THIS INDENTURE, made the 24th day of February nineteen hundred and ninety—six f� BETWEEN SAMUEL ELDRIDGE PETERS and VIRGINIA SICA—PETERS, his wife, both residing at 81 Short Hills Avenue, Short Hills, New Jersey 0707bTk .1,,7 ® f a{ 17 li party of the first part, and SAMUEL E., PETERS_ad VIRGINIA SICA—PETERS, both residing at 81 Short Hills—Avenue','Shrtrt 'Hills,-.....__ .__ New Jersey, 07078, as tenants in common and not as joint tenants, party of the second part, WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being i Ltha at Peconic, Town of Southold, County of Suffolk and State of New York, more particularly bounded and described as follows: 'BEGINNING at a point on the easterly line of Indian Neck Lane distant 150.00 feet, southerly from the southerly line of land now or formerly of Albert Sacco; thence from said point of beginning running thence North 69 degrees 24 minutes East 759.60 feet to the shores of Richmond Creek; thence along the shores of Richmond Creek on a tie line South 3 degrees 24 minutes West 163.91 feet to other lands of Peconic Bay Gardens, Inc. ; thence along said last mentioned lands South 69 degrees 24 minutes West 684.03 feet to the easterly side of Indian Neck Lane; thence along the easterly side of Indian Neck Lane, North 24 degrees 00 minutes West 150 feet to the point or place of BEGINNING. Said premises are commonly known and designated as 1925 Indian Neck Lane, at Peconic, in the Town of Southold, Suffolk County, New York. Being and intended to be the same premises conveyed to the partyof the first part herein by Deed of Peconic Bay Gardens, Inc. , a New York corporation, dated November 25, 1981 and recorded on December 1, 1981 in the Suffolk County Clerk's Office in Liber 9108, Page 231. Samuel Eldridge Peters and Samuel E. Peters are one and the same person. This is a conveyance between husband and wife; the purpose of this conveyance is to change the form of ownership of these premises from a tenancy by the entirety TAX MAP to a tenancy in common. DESIGNATION This conveyance is subject to easements and restrictions of record, municipal zoning ordinances, governmental regulations, and such state of facts as an accurate survey maydisclor D':t. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances Sm 86. and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of BIL 5 the party of the second part forever. 9.3 AND the party of the first pari covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
