the Board of Town Trustees willbe held
Tuesday, January 2, t978 at 7:30 p.m.
There being no £urther business to come before the Board,
Trustee Harris made a motion, seconded by Trustee Nickles and
carried to adjourn the meeting. Meeting adjourned at 9:00 p.m.
